12   9 OF THE CONSTITUTION OF THIS STATE AND SECTION
13   2-1-180 OF THE 1976 CODE, WHEN THE RESPECTIVE
14   HOUSES OF THE GENERAL ASSEMBLY ADJOURN ON
15   THURSDAY, MAY 21, 2009, NOT LATER THAN 5:00 P.M.,
16   EACH HOUSE SHALL STAND ADJOURNED TO MEET AT A
17   TIME MUTUALLY AGREED UPON BY THE PRESIDENT
18   PRO TEMPORE OF THE SENATE AND THE SPEAKER OF
19   THE HOUSE OF REPRESENTATIVES NO LATER THAN
20   JUNE 30, 2009, FOR A PERIOD NOT TO EXCEED THREE
21   STATEWIDE       LEGISLATIVE   DAYS    FOR    THE
22   CONSIDERATION OF CERTAIN MATTERS, TO PROVIDE
23   THAT WHEN EACH HOUSE ADJOURNS AFTER THIS
24   THREE-DAY PERIOD NOT LATER THAN 5:00 P.M. ON THE
25   THIRD LEGISLATIVE DAY, EACH HOUSE SHALL STAND
26   ADJOURNED TO MEET AT A TIME MUTUALLY AGREED
27   UPON BY THE PRESIDENT PRO TEMPORE OF THE
28   SENATE AND THE SPEAKER OF THE HOUSE OF
29   REPRESENTATIVES UPON CERTAIN OCCURRENCES AND
30   FOR THE CONSIDERATION OF SPECIFIED MATTERS, AND
31   TO PROVIDE THAT UNLESS ADJOURNED EARLIER, THE
32   GENERAL ASSEMBLY SHALL STAND ADJOURNED SINE
33   DIE NO LATER THAN NOON ON TUESDAY, JANUARY 12,
34   2010.

36   Be it resolved by the Senate, the House of Representatives
37   concurring:
38
39     (A) Pursuant to the provisions of Article III, Section 9 of the
40   Constitution of this State and Section 2-1-180 of the 1976 Code,
41   the sine die adjournment date for the General Assembly for the
42   2009 session is recognized and extended to permit the General

 1   Assembly to continue in session after Thursday, May 21, 2009,
 2   under the terms and conditions stipulated in this resolution and for
 3   this purpose each house agrees that when the Senate and the House
 4   of Representatives adjourn on Thursday, May 21, 2009, not later
 5   than 5:00 p.m., each house shall stand adjourned to meet in
 6   statewide session at a date and time mutually agreed upon by the
 7   President Pro Tempore of the Senate and the Speaker of the House
 8   of Representatives. However, the Senate and the House shall
 9   remain in session past May 21, 2009, to complete any unfinished
10   business concerning any general appropriations bill or any
11   supplemental appropriations bill or any veto to any appropriations
12   bill and, upon completion, each body shall adjourn pursuant to the
13   provisions of this resolution. When the Senate and the House
14   reconvene at a time between, the later of May 21, 2009, or the
15   completion of any general appropriations bill or any supplemental
16   appropriations bill, and no later than June 30, 2009, each house
17   may remain in session for no longer than three statewide
18   legislative days to adjourn not later than 5:00 p.m. on the third
19   legislative day, except as provided by this resolution, for the
20   following matters and subject to the following conditions, as
21   applicable:
22         (1) receipt and consideration of gubernatorial vetoes;
23         (2) receipt, consideration, and confirmation of appointments;
24         (3) election of members to state boards and commissions, or
25   other office elected by the General Assembly, at a joint session on
26   a date and time mutually agreed upon by the President Pro
27   Tempore of the Senate and the Speaker of the House of
28   Representatives;
29         (4) receipt and consideration of resolutions affecting the sine
30   die adjournment date;
31         (5) receipt and consideration of local legislation which has
32   the unanimous consent of the affected delegation;
33         (6) receipt and consideration of resolutions expressing
34   sympathy or congratulations;
35         (7) receipt, consideration, and actions upon any general
36   appropriations bill and any supplemental appropriations bill;
37         (8) receipt and consideration of conference and free
38   conference reports;
39         (9) receipt and consideration of any matter related to the
40   certification, application, receipt, or expenditure of federal funds
41   available pursuant to HR-1, the American Recovery and
42   Reinvestment Act of 2009;

 1         (10) receipt, consideration, and actions upon S.351, relating to
 2   the State Ports Authority;
 3         (11) receipt, consideration, and actions upon S. 576, relating
 4   to the establishment of the Capitol Police Force; and
 5         (12) receipt, consideration, and actions upon legislation
 6   pertaining to the state election laws.
 7      (B) After each house stands adjourned pursuant to subsection
 8   (A) not later than 5:00 p.m. on the third legislative day, each house
 9   shall stand adjourned to meet in statewide session at a date and
10   time mutually agreed upon by the President Pro Tempore of the
11   Senate and the Speaker of the House of Representatives, only for
12   the following matters and subject to the following conditions, as
13   applicable:
14         (1) receipt and consideration of legislation necessary to
15   address any shortfall in revenue meeting the conditions of Section
16   11-9-890;
17         (2) receipt and consideration of any matter related to the
18   certification, application, receipt, or expenditure of federal funds
19   available pursuant to HR-1, the American Recovery and
20   Reinvestment Act of 2009 or receipt and consideration of any
21   matter related to the maintenance of state effort required by the
22   American Recovery and Reinvestment Act of 2009;
23         (3) receipt and consideration of gubernatorial vetoes;
24         (4) receipt, consideration, and confirmation of appointments;
25         (5) election of members to state boards and commissions, or
26   other office elected by the General Assembly, at a joint session on
27   a date and time mutually agreed upon by the President Pro
28   Tempore of the Senate and the Speaker of the House of
29   Representatives;
30         (6) receipt, consideration, and actions upon legislation
31   pertaining to the state election laws; and
32         (7) receipt and consideration of resolutions affecting the sine
33   die adjournment date.
34      (C) The President Pro Tempore of the Senate and the Speaker
35   of the House of Representatives may set a mutually agreed upon
36   time after May 21, 2009, and prior to sine die adjournment for
37   officers of the Senate and House to ratify acts.
38      (D) Unless adjourned earlier, the General Assembly shall stand
39   adjourned sine die no later than noon on Tuesday, January 12,
40   2010.
