DRUMORE TOWNSHIP SUPERVISORS
August 4, 2005 Minutes
The Drumore Township Supervisors met on Thursday, August 4, 2005, beginning at 7:30 p.m.
in the Municipal Building located at 1675 Furniss Road, Drumore, Pennsylvania, as advertised.
1. Call to Order – Chairman, Thomas W. Aaron, called the meeting to order and presided.
Anna Morris was present as Secretary. Board members, Ralph I. McLaughlin, Jr. and
Robert S. Holzhauer, were present along with those listed on the attached Attendance Sheet.
Kim Carter Paterson, Solicitor, was present.
2. Approval of Board Minutes –
- Clarification – Mr. Holzhauer questioned the minutes from July 7 “Hearing Officer,
Attorney Matthew Crème, closed the record of testimony after the June 16 Conditional
Use Hearing. A schedule was put in place that will not produce a decision much before
the end of the year.” He was concerned that the application would be approved due to
being out of line with the 45 days response time. Mr. Notturno explained that all parties
had stipulated certain procedures and along with a time table and this would override
the zoning ordinance.
- Mr. McLaughlin moved and Mr. Holzhauer seconded the motion to accept the July 7,
2005 minutes as presented. All voted yes and the motion carried.
3. Proposed Amendment to Zoning Ordinance
- On October 7, 2004 the Board adopted a resolution to initiate an amendment to the
Zoning Ordinance on size restriction of 100,000 square feet of gross leasable area for
shopping centers within the Township. The amendment was enacted on December 2,
2004.
- This public hearing is to consider adoption of an amendment to the official zoning
ordinance of Drumore Township to repeal the December amendment to the Ordinance
addressing square footage limitations to shopping centers within the Township.
- Proper advertisement and postings were made.
- Public Comment Time – Procedures for comments were reviewed.
The following people spoke against repealing the December amendment to the Zoning
Ordinance:

- Gail McSparran – 1040 Goshen Mill Road, Peach Bottom
- Charles Smithgall – 1451 Harmony Ridge Road, Drumore
- John Carter – 1322 Silver Spring Road, Holtwood
- Judy O’Brien – 1426 Susquehannock Drive, Drumore

- Todd Sheaffer – 1051 Silver Spring Road, Drumore
- John Ferreira – 1126 Fishing Creek Hollow Road, Quarryville
- Thomas Consylman – Slate Hill Road, Peach Bottom
- Robert Gerhart addressed the Board on how he felt that the three townships in the
area of the proposed shopping center should be financially involved with Drumore
Township. Mr. Gerhart agreed that the proposed amendment should not be
approved to repeal the December amendment.
The following had comments concerning raising taxes and driving the farmer out of the
Township:
- Charlotte Trimble
- Delmar McCauley
- Representative Gibson Armstrong offered two statements:
- Apology for his inappropriate statement about the Board of Supervisors in the
newspapers awhile ago.
- Money – He and Senator Armstrong will pledge $10,000 each to the cause.
Finding resources will be his number one priority.
- Ken Notturno, representing SORCE, was concerned with the message the Board
would be sending to developers if they repealed the December amendment. He
urged the Board to keep the amendment. He asked that communication be made
with the surrounding townships to see if there is any support. He suggested that the
residents from those townships make the contact. Mr. McLaughlin asked Mr.
Notturno to find out what is legal for the Township to accept from others, especially
SORCE.
- Scott Stauffer asked Board members to table the decision until the community can
look for funding. He asked that the Board work with the developer. He reminded
the audience that with Representative Armstrong we have to pay. We lost a good
Township Supervisor because of him and he was instrumental in bringing in the
developer for the proposed shopping center. He felt that Representative Armstrong
should just leave us alone.
- Charles Smithgall challenged the Armstrongs with a match dollar to dollar in a
cannon shoot at his farm.
- Decision – Mr. Holzhauer moved to table the decision until the October meeting giving
time to search for funding. Mr. McLaughlin seconded the motion and the motion
carried. Board members agreed that getting resources to finance the legal battle with
the developer was their main priority. Various members of the audience questioned
how they could contribute to the Township. Mr. Notturno indicated that the private
citizen could at any time contribute to the Township; but a group like SORCE
contributing could be a problem.
- Recess – Mr. McLaughlin moved to go to a short recess. Mr. Holzhauer seconded the
motion and the motion passed.
- Reconvene – At 9:15 p.m. on motion by Mr. Aaron, second by Mr. McLaughlin the
board members returned to the regular meeting. All agreed.
4. Treasurer’s Report – Mr. Holzhauer moved and Mr. McLaughlin seconded the motion to
accept the treasurer’s report as presented. All voted yes and the motion carried.
Treasurer’s Report – A motion to accept the treasurer’s report is recommended.

5. Comments from the Audience – Mr. Aaron presented a time for comments from the
audience and there were none.
6. Reports
Zoning Officer/Engineer – Mark Deimler, Zoning Officer, presented the zoning officer
report for July that is attached. Mr. McLaughlin moved and Mr. Holzhauer seconded
the motion to accept the report. All agreed.
Sanitation Enforcement Officer – The Secretary read the SEO’s report that is attached.
Mr. McLaughlin moved and Mr. Aaron seconded the motion to accept the report. All
agreed.
Planning Commission – The Secretary read the minutes of the Planning Commission
that are attached.
Emergency Coordinator – Nancy Carter, Coordinator, announced that all were invited
to the Peach Bottom picnic on September 9 at 4:30 p.m. at Muddy Run Park. The
Providence Ambulance would like to piggyback with us to use our high band on an as
needed basis. Mr. McLaughlin moved and Mr. Holzhauer seconded the motion to
approve this request on the condition there would be no cost to the Township and if
there was interference they could not use it. Nancy will write the letter to Providence
Ambulance with these conditions. The Muddy Run dam alert system sounds the second
Thursday of the month at 10:00 a.m.
Representative of the Board for the Road Workers – Robert Holzhauer reviewed the
report that is attached.
Steering Committee for the Comprehensive Plan – Ralph McLaughlin, Township
Representative, gave the draft ordinance to the Solicitor for review and advertisement.
The County will be paying for the Comprehensive Plan update.
Tax Collector – There was no report.
Southern Lancaster County Intermunicipal Council – Ralph McLaughlin reported that
some Townships would like to have more than one firm to process building permits.
7. Unfinished Business
7.1 Road Material Bids – Liquid Fuels Funds (State)
- Slate Hill Road and Prawls Hollow Roads Reclamation Bids – Two companies bid
on the reclamation of portions of Slate Hill and Prawls Hollow Road. The Board
of Supervisors has reviewed the bids and conditionally awarded the contract to the
low bidders at their July 7 meeting. After further review and meetings with the
PennDOT representative and bidders, the Board reviewed the total package of
bids received and decided the project should be downsized to allow the work to be
done in 2005. Mr. McLaughlin moved and Mr. Aaron seconded the motion to
reject both bids received for the reclamation project of Slate Hill Road and Prawls
Hollow Road.
- Slate Hill Road Project – The downsized road maintenance project for 2005 would
be to apply ID-2 Binder and ID-2 Wearing to Slate Hill Road from River Road to
Spring Valley Road and place ID-2 Wearing Scratch on various roads throughout
the township. Mr. McLaughlin moved and Mr. Holzhauer seconded the motion to
approve this project.

- Award of Contract – Mr. Holzhauer moved and Mr. McLaughlin seconded the
motion to award the contract to the lone bidder for the Slate Hill Road project, or
McMinn’s Asphalt Company. A copy of the bid is attached.
7.2 Insurance Meeting – On July 25 the Board members met with a representative of H.
A. Thomson, Inc., our insurance company. The representative reviewed rates for the
upcoming year and updated our equipment listing with the insurance company. No
formal actions were taken at this meeting.
7.3 Vacation of a Portion of Benton Hollow Road – Solicitor, Kim Carter Paterson
updated the Board on the ongoing vacating of the dirt portion of Benton Hollow Road.
She has contacted the railroad and they do not agree with the vacating of the road.
Once clarified on other approaches to the railroad, the ordinance will be readvertised
for action by the Board.
7.4 Ordinance to Rename Township Road – There has been brought to the attention of the
Board by the Lancaster County Emergency Management Agency that there is a
conflict between the Township map and the addresses of residents in the Township on
a certain road. Susquehannock Drive, from Fishing Creek Hollow Road to the River,
is listed on the Township map as Fishing Creek Hollow Road and apparently the
residents on this portion of the road have had their address as Susquehannock Drive
for some time. After thorough review it is recommended that an ordinance be
approved to change that portion of the road to Susquehannock Drive on all Township
maps.
8. New Business
8.1 Draft Housing Element Update Goals, Objectives and Strategies and Growth
Management Element Update Summary – The Lancaster County Planning
Commission has sent the Board a hard copy of these documents for review.
Comments on these documents can be offered to the LCPC. Full drafts of these
documents are anticipated to be completed and released by late summer/early fall
2005 for a publicly-noticed 45-day comment period. No action was required.
9. Review of Plans – No action was required.
9.1 Lancaster County Planning Commission
- Suzanne E. Salisbury – Conditionally approved the Plan as requested.
- J. Robert Findley – Conditionally approved the Add-On Plan as requested.
9.2 PA Department of Environmental Protection -
- Paul L. Hess subdivision plan is adequate and SEO can issue permits.

11. Bills – Mr. McLaughlin moved and Mr. Holzhauer seconded the motion to pay all July
invoices as presented. All agreed.
12. Dates to Remember

August 22 – Zoning Hearings at 7:00 p.m.
August 30 – Planning Commission at 7:00 p.m.
September 1 – Board of Supervisors Meeting at 7:30 p.m.
13. Comments from the Audience – Frank Weigand volunteered to clean off the graffiti from
the “Slow Children Ahead” signs on Deaver Road.
14. Adjournment – With no further business, at 9:40 p.m., the meeting was adjourned on
motion by Mr. McLaughlin, second by Mr. Holzhauer and unanimous agreement by all.
