Secretariat Update
Mr. Cassarino reported that 2010 filings to-date have been consistent with the
projections.
Mr. Emard noted that a number of questions regarding ACTA and Part 68 has been
received and addressed by the Secretariat. Mr. Cassarino expressed his thanks
to the ACTA Chair and the IS Reps that assisted in answering the questions
received by the Secretariat.

ACTA-10-019: TR 41 Liaison Report

Comparisons 2003-2010
Mr. Bipes reviewed ACTA-10-019, TR 41 Liaison Report. He highlighted a number of
sections including, 4, 11, and 12 which were of interest to ACTA.
Mr. Bipes and Mr. Mulvihill reviewed ACTA-10-019a, ACTA and Industry Canada
Fiscal Year Comparisons 2003-2010 detailing the filings over the past few years.
Participants discussed the contribution and a number of questions were asked of
Mr. Mulvihill.
One question was regarding what type of device was being defined as a handset. In
response it was noted that a handset was a device that had to comply with Part 5
and HAC rules, but did not connect directly into the PSTN.
It was noted that ACTA does not have this category because in the United States
and Standard IP phones are not regulated by the Part 68 rules.
It was asked if Industry Canada maintained a public listing of all companies/devices
that register with them. Mr. Mulvihill added that this information is public and
available via the Industry Canada website.
A question was raised about Industry Canada’s duel role in administrating the
registration of devises, as well as its role in enforcement for lack of registration.
Mr. Mulvihill noted that Industry Canada does do market surveillance to ensure
that the rules are being followed.

A follow up question was raised, regarding any correlation between the market
surveillance and the number of devices registered. Mr. Mulvihill noted that he
was unaware of a direct correlation. He added that the goal of market
surveillance was to help “offenders” w/ education of the registration process;
monetary penalties are only issued after education takes places and compliance
does not occur.
Working Group Reports
1. ACTA WG on Enforcement
Mr. Bush was unable to attend the meeting and Ms. Conn gave the WG report on his
behalf.
Ms. Conn noted that the WG met in November and 4 of the 5 members were
present. The WG reviewed the reason for its creation and discussed what the
goals would be moving forward. The WG specifically discussed the suggestion
for ACTA to go to Capitol Hill in order to get enforcement support. It was
determined that the best path would be for ACTA to circle back w/ its FCC
contacts first. Lastly, the group discussed creating a possible timeline for the
enforcement goals, and it was decided that further discussions would be needed.
The next WG meeting will be held on December 8th and Mr. Bishop was added to the
WG.
2. ACTA WG on Smart Grid and other new Technologies
Mr. Salinas reported that no meeting has been held as no new technologies were
brought before the group for review.
Old/New Business
3. Announcement of New Data Validation Program
Mr. Cassarino gave a summary of the Data Validation Program which will be
launched on or around January 1, 2011. As mandated by the FCC, ACTA must
operate and maintain an accurate database of compliant equipment.
Unfortunately over time, the information regarding the Responsible Parties
associated with compliant TTE has become outdated causing several
complications. The Data Validation Program is a process to update Responsible
Party information on an annual basis to ensure as much of the information
contained in the Part 68 database is accurate and up to date.
It was noted that the Data Validation Program was different from a transfer of
ownership and that the transfer of ownership process will remain unchanged.
It was noted that there would be a broad dissemination of information regarding this
program to the industry. It was suggested that the Secretariat use industry
publications, as another method of sharing the information.
Notice of approval of 2011 Budget
Mr. Emard noted the budget was approved and that filing costs would remain
unchanged for 2011.

Mr. Emard noted that there are a number of openings on the Executive Committee
for Industry Segment Representatives. ACTA Members are encouraged to reach
out to colleagues in the Industry to try and fill these positions, especially
participants within TIA TR41.
Mr. Derr added that TIA agrees that this is an excellent suggestion, and will take
some steps to try and fill the open positions.

COMMENTS OF THE
ADMINISTRATIVE COUNCIL FOR TERMINAL ATTACHMENTS
Summary
As part of the Commission’s 2010 Biennial Review of Telecommunications
Regulations, the Consumer & Governmental Affairs Bureau has requested comments
concerning the rules in Part 68 pertaining to hearing aid compatibility (HAC). There can
be no doubt that HAC requirements have served the public interest by making
telecommunications accessible to the hearing impaired. The Administrative Council for
Terminal Attachments (ACTA) supports the Commission’s efforts to promote HAC by
administering a publicly accessible database of terminal equipment that has been
approved as compliant with Part 68 and the technical criteria published by the ACTA.
Since the Commission turned the administration of the approved terminal
equipment database over to ACTA ten years ago, there has been a steady year over year
decline in the number of terminal equipment listings. The decline has been much sharper
in the U.S. than in Canada. The ACTA believes the primary reason for this difference is
that Canada has a more rigorous enforcement program than the U.S.
During the past ten years, observers have reported to the ACTA that telephones are
being sold in retail stores which are not labeled in accordance with ACTA labeling
specifications and are not listed in the ACTA database. The ACTA has in the past given
samples of such non-compliant devices to the Commission, but is not aware of any
Commission enforcement action with regard to those products.
When telephones are not listed in the ACTA database of approved terminal
equipment, there is no guarantee that the phones have actually been tested for Part 68
compliance and actually comply with the Commission’s HAC requirements in Part 68.
Such a situation can lead to telephones with poor quality HAC infiltrating the
marketplace. Telephones that do not comply with the Commission’s HAC rules in Part
68 and/or ACTA labeling requirements are not in the public interest because such
telephones impede accessibility to telecommunications by hearing impaired individuals.
The best way to resolve this problem is for the Commission to emphasize the HAC
rules and ACTA database listing process in Part 68 through public notices and workshops
and to institute more rigorous enforcement efforts. In addition, the Commission should
modify Part 68 to clarify that VoIP phones must meet the HAC and Volume Control rules
in Part 68 and be listed in the ACTA database of approved terminal equipment.
I. Background
The Administrative Council for Terminal Attachments (“ACTA”) was established
pursuant to the Commission’s Report and Order in the 2000 Biennial Review of Part 68
of the Commission’s Rules and Regulations, CC Docket No. 99-216, FCC 00-400,

adopted November 9, 2000 and released December 21, 2000 (“Order” or “R&O”). The
Order privatized the process by which technical criteria for the prevention of harm are
established for terminal equipment sold for connection to the telephone network, and for
the approval of such equipment to demonstrate compliance with the relevant technical
criteria. The Order directed the industry, through the co-sponsorship and support of the
Telecommunications Industry Association (“TIA”) and the Alliance for
Telecommunications Industry Solutions (“ATIS”) to establish the ACTA as the open
body that would assume the Federal Communication Commission’s Part 68 role for those
items privatized in the Order. (Section 68.602)
The Commission tasked ACTA with responsibility for administering key aspects
of the Commission’s rules in 47 C.F.R. Part 68 aimed at preventing harm to the telephone
network caused by the connection of terminal equipment and associated wiring including:
(1) adopting technical criteria and acting as the clearing-house for the publication of
technical criteria for terminal equipment developed by ANSI-accredited standards
development organizations; and (2) establishing and maintaining a registration database
of equipment approved as compliant with the technical criteria. ACTA fulfills its mission
through an open and consensus-based process and with active participation from key
stakeholders, including service providers, manufacturers, testing laboratories and other
interested parties.
II. Discussion
As part of the FCC’s 2010 Biennial Review of Telecommunications Regulations,
the Commission seeks to “determine whether any such regulation is no longer necessary
in the public interest as the result of meaningful economic competition between providers
of such service.” The Commission may repeal or modify any regulations that it finds are
no longer in the public interest. The Consumer & Governmental Affairs Bureau has
requested comments concerning the rules in Part 68 pertaining to hearing aid
compatibility (HAC).
There can be no doubt that HAC requirements have served the public interest by
making telecommunications accessible by the hearing impaired. The Administrative
Council for Terminal Attachments (ACTA) supports the Commission’s efforts to
promote HAC by administering a database of terminal equipment that has been approved
as compliant with Part 68 and the technical criteria published by the ACTA.
Since the Commission turned the administration of the approved terminal
equipment database over to ACTA ten years ago, there has been a steady year over year
decline in the number of terminal equipment listings. While a general decline in wireline
terminal equipment approval listings over the past ten years in North America has not
been isolated to the U.S., the decline has been much sharper in the U.S. than in Canada.
Through discussions with the Commission’s counterparts in Canada, the ACTA has
determined that the more moderate decline in the number of terminal equipment listings
in Canada is due in large part to Canada’s more aggressive enforcement activities.

During the past ten years, observers have reported to the ACTA that telephones are
being sold in retail stores in the U.S. that are not labeled in accordance with ACTA
labeling specifications nor listed in the ACTA database. There is no guarantee that such
telephones have been tested for HAC and actually meet the Commission’s HAC
requirements in Part 68. Such a situation can cause poor quality HAC to infiltrate the
market.
When terminal equipment does not meet the Hearing Aid Compatibility and
Volume Control requirements of Part 68, it can create accessibility problems for hearing
impaired users. Non-compliant devices can produce poor quality audio that hearing
impaired users may not be able to discern as a device non-compliance problem, as
opposed to a network problem or a worsening of their hearing impairment. Telephones
that do not comply with the Commission’s HAC rules in Part 68 and/or ACTA labeling
requirements are not in the public interest because such telephones impede accessibility
to telecommunications by hearing impaired individuals.
HAC compliance can only be determined through thorough testing and the public
can only be assured of compliance through the terminal equipment approval process
defined in Part 68, including the listing of approved products in the ACTA database.
The ACTA has in the past given samples of improperly labeled terminal equipment
and terminal equipment not listed in the ACTA database of approved terminal equipment
to the Commission, but is not aware of any Commission enforcement action with regard
to those products.
The best way to resolve the problem of improperly labeled terminal equipment and
terminal equipment not listed in the ACTA database of approved terminal equipment is
for the Commission to emphasize the HAC rules and ACTA database listing process in
Part 68, through public notices and workshops, and to institute more rigorous
enforcement efforts. In addition, the Commission should modify Part 68 to clarify that
VoIP phones must meet the HAC and Volume Control rules in Part 68 and be listed in
the ACTA database of approved terminal equipment.
III. Conclusion
ACTA appreciates the opportunity to provide comments in this proceeding and
welcomes the FCC’s participation in ACTA’s semi-annual (March and September) face-
to-face public meetings in Washington D.C. and its semi-annual (June and December)
public conference calls.
