TEMPORARY LEASE
This Temporary Lease (hereinafter termed as the “Lease”) is made on ____ [Month] ____
[Date], 20____ by and between _____________________________ [Instruction: Insert the

Insert the address of Owner] (hereinafter termed as the “Lessor”), which expression shall
include its heirs, successors and assigns where the context so admits, does hereby lease to, and

residence at _____________________________ [Instruction: Insert the address of Tenant]
(hereinafter termed as the “Lessee”) which expression shall include its heirs, successors and
assigns where the context so admits. Lessor and Lessee may individually be referred to as the
“Party” and collectively be referred to as the “Parties” agreed upon the following terms and
conditions:
1. PREMISES: The Lessee hereby Leases the following described Property (hereinafter
referred to as the “Premises”):

4. RENT: The Lessee shall pay the Lessor the full amount of the rental by ___ [Month] ___
[Date], 20___ at the rate of ________ ($___) [Instruction: Insert the rent amount E.g.,
Fifty dollars only ($ 50)] per day, a total amount of ________ ($___) [Instruction: Insert
the amount E.g., Five hundred dollars only ($ 500)]
5. SECURITY DEPOSIT: Lessee shall deposit with Lessor the sum of ________ ($___)
[Instruction: Insert the amount E.g., One hundred dollars only ($ 100)] as a Security and
Damage Deposit. The Security Deposit will be held until the Premises has been returned to
Lessor in good condition and in the manner in which they were received (no damage or
missing items, with the exception of ordinary wear and tear and damage from natural causes
including the elements and fire, not caused by Lessee). If all terms have been met, as outlined
in this Lease, the Security Deposit will then be returned to Lessee, in full, within Thirty (30)
business days of the check-out date, as per Section 7.1, Title 47- Property, Chapter 16-
Leasing of Real Property, of North Dakota Code.
6. PETS: No pets will be permitted by the Lessee at the above mentioned Premises.
7. ACCESS: Lessee shall allow Lessor access to the Premises for purposes of repair and
inspection. Lessor shall exercise this right of access in a reasonable manner. Lessor shall give
Lessee reasonable notice before exercising this right of access, except in case of emergency.
8. INDEMNIFICATION: The Lessee shall hold harmless and indemnify the Lessor against all
liabilities of every kind and character, settlements, costs, charges, damages, expenses,
including, but not limited to, attorney fees, which may be imposed upon, incurred by, or
asserted against Lessor by reason of:
a. any failure on the part of the Lessee, its successors, heirs, assigns or agents to perform or
comply with any conditions required to be performed or complied with by the Lessor
under this Lease; or
b. any injury to person, or loss of, or damage to property of any nature whatsoever sustained
or occurring on the Premises on account of or based upon the act, omission, fault,

negligence or misconduct of any person whomsoever other than the Lessor, its employees
and agents.
9. MODIFICATIONS: No changes to this Lease shall be considered binding unless attached in
writing to this document and signed by both the Parties.
10. TERMINATION: This lease may be terminated at the sole discretion of the Lessor.
Notification will be provided to the Lessee at least ___________ (___) [◊ Instruction:
Insert the number of days e.g. Ten (10)] days in advance of the Lease term.
11. COMPLIANCE WITH LAWS: The Lessee acknowledges that no trade or occupation shall
be conducted in the Premises or use made thereof which will be unlawful, improper, noisy or
offensive, or contrary to any law or any municipal bylaw or ordinance in force.
12. LEASE ASSIGNMENT: The Lessee shall not assign or sublet the Premises of the Lessor
without written approval of the Lessor.
13. FORCE MAJURE: Neither Party shall be liable under this Lease should performance
become impossible due to events beyond their control, such as Acts of God, hurricanes,
floods, governmental actions, or other unforeseen actions which are out of the control of both
the Parties.
14. GOVERNING LAW: This agreement shall be construed and governed according to the
laws of State of North Dakota.
