2010 ANNUAL REPORT
PERSONNEL BOARD
The Personnel Board is established in CBJ Code 44.05.060 “Personnel Board,”
and is an appeal board consisting of volunteer members from the community with an
interest in human resource issues and labor law. The board does not have a regular
meeting schedule, but is called upon when matters arise which require board assistance
and review.
The Board met January 7, 2010 and voted to sever the issues of PCN 15005 Fire
Training Officer and PCN 15006 EMS Training Officer from the issue of PCN 15201
Deputy Fire Marshal, in the Petition for Bargaining Unit Clarification filed by IAFF on
November 16, 2009. The Board also voted to grant the IAFF petition with regard to PCN
15005 and PCN 15006, and determine the two positions be included in the Fire Fighters
Bargaining Unit currently represented by the IAFF. At the same meeting, the board
rejected as untimely the November 6, 2009 CBJ Petition for Bargaining Unit
Clarification for positions located within the Records Unit at the Juneau Police
Department.
On January 20, the Board held a hearing on a Petition for Bargaining Unit
Clarification to include PCN 15201, Deputy Fire Marshal, in the Fire Fighters Bargaining
Unit. In its decision dated February 4, 2010, the Board determined that the petition of the
IAFF for bargaining unit clarification to include the Deputy Fire Marshal position, PCN
15201, in the Fire Fighter Bargaining Unit currently represented by the IAFF, was denied
and dismissed.
On March 31, the Board voted to accept a petition filed March 3, 2010 by the
Public Safety Employees Association, Inc. /AFSCME Local 803 (PSEA) regarding a
Community Interest Rule 4.10 Re-Inclusion Petition. The Board set Friday, April 9,
2010 for the election on Bargaining Unit Representation, from 8 a.m. to Noon, with the
election to be conducted by the CBJ Human Resources staff. The Board directed that the
Notice of Election will be posted no later than close of business on April 2, 2010.
On April 15, the Board voted to certify the election as outlined in Order No.
2010-03: Certification of Results of Election on Re-Inclusion of JPD Records Unit and
Evidence/Property Specialist In Police Department Bargaining Unit.
On June 10, the Assembly ruled on an appeal from the CBJ Personnel Board
(“Board”), timely filed by the International Union of Operating Engineers, Local 302,
(“Union”), regarding the formation of a separate bargaining unit for the Airport Field
Maintenance employees at the Juneau International Airport. The Board denied the
Union’s petition, and the Union appealed to the Assembly. The Board found, after
hearings and briefing, that the Airport Field Maintenance employees could not form a
separate bargaining unit under the CBJ Code and Board Rules, despite the fact that the
same group of employees had been earlier found by the Board to have a “community of
interest” sufficient to allow them to withdraw from representation by their former union,
MEBA, in 2008. The Assembly stated in its ruling that the Personnel Board properly
weighed all relevant factors in reaching its determination that the Airport Field
Maintenance employees group is not an appropriate bargaining unit despite the fact that it
has a community of interest.
The Board held two meetings in June and a meeting in August to review the
Personnel Board Rules of Procedure in its entirety. The Board heard and considered
comments on suggested changes to the rules from representatives of the Central Labor
Council at the meeting in August. The Board submitted the updated rules to the
Assembly for consideration. The Assembly adopted Resolution 2546, A Resolution
Adopting Amendments To The Personnel Board Rules Of Procedure And Repealing
Resolution No. 2471. at its regular meeting of November 8, 2010.

Ms. Cahill’s and Ms. Porters’s terms expire at the end of January. Term limits apply to
this board, however, do not apply to either member as they are both finishing their first
term. Both have reapplied for a position on the Personnel Board.
