Eviction is the process of removal of tenant from the

premises by the house owner. The landlord serves the tenant with an

eviction notice if he has disagreement with him or if the tenant violates

the lease on any specific rules. The process of serving notice need not

necessarily be the first step of the landlord. Initially he can talk to

the tenant and if he agrees to make good the mistake then the problem can

be mutually settled between them. Notice should be given only when the

tenant is not ready for compromise. As per the available jurisdiction

laws, the eviction is also called as summary possession, and unlawful

detaining tool. The term eviction is often used by the landlord for

removing the unwanted tenant from his house. As per the state

laws it is mandatory for the landlord that he should win the trial of

eviction notice for removing the tenant from the premises. And if the

court feels the reason is valid it may give less than a week for the

tenant for shifting and vacating the house. You should be familiar with

the state law and jurisdictions before serving the tenant with a notice.

Ensure the reason for giving notice is also valid and strong. Not all the

house owners vacate their tenant by giving notice. You should first have

an open conversation with the tenant and wait for some reasonable time.

If you still feel strongly that the tenant is unlawful and violating the

norms of lease you can further proceed for giving notice.For

terminating the tenancy the landlord has to give a quit notice before

initiating legal proceedings. The case will be decided in favor of

landlord if the tenant has violated the lease by not paying rent or

involved in any damaging activity. Usually the period for vacating the

house will be decided by the court. Though each state follows different

jurisdiction most of them have one thing in common. If the case is

genuine and has a valid reason the landlord is sure to win the case.

Remember one thing. No house owner has absolute right to throw out the

tenant just by giving eviction notice, even though the cause is

reasonable. He has to patiently wait for the stipulated time and obey the

court order for removing the tenant.
