5. DOS Responds to Grassley's Concerns over B-1 in Lieu of H-1B The Department of State (DOS) sent a
May 13, 2011, letter to Senator Grassley in response to the Senator's concerns over alleged misuse of
the B-1 visa program. DOS states that it is working with DHS to "consider removing or substantially
amending" the B-1 in lieu of H-1B provision in the FAM. The B-1 in lieu of H-1B provision came under fire
with the filing of a civil complaint against Infosys Technologies, alleging that the company illegally
employed B-1 visa holders on company projects in an effort to avoid the restrictions and limitations of

7. DOS Announces Changes to Iranian Student Visa Validity The Department of State announced that as
of May 20, 2011, certain qualified Iranian applicants for visas in the F, J, and M categories are eligible for
two-year, multiple entry visas. This is an increase in the current visa validity of three months, single

8. CBP Border Patrol Apprehension Statistics U.S. Customs and Border Protection (CBP) released
statistics on the total number of apprehensions of undocumented individuals by fiscal year, from FY1999
through FY2010. The report also includes a breakdown of apprehensions from Mexico, and from

9. H-1B/H-2B Counts FY2012 H-1B Cap CountUSCIS updated its count of FY2012 cap-subject H-1B
petitions and advanced degree cap-exempt petitions. As of May 20, 2011, approximately 12,300 H-1B
cap-subject petitions were receipted. USCIS has receipted 8,500 H-1B petitions for aliens with advanced

FY2011 H-2B Cap CountAs of May 20, 2011, USCIS receipted 27,788 petitions toward the 33,000 H-2B

10. DOL Announces Back Wages and Penalties for H-2A ViolationsThe Department of Labor announced
an order for Global Horizons, Inc. to pay $153,000 in back wages to 88 workers, plus $194,000 in
penalties, for violating provisions of the H-2A program. Under the order, Global Horizons will be
