					Drug and Alcohol Screening Contract
This proposal is specifically written for Excellent Experience Cleaning Service hereinafter referred to as the Company, by Trinity Behavioral Care, hereinafter referred to as the Agency. The Agency wishes to enter into an agreement with Company for the provision of drug and alcohol testing services whereby the Agency will be responsible to provide all services necessary to accomplish this goal. The Agency has the requisite skills and warrants that the Agency is, in every respect, qualified to provide services under this proposal. Term: The terms of this proposal is to be for one (1) year and will automatically renew on its anniversary date, unless terminated by either party, with or without cause, by tendering via certified mail or registered mail written notice to the other at least 60 days prior to cancellation. Confidentiality: The Agency understands the confidential nature of urine specimen testing. The Agency will disclose information concerning drug and alcohol testing results only to authorized representatives of the Company in compliance with applicable HIPPA, State and Federal laws, rules and regulations. Authorized Representatives:___Ms. Iris Davis ______________________________ ____________________________________________ Services: The Agency will provide Forensic Drug Testing services for the Company through its contracted laboratories. The Agency will, at all times, have necessary laboratory contracts in force to ensure that no gap in services to the Company will result. Appointments will scheduled and tentatively selected employee informed to bring: Photo ID/driver’s license and social security card. Annual Program Management Fees: Upon acceptance and agreement of this proposal, the Company shall pay to the Agency a special starter program administration (APA) fee of $_150.00. The APA fee will be renegotiated annually. Drug Testing Fees: Fees for drug testing services to be performed are set at $40.00 which includes collection per screening for non-DOT testing. There are no additional fees for MRO services. Pre-employment is to be paid by employee. Random, Reasonable Cause, Post-Accident will be billed to the Company. Included in the service are: 1. Pre-employment, post-accident, and reasonable cause testing 2. EMIT screening 3. GCMS confirmation 4. Two-day turnaround of negative results 5. Required documentation 6. Notification of test results 7. Tests performed by qualified laboratories 8. Courier services from collection site to laboratory 9. Specimen collection management 10. Certified laboratory analysis 11. Medical Review Officer (MRO) verification 12. Collection site identification and management 13. Blind specimen program 14. Annual summaries 15. Referral services, if indicated ***Please note there will be no additional fee for positive results. Alcohol Testing Fees: Fees for Alcohol Testing will be provided for $30.00 includes BAT charges. Record retention will be in strict accordance with Federal Regulations. All alcohol testing fees will be billed by the Agency.

Included in the services are: Alcohol screening and confirmation: Alcohol screening and confirmation will be a package. Alcohol test data collection/statistical reporting record retention, quarterly and annual summaries. Billing: The Company will be billed monthly for tests completed. In this way, billing can be cross-referenced as to individual employees or applicants. Payment terms will be net fifteen (15) days after the date of the invoice. Training: Employee and supervision education, for both substance abuse and alcohol abuse, to include materials is available at $100.00 per hour for set-up and $20.00 per individual new hire. Class size for education should be kept at a maximum of 20 persons. (SAP) Substance Abuse Professional referrals will be made to appropriate services and charged by provider to employee at standard agency fees; insurance and Medicaid accepted. Indemnification: The Agency agrees to defend, indemnify, and hold the Company, director, officers, employees, council members, and agents wholly harmless from and against all costs (including reasonable attorney's - fees), liabilities, claims, losses, lawsuits, settlements, demands, causes, judgments, and expenses arising from the performance of this agreement out of wrongful disclosures, breach of confidentiality or misuse of employee information to the extent that such costs and liabilities are caused by the negligence or willful misconduct of the Agency. The Company agrees to defend, indemnify, and hold the Agency and its directors, officers, employees and agents wholly harmless from and against all costs including reasonable attorney's fees), liabilities, claims, losses, lawsuits, settlements, demands, causes, judgments, and expenses arising from the performance of this agreement out of wrongful disclosures, breach of confidentiality or misuse of employee information to the extent that such costs and liabilities are caused by the negligence or willful misconduct of the Company. Representation and Guarantees: a. The Agency represents and guarantees that its contracted laboratories comply with all applicable Federal and State laws, rules and regulations applicable to the drug testing services offered under this agreement. b. The Agency represents and guarantees that its contracted laboratories are SAMHSA certified laboratories under DHHS mandatory guidelines for Federal Workplace Drug Testing programs, 53 FR 11910, Apri111, 1988 as amended. c. The Agency represents and guarantees that its contracted laboratories are certified for Forensic Drug Testing by the College of American Pathologists. d. The Agency, in the absence of circumstances beyond the control of the Agency, represents and guarantees that negative test results will be available to the Company within 24 hours from receipt at the laboratory. This applies to collection and receipt to the lab Monday through Thursday. Results from Friday tests sent out by lunch will be available before 5:00 P.M. the following Monday. Positive test will be run through a GC/MS process taking a Minimum of two (2) more days and confirmation by the MRO. f. The Agency will follow all FTA rules and regulations as set forth in subparagraph 49 CFR 653, 654, 40 concerning drug and alcohol testing of all CDL drivers. g. The Agency appreciates the opportunity to provide these services to the Company.

Confidentiality: Excellent Experience Cleaning Service agrees to abide by the Agency’s policy of confidentiality, which states that all information as to personal facts and circumstances given or made available to employees/volunteers and/or contractors of Trinity Behavioral Care in administration of programs shall be held confidential and shall not be divulged without consent of the programs and services and individual(s) to which it pertains. Confidential agency information and action shall not be divulged as expressly provided for in the federal confidentiality regulations, governing Confidentiality of Alcohol and Drug abuse Patient Records, 42 CRF Part 2, and the Health Insurance Portability and Accountability Act of 1996 (HIPAA), 45 C.F.R., Parts 160 and 164. Any unauthorized disclosure of confidential information may result in termination of this contractual relationship with Excellent Experience Cleaning Service and may be grounds for fines, penalties, imprisonment, civil suit, or debarment from doing business with the state.

Employee Handbook – Personnel Policy
(Not a Contract)

Responsibilities: As an employee of Excellent Experience Cleaning Service, you are required to account for the correct time you are on a job or service call. You must call in when you have completed a job before you go to next one, no matter what. You will be responsible for getting to and from work. Probationary Period: All new employees serve a minimum probationary period of 90 days. If the new employee does not meet normal, expected performance levels, he/she may be terminated at any time during the probationary period. Evaluation: After 90 days, the new employee will subject to a performance evaluation to determine permanent employee status. An evaluation may be given to each employee at least once a year after they are hired permanently to evaluate their performance and discuss any problems or to make changes to improve our company. Attendance: It is your responsibility to call in for yourself if you are unable to come in to work as soon as the office is open. If you are unable to call, a family member may call in immediately for you. As soon as you are able, you are expected to call.

After missing 3 days of work you will be required to bring a doctors note before you can return to work. If we do not hear from you within 3 days, we will assume you have voluntarily quit your job.
Employee Conduct: Employees are expected to behave professionally at all times while on the job presenting themselves as a representative of the company. Disciplinary actions shall be taken up to and including termination for unacceptable behavior. Phone Calls: There will be no personnel phone calls during company time. If there is an emergency, calls will come to the office and you will be contacted as-soon-as-possible. No cell phones are allowed on the job.

Dress Code and Appearance: Excellent Experience Cleaning Service will furnish uniforms for employees to ensure professional dress and that you are recognized as an employee of Excellent Experience Cleaning Service. As a representative of this company, each employee is expected to wear their shirttails tucked in, and hair/beard to be well kept. Also, as a safety issue, all males are not to wear jewelry; rings, ear ring(s), etc. while working on the job.

Employees are responsible for their uniforms. If you leave the company, either on your own or by termination, you must turn in your uniforms. Your last paycheck will be held until all of your uniforms (pants, shirts, jackets, and overalls) are turned in to the company. Vacation: You will be eligible for one-week vacation after being employed for a year at Excellent Experience Cleaning Service. You must put in a request to employer at least two weeks before taking vacation for approval. Substance Abuse: It is the intent of Excellent Experience Cleaning Service to provide a safe and drug free environment for our employees by having a “Zero Tolerance” Alcohol and Drug Policy. Alcohol or illegal drug use on the job will not be tolerated. All tentatively selected applicants must pass a drug screen test prior to hire. All employees are subject to reasonable cause, and post accident testing. (Always keep the names of the medications with you. Should a drug/alcohol test be required, you will need to be able to furnish this information). Anyone testing positive, will automatically be terminated for non-compliance with Personnel Policy If you are taking any prescription drugs that may make it unsafe for you to work, you must notify owner/supervisor immediately. EMPLOYEE TO EMPLOYER NOTIFICATION As a condition of employment, the employee agrees to notify the Company of any criminal drug statute conviction for a violation occurring in the workplace no later than five calendar days after the conviction. "Criminal conviction" means a finding of guilt, an imposition of a sentence, a plea of no contest, or a plea of guilty.

NOTIFICATION OF FEDERAL AND STATE CONTRACTING/GRANTING AGENCIES The Company will notify federal and state contracting and granting agencies of all instances where employees have been convicted of drug violations occurring in the workplace within ten days after receiving notice of the conviction. DRUGS FOUND IN THE WORKPLACE Law enforcement authorities will be notified whenever illegal drugs are found in the workplace. Anyone having illegal drugs in the workplace or testing positive for drugs or alcohol will be automatically terminated. Injury on the Job: ' If you are injured on the job, you must notify office personal immediately to follow workman's compensation protocol in filling out required paperwork from Insurance company and meet OSHA Guidelines. If you are injured on the job you are subject to a postaccident drug screening immediately.

THIS POLICY MANUAL FOR EXCELLENT EXPERIENCE CLEANING SERVICE IS INTENDED TO PRESCRIBE GENERAL POLICY GUIDELINES FOR ALL EMPLOYEES. IT IS NOT IN ANY MANNER TO BE CONSTRUED AS A CONTRACT BETWEEN ANY EMPLOYEE AND EXCELLENT EXPERIENCE CLEANING SERVICE.

This Policy was developed and to become effective _______________, 20__. All employees are required to sign this form stating they have received a full copy of the Employee Handbook – Personnel Policy.

THE PURPOSE OF THIS POLICY IS TO INFORM AND GIVE EMPLOYEE GUIDANCE AS TO WHAT IS EXPECTED OF THEM AS AN EMPLOYEE AND WHAT THEY CAN EXPECTED FROM THEIR EMPLOYER.
