                           MEETING MINUTES

                               April 08, 2009



Orwigsburg Borough Council met on Wednesday, April 08, 2009 in Council
Chambers. President Charles J. Sterner called the meeting to order at 7:30 pm,
and the Pledge of Allegiance was recited.


Attending were: President Charles J. Sterner; Vice President Michele Rudloff:
Councilors, Sue Murphy, David Lafko, Daniel K. Strausser, Steven J.
Zimmerman; John Rehrig; Mayor Austin Scandiber, Solicitor Frank L. Tamulonis,
Borough Manager Mike Lonergan and Borough Secretary Sherry M. Edwards.


Visitors were: Buddy & Susie Touchinsky of 225 Clark Drive; Martha Sterner of
202 N. Straub Ave; John Dunchick of 205 Pine Blvd; Mike Brinkash of Brinkash
Associates, Inc; Amy Beres of Schuylkill News; Colleen Hoptak of The Call.


The minutes of the March 4th and 11th meetings were accepted as presented on
a motion made by Dan Strausser, second by John Rehrig. Unanimous.


The February 2009 Treasurer’s Report was approved as presented on a motion
made by Sue Murphy, second by Dave Lafko. Unanimous.


The Tax Collector’s report for March 2009: Real Estate $22,447.46; Per Capita
$3,929.80; Occupation $1,065.78 was approved on a motion made by John
Rehrig, second by Sue Murphy. Unanimous.

The Tax Collector was exonerated from collecting Occupation Taxes on Tax
Exoneration List #2 on a motion made by Dave Lafko second by Michele Rudloff.
Unanimous.


Building Permits for March – 1 new permit issued at $207,990.00 total value and
1 renovation permits issued at $ 32,000.00 total value.

New Business
A motion to adopt Resolution 2009-07 authorizing the destruction of audiotapes
of Borough Council meetings was made by Michele Rudloff, second by Sue
Murphy. Unanimous.


Committee Reports


Finance
A motion to authorize the Borough Manager to submit an application for
participation in the OnDemand Energy Pool through the Schuylkill Chamber of
Commerce and ratify actions previously taken was made by Steve Zimmerman,
second by Michele Rudloff. Unanimous.

Insurance & COG
Sue Murphy noted the next COG meeting is April 16, 2009 in Borough Council
Chambers.

Personnel & Negotiations
A motion to adopt Resolution 2009-06 establishing a Section 125 Plan for
Borough employees was made by Dave Lafko, second by Michele Rudloff.
Unanimous.

A motion to authorize the Borough Manager to execute an agreement with The
Redco Group, Workforce Investment Network to participate in Project Earn was
made by Dan Strausser, second by John Rehrig. Unanimous.

President Sterner congratulated our Borough Employees for receiving a safety
award from our Workers’ Compensation Insurance Carrier. Mike noted there
were -0- claims in 2007.


Fire – No Report


Police -
A motion to apply to the Office of Community Oriented Policing Services for grant
funding under the COPS Hiring Recovery Program for one police officer for three
years with the requirement that other funds be used to maintain the position for
an additional 12 months was made by Michele Rudloff, second by Dave Lafko.
Two opposed. Motion carried.

A brief discussion was held regarding the borough’s expense maintaining the
officer an additional 12 months after the 3 year grant expires.

The March 2009 police report is attached to these minutes.

Water
A motion to approve payment of $14,364.80 to Authority Maintenance Company
as final payment for the Water Meter Replacement Project subject to execution
for settlement agreement and release was made by Michele Rudloff, second by
Dan Strausser. Unanimous.

A motion to accept the Settlement Agreement between the Borough and
Authority Maintenance Company was made by Michele Rudloff, second by Steve
Zimmerman. Unanimous.

A motion to authorize the Borough Manager to sign the Settlement Agreement
between the Borough and Authority Maintenance Company on behalf of the
Borough was made by Michele Rudloff, second by Steve Zimmerman.
Unanimous.

Michele noted spring hydrant flushing will take place on April 21st, 22nd, and 23rd
from 7:00 am until 7:00 pm.


Sewer and Solid Waste – No Report


Streets & Lights
A motion to give conditional final approval of the land development plan for The
Bottom Luxury Townhouses subject to the conditions outlined in the engineers
letter was made by Dan Strausser, second by Sue Murphy. Three opposed.
Motion carried.

Councilor Zimmerman stated the following “When this project was initially
proposed considerable concerns were raised concerning traffic safety due to
the proximity of the proposed entrance to Hope Avenue and the impact of
stormwater runoff on adjacent properties. These concerns were shared with
the Pennsylvania Department of Transportation, the Schuylkill Conservation
District and the borough engineer, Hanover Engineering.

We understand that PennDot has approved the plans for the entrance to the
development and will be issuing a Highway Occupancy Permit. In addition
our engineers and the Schuylkill Conservation District have indicated that

the stormwater management plans meet the requirements of our ordinance
and their regulations respectively.

Our engineers have indicated that the plan complies with the requirements
of our Zoning Ordinance and Subdivision and Land Development Ordinance
and the Planning and Zoning Commission has recommended that
conditional approval of the final plan be granted. Under the Pennsylvania
Municipalities Planning Code to deny approval of a plan it must fail to meet
a requirement of one of these ordinances, as this is not the case I will be
voting to approve the application.”

A motion to authorize the Borough Manager to sign the land development plan
for The Bottom Luxury Townhouses upon satisfaction of all conditions imposed
upon final approval was made by Dan Strausser, second by Sue Murphy.
Unanimous.

A motion to authorize the Borough Manager to advertise for bids for Phase 2 of
the 2009 Road Program was made by Dan Strausser, second by Dave Lafko.
Unanimous.

A motion to approve the request of Salem United Methodist Church to close
Independence Street from South Liberty Street to South Warren Street on May
24, 2009 from 3:00 pm to 8:00 pm for an outdoor service was made by Dan
Strausser, second by Michele Rudloff. Unanimous.

A motion to approve the request of Salem United Methodist Church to close
Independence Street from South Liberty Street to South Warren Street on
September 6, 2009 from 12:00 pm to 9:00 pm for a block party was made by Dan
Strausser, second by John Rehrig. Unanimous.

A motion to authorize the Borough Engineer to provide a letter to Brinkash and
Associates indicating that the Stormwater Management Plans for The Bottom
Luxury Townhouses land development plan are compliant with the Borough
Subdivision and Land Development Ordinance was made by Dan Strausser,
second by Steve Zimmerman. One opposed. Motion carried.

A motion to purchase two skids of asphalt crack sealer at a cost not to exceed
$4,080 was made by Dan Strausser, second by Steve Zimmerman. Unanimous.

Dan Strausser noted the street sweeper will be in the Borough on May 13 th and
14th from 7:00 am to 5:00 pm.

Building and Recreation

A motion to approve payment of $30,450 to Yost Mechanical Inc. for the Borough
Hall HVAC project subject to final inspection by the Borough Engineer was made
by John Rehrig, second by Michele Rudloff. Unanimous.

John Rehrig noted the annual Children’s Fishing Rodeo will be held on May 9 th
and 10th from 9:00 am to 3:00 pm at Fisher’s Dam.


Correspondence – None


Bills

A motion to approve and ratify the accounts payable for General, Water, Sewer,
Sanitation, Borough Hall Equipment Grant, Capital Improvement and State Fund
accounts was made by Steve Zimmerman, second by Michele Rudloff.
Unanimous.

At 7:50 pm President Sterner called an executive session to discuss a real estate
acquisition.

At 8:28 pm the executive session ended and there being no further business the
meeting was adjourned.
