RE:    Gary Recodification--Legal Analysis of Code

                               Part I. Introduction
                                 Subpart A. General
This memorandum is the introduction to an analysis of the 1989 Municipal Code of the
City of Gary, Indiana as amended or modified through ordinances adopted through Ord.
No. 8083, adopted on January 2, 2007 ("Code"), in which the Code has been researched
for the following purposes:

       1.     Identification and elimination of conflicts, inconsistencies and obsolete
              provisions in connection with state statutes (Indiana Code as available
              through the state website through May 31, 2007).

       2.     Identification and elimination of conflicting or obsolete provisions.

       3.     Identification and elimination (or curing) of potentially unconstitutional
              provisions.

The results of the research have been impressed as footnotes in a legal manuscript. The
legal manuscript consists of the 1989 Code as augmented by subsequent ordinances, with
the additions and deletions suggested by the research have been shown using underlined
and strikeout type.

As the version of the 1989 Code furnished by the city was missing material, the missing
material has been obtained from the unadopted proposed Code prepared in house (1997
edition). Footnotes and shading indicate where this has been done.
Except as stated otherwise, Municipal Code Corporation can implement the solutions
suggested in the content proofs. A new Code incorporating the changes can be presented
to the Town Council for adoption. When the new code is adopted (by one ordinance), the
changes become law.

                                Subpart B. Entry Powers
Many Code provisions grant entry powers and inspection powers. If enforced literally,
such powers could be unconstitutional. Except as to businesses over which there is
substantial municipal regulation, such entry powers cannot authorize warrantless searches
for which consent has not been given to inspect in places other than where the public has
the right to be. See McQuillin, Municipal Corporations, § 19.29. The author has
assumed that the city staff enforces all entry powers granted to it in a constitutional manner.

                                 Subpart C. Preemption

Indiana municipalities may not prescribe a penalty for conduct constituting a crime or
infraction under statute. IC 36-1-3-8 (a)(8). Unless express authorized, Indiana
municipalities may not regulate conduct that is regulated by a state agency IC 36-1-3-8
(a)(7). In this memorandum, it is recommended to delete provisions as preempted by
cited statutes. In each case the statute cited is the statute authorizing state regulation or
making the conduct penal. All such citations must be understood as including a reference
to IC 36-1-3-8 (a)(7), (a)(8).

                               Subpart D. History Notes

While the 1989 Code contained history notes to source provisions, many of the notes were
incomplete, not bearing adoption dates or other information. Therefore, it is
recommended that history notes only contain references to the city's 1989 code and
amendments thereto as furnished to Municipal Code Corporation by the city. In addition,
history notes must appear at the end of sections so as to allow them to capture in tracing
tables.

                                   Subpart E. Penalites

There are a myriad of penalties in the Code. It is clear that numerous penalties reflect that
maximum penalty authorized for ordinance violations when the ordinance was adopted.
The provisions of IC 36-1-3-8(10) do not authorized imprisonment as an authorized
penalty for ordinance violations and restrict penalties to fine of not more than ($2,500 for
a first violation of the ordinance and not more than $7,500.00 for a second or subsequent
violation of the ordinance (ordinance regulating traffic or parking being excluded from the
penalty enhancement for second or subsequent violations). The city has revised to penalty
in chapter 10 of the Code to reflect the new stautory maximums.

Many ordinance contain mimimum fines, the utility of which could be questioned, given
the presumed power to the city judge to suspend sentence or impose probation.

Penalites in the Code that are less than the maximum authorized in chapter 10 have not
been altered. They have been identified for review.


             Part II. General Recommendations or Changes

The following changes will be made throughout the new code. Except in specific
situations, these changes are not noted.
