Sub : Request for Online Bid for supply of shaft for Bucket Wheel



Sealed Bid (Technical bid with commercial terms and Price bid) invited from

reputed firms in two parts for supply of shaft for Bucket Wheel at Pellet Plant,

Mangalore.



1. SUBMISSION OF TECHNICAL AND PRICE BID :



Tenderers should submit their tenders in two parts in separate sealed

covers :



Part – A : Technical Bid

Part - B : Price Bid for GEAR BOX





(A) Sealed Cover No. 1 – Technical Bid



The Sealed tenders (Technical bid with commercial terms without

indicating price of Main Equipment) complete in all respects conforming to the

Scope of Supply, Scope of work involved, accepting point-wise of all terms and

conditions strictly as described in this tender document should reach us on or before the

last date and time specified at page-1 above and should be addressed to The Manager

(Purchase), KIOCL Limited, Second Block, Koramangala, BANGALORE – 560 034.

The envelope should be superscribed as "Technical Bid ―for supply of shaft for bucket

Wheel ‖.



The technical details with the relevant information, documents, acceptance of all terms

and conditions strictly as described in this tender document should be submitted.



Technical Bid contain :



a. Technical specification of gear box & coupling offered in detail.

b. Acceptance of Techno-Commercial Bid point wise including Blank Price bid

format for Reverse Auction (without indicating price).

c. Duly filled in check list : The response / offer should be indicated with ‗Yes

or No in the appropriate column.



(B) Sealed Cover No. 2 – Price Bid



Price bid duly filled in the format as at Annexure – IIA shall alone be enclosed in

a separate sealed cover duly super scribed with our Tender Number & Due Date and

time of Opening and captioned ―PRICE BID FOR SHAFT FOR BUCKET WHEEL”



Note : Any other terms and conditions other than the price mentioned in the price bid

shall not be taken into consideration.



(C) Cover No. 3 – Common Outer Sealed Cover :



Cover at (1), & (2) above shall be kept in a common sealed outer cover

duly super scribed with our Tender number & Due Date and time of

Opening and captioned " Quotation for Supply of Shaft for Bucket Wheel "



The Sealed Cover can be dropped in Tender Box kept in Purchase Department, KIOCL

Limited, Second Block, Koramangala, BANGALORE – 560 034 or can also be sent

by Courier / Post..

Quotation received by fax / e-mail will not be accepted.



2. TENDER OPENING :



Sealed Cover No. 1 - The Sealed Techno-commercial bid will be opened in

the presence of the tenderers or their authorised representatives, who may

choose to be Present on the same day as specified at page-1 at 15.00 Hrs (IST)

at Purchase Department, KIOCL Ltd., Koramangala, Bangalore-560 034.



Sealed Cover No. 2 - The date of opening of the Sealed Price bids of the

tenderers who have been techno-commercially found acceptable shall be

informed later so as to enable them to depute their authorised representatives to

be present at the time of opening of the Sealed Price Bids, if they so desire.

3. ONLINE COMPETETIVE PRICE BIDDING CUM REVERSE AUCTION :



a) As per current guidelines, KIOCL shall be conducting online competitive price

bidding cum Reverse e-Auction prior to opening of sealed price bids. The details

regarding online bidding cum reverse auction are mentioned at tender document.



b) KIOCL has made arrangement with M/s ----------- Limited, -------- who shall

be KIOCL‘s authorized service provider for this tender. Details of service provider

will be furnished later.



c) All technically and commercially acceptable bidders those who have accepted

business rules provided by our service provider would be required to participate in

the online bidding cum reverse e-auction, on a date and time to be intimated

later. Bidders are to indicate in the online bidding against price column their most

competitive price which sets the reverse auction into motion after the system

takes in the first entered price.



d) M/s ---------------- Ltd., will train short listed vendors for this purpose, and they

will have to abide by the e-business rules framed by the KIOCL in consultation

with M/s ----------- Ltd., A copy of e-business rules is furnished in Annexure-V.

The date and time of which shall be intimated to all the eligible bidders by the

Service Provider in due course.



Note :All Techno-commercially qualified bidders are required to submit the Process

Compliance Form duly signed prior to online bidding and Reverse Auction to

ANNEXURE-II

TECHNO-COMMERCIAL TERMS AND CONDITIONS



1. PRICE :



Please furnish your best/ lowest price on Door Delivery to KIOCL, Stores, Mangalore

basis including charges towards packing & forwarding charges, freight up to

Mangalore. Offered price shall be exclusive of Sales Tax / VAT and Excise Duty.



Note :

a. Bidder shall quote price taking into account the deemed export

benefit as applicable for supplies to 100% EOU.



b. Sales Tax / VAT : Percentage applicable to be indicated. KIOCL

would issue ‗C‘ form for concessional CST and at present ‗CST‘ is

re-imbursible and VAT being input tax is rebatable.



c. Excise Duty: KIOCL being a 100% Export Oriented Unit (EOU) is

exempted from payment of excise duty and CT-3 form towards

same will be issued by KIOCL Stores, Mangalore.



d. The price quoted shall be firm through-out the currency of the

contract and is not subject to escalation of any kind whatsoever.



e. It may be noted that unit price is to be quoted both in figure and

words in the Price Bid format enclosed at Annexure-III. In case of

any discrepancy between the two, the price indicated in words shall

only be considered.



2. TRANSIT INSURANCE :



Transit Insurance shall be covered by us at our cost.





3. DELIVERY SCHEDULE & TIME OF COMPLETION :



Please indicate your best delivery schedule.



4. PACKING :



Material to be suitably packed to avoid transit damage or water ingress. Packing

should be sufficiently robust to withstand rough handling during transit. All items should

have their respective identification tag and should be suitably packed to provide ease of

handling / storage and offer maximum protection during transit.



5. PERIOD OF VALIDITY :

Price quoted shall be valid for a period of minimum 60 days from the date of Reverse

Auction conducted.





6. PAYMENT TERMS



100% payment shall be made against original dispatch documents, 5 copies of

invoices, inspection certificate, delivery challan and guarantee certificate through

Union Bank of India, Koramangala, Bangalore.

8. PRE-DESPATCH INSPECTION :



a) KIOCL shall have the right to inspect and / or to test the goods to confirm

their conformity to the contract.



b) SM(I&P), Bangalore or their authorized representative will inspect the items at

your premises on receipt of advance intimation from you in writing on

readiness of materials.



9. WARRANTY / GUARANTEE :



Bidders shall guarantee the items against material and manufacturing defects

for a period of 12 months from the date of commissioning or 18 months from

the date of dispatch whichever is earlier and warranty obligation shall be as

per our General Conditions for supply enclosed herewith. In case of wrong

supply of any parts or found defective during the warranty period, the same

shall be rectified/replaced on free of charge on site to site basis without lapse

of time.





10. DELAYED DELIVERY AND LIQUIDATED DAMAGES (PENALTY) FOR DELAY IN

DELIVERY :-



KIOCL shall have the option to accept delivery of material after the originally stipulated

delivery period in the Contract and in case of acceptance of delayed delivery KIOCL shall

recover of retain from supplier as agreed liquidated damages and not as penalty a sum

equal to quarter percent (1/4%) of the price of any materials, spares and / or supplies

which supplier has failed to dispatch as aforesaid, for each week or part of a week,

during which such dispatch . The liquidated damages and penalty on delay in delivery

shall be limited to a maximum of 5% of the total contract value.

11. EVALUATION AND COMPARISON OF BIDS



Price shall be evaluated on the basis of TOTAL DELIVERED COST AT

MANGALORE basis (For more details please visit our website or website page:

www.kioclltd.com/traders/screen.zip)



a) First Stage : Techno-Commercial Evaluation :



A duly constituted Tender Committee will evaluate the techno-commercial bids

on the basis of technical parameters and features offered in the technical bids.

The Tender Committee may call the vendors representatives for detailed

techno-commercial discussions, clarifications, presentation if required. The

names of techno-commercially evaluated vendors will be announced to only

those vendors whose techno-commercial bids will qualify for opening of Price

bids.



b) Second Stage : Collection of online final price bid history from service

provider



After the online bidding cum reverse auction is conducted, collect price

comparative statement from service provider.



c) Third Stage : Composite price comparative statement



After the receipt of the price comparative statement from the service provider,

the sealed price bids of all the Techno-commercially acceptable tenderers,

irrespective of whether they have participated in the Reverse e-Auction or not,

shall be opened within a short duration ie., within 2 to 4 working days. Based

on the prices so received, through online bidding cum Reverse Auction and the

Sealed price bids received along with the techno-commercial offers, a

composite price comparative statement shall be made considering the lower of

the prices (ie., sealed price bid prices & online bid cum Reverse Auction prices)

of all the tenderers. Placement of order shall be considered on the L1 price so

arrived.



12. ACCEPTANCE OF GENERAL CONDITIONS OF CONTRACT :



The tenderer shall confirm their acceptance to General Conditions for Indigenous supply

KIOCL – P/1 (for Indigenous bidders) Please note that the terms and conditions

contained in this annexure including other annexures of tender enquiry shall prevail over

the General Conditions of Contract KIOCL – P/1 wherever applicable.

13. SPECIAL NOTE :



a) The Tenderer is required to carefully examine the Terms and Conditions of

tender document and work related to scope of supply given in the Tender

Document and fully acquaint himself as to all conditions and matters which

may in any way affect the work related to scope of supply or the cost thereof.

The Tenderer shall be deemed to have on his own and independently obtained

all necessary information for the purpose of preparing the tender and shall be

deemed to have taken into account all contingencies as may arise due to such

information or lack of the same.



b) Clarifications on Techno-Commercial Terms: KIOCL reserves the right to seek

clarifications on the Techno-Commercial clarifications/confirmation from the

bidder. However, such clarification/confirmation sought shall not permit the

tenderer to revise the price bids submitted. The request for clarification and

the response shall be in writing and no change in the price or substance of the

Bids shall be sought, offered or permitted.



c) KIOCL reserves the right to accept or reject tender either in whole or in part or

to invite revised offer.



d) The Tenderer shall be deemed to have acquainted himself of Rules,

procedures, guidance of Government Laws, statutes, regulations, etc., relating

to his work related to present scope of supply of material.



e) KIOCL reserves the right to shorten / extend the period for supply of materials

while concluding the contract. KIOCL also reserves the right to short close the

contract in case of breach of terms and conditions of the contract by the

tenderer.



14. The award of work shall not be assigned, transferred or sub-delegated to other

Contractors except with the written approval of KIOCL. However this clause shall not

apply to purchase of equipments and material for the performance of the work.



15. BIDDERS‘S OBLIGATIONS :



a) The successful bidder is obliged to work in close coordination with KIOCL staff.



b) The successful bidder will abide by the safety measures prevalent in India and

will free the KIOCL from all demands or responsibilities arising from accidents

/ loss of life, the cause of which is the Bidders negligence. The bidder will

pay all indemnities arising from such incident and will not hold the KIOCL

responsible or obligated.



c) The bidder is responsible for managing the activities of his personnel or sub-

contracted personnel and will hold himself responsible for any

misdemeanors.



d) The bidder shall treat all data and information about the KIOCL as confidential

and shall not reveal such information to any other party without the prior

written approval of KIOCL.

18. Not withstanding anything specified in this Tender Documents, KIOCL, in

his sole discretion, unconditionally and without having to assign any

reason, reserves to himself the rights:



a) To accept or reject the lowest tender or any other tender or all the tenders

b) To reject the offers not conforming to the tender terms and

c) To give Purchase preference to Public Sector Undertakings wherever applicable as

per Government policy/ Guidelines.

d) To extend purchase preference to SSIs (Micro and Small Enterprises) as per

prevailing guidelines.

ANNEXURE – IV A



BUSINESS RULES FOR REVERSE AUCTION





GENERAL TERMS AND CONDITIONS OF REVERSE AUCTION





1. Against this Enquiry for the subject item/system with detailed scope of supply as

per our specification, KIOCL Limited, hereinafter referred to as KIOCL, may resort

to ―REVERSE AUCTION PROCEDURE‖ i.e. ON LINE BIDDING on INTERNET.

2. For the proposed reverse auction, technically and commercially acceptable bidders

only shall be eligible to participate.

3. KIOCL will engage the services of a service provider who will provide all necessary

training and assistance before commencement of on line bidding on Internet.

4. Business rules like event date, time, bid decrement, extensions, etc. also will be

communicated through service provider.

5. Vendors have to fax the compliance form in the prescribed (provided by service

provider) before start of Reverse auction. Without this the vendor will not be

eligible to participate in the event.

6. Reverse auction will be conducted on schedule date & time.

7. At the end of reverse auction event, the lowest bidder value will be known on the

network.

8. The lowest bidder has to fax the duly signed filled-in prescribed format as

provided on case-to-case basis to KIOCL through service provider within 24 hours

of action without fail.

Business Rule for finalization of the procurement.



KIOCL shall finalize the procurement of the item against this Tender through reverse

auction mode. KIOCL has made arrangement with M/s. ----------------------- Ltd, -----------

--, hereinafter referred to as ----------------------- LTD , who shall be KIOCL‘s authorized

service provider for the same. Please go through the guidelines given below and submit

your acceptance to the same along with your Commercial Bid.



1. Computerized reverse auction shall be conducted by KIOCL, on pre-specified date,

while the vendors shall be quoting from their own offices/ place of their choice.

Internet connectivity shall have to be ensured by vendors themselves. In extreme

case of failure of Internet connectivity, (due to any reason whatsoever may be) it

is the bidders‘ responsibility / decision to send fax communication immediately to

M/s. ------------------- Ltd., ----------. Furnishing the price the bidder wants to bid

online with a request to the service provider to upload the faxed price on line so

that the service provider will up load that price on line on behalf of the Bidder. It

shall be noted clearly that the concerned bidder communicating this price to

service provider has to solely ensure that the fax message is received by the

service provider in a readable / legible form and also the Bidder should

simultaneously check up with service provider about the clear receipt of the price

faxed. It shall also be clearly understood that the bidder shall be at liberty to send

such fax communications of prices to be up loaded by the service provider only

within the closure of Bid time and under no circumstance it shall be allowed

beyond the closure of Bid time / reverse auction. It shall also be noted that the

service provider should be given a reasonable required time by the bidders, to

upload such prices online and if such required time is not available at the disposal

of the Service provider at the time of receipt of the fax message from the bidders,

the service provider will not be uploading the prices and either KIOCL or the

service provider are not responsible for this unforeseen circumstances. In order to

ward-off such contingent situation bidders are requested to make all the

necessary arrangements/ alternatives whatever required so that they are able to

circumvent such situation and still be able to participate in the reverse auction

successfully. Failure of power at the premises of vendors during the Reverse

auction cannot be the cause for not participating in the reverse auction. On

account of this, the time for the auction cannot be extended and neither KIOCL

nor M/s. ------------------------------ is responsible for such eventualities.



2. Please note that the blank screen will appear in online reverse auction

when it is open to all the participating bidders. Any bidder can quote their

competitive bid in the online reverse auction. Please note that the first online bid

that comes in the system during the online reverse auction can be treated as start

bid price. The subsequent bid that comes in to outbid the L1 rate will have to be

lesser than the L1 rate by one decrement value or in multiples of the decrement

value



3. ---------------------------- shall arrange to train your nominated person(s), without

any cost to you. They shall also explain you, all the Rules related to the Reverse

Auction/ Business Rules Document to be adopted along with bid manual. You are

required to give your compliance on it before start of bid process.

4. BIDDING CURRENCY in Indian Rupees . UNIT OF MEASUREMENT in No.



5. BID PRICE: The Bidder has to quote the unit price on Door Delivery to

KIOCL – Plant, Mangalore Basis



6. The technical & commercial terms are as per KIOCL Tender only.



7. VALIDITY OF BIDS: The Bid price shall be firm specified in the tender document

and shall not be subjected any change whatsoever.



8. At the end of the reverse auction, bidder has to provide a detail break up for his

lowest offer within 24 hours.



9. Procedure of Reverse Auctioning





 Blank Screen will be visible to all techno-commercially acceptable bidders

during the start of the reverse Auction. Any bidder can quote their

competitive bid in the online reverse auction. Please note that the first

online bid that comes in the system during the online reverse auction can

be treated as start bid price.



 English Reverse (no ties) Auction shall be for a period of one hour. If a

bidder places a Bid in the last 10 minutes of Closing of the Auction, the

auction shall get extended automatically for another 10 minutes from the

time of the last accepted bid. In case, there is no Bid in the last 10 minutes

of closing of Auction, the Auction shall get closed automatically without any

extension.



 The bid decrement amount shall be specified by KIOCL before start of

bidding. The bidder can bid lower than the start bid price in reverse auction

by a bid decrement or multiple of Bid decrement.



 Any commercial loading shall be intimated to bidders in advance and it

shall be added to price during dynamic auction process. For evaluation

purpose, commercial loading if any, shall be added to the quoted price of

respective bidder. However for ordering only the final bid placed by you

shall be considered.



 After the completion of English Reverse (no ties), the Closing Price (CP)

shall be available. In case, any commercial loading was made to L1

bidder‘s price, it shall be de-loaded from the closing price of L1 bidder (CP)

for further processing.



 Successful vendor shall be required to submit the final prices, quoted

during the English Reverse (no ties) in Annexure-III Format after the

completion of Auction to KIOCL, duly signed and stamped as token of

acceptance without any new condition other than those already agreed to

before start of auction. The successful vendor also has to submit the

complete price breakup of the final price quoted during the online reverse

auction duly signed & stamped.



 Your bid will be taken as an offer to supply. Bids once made by you, cannot

be cancelled / withdrawn and you shall be bound to supply as mentioned

above at your final bid price. Should you back out and not supply as per

the rates quoted, KIOCL shall take action as appropriate.



 You shall be assigned a Unique User Name & Password by e-Procurement

Technologies Ltd. You are advised to change the Password after the receipt

of initial Password from e-Procurement to ensure confidentiality. All bids

made from the Login ID given to you will be deemed to have been made

by your company.



 You will be able to view the following on your screen along with the

necessary fields in the English Reverse (no ties) {Reverse Auction}:



- Leading Bid in the Auction (only unit price of items)

- Bid Placed by you

- Your rank.



At the end of the Reverse Auction, KIOCL will decide upon the winner. KIOCL‘s decision

on award of Contract shall be final and binding on all the Bidders.



KIOCL shall be at liberty to cancel the reverse auction process / tender at any time,

before ordering, without assigning any reason.



KIOCL shall not have any liability to bidders for any interruption or delay in access to the

site irrespective of the cause.



Other terms and conditions shall be as per your techno-commercial offers and other

correspondences till date.



You are required to submit your acceptance to the terms/ conditions/ modality given

above before participating in the reverse auction.

Terms & Conditions of Reverse Auction



1. LOG IN NAME & PASSWORD: Each Bidder is assigned a Unique User Name &

Password by ------------------------- LTD. The Bidders are requested to change the

Password after the receipt of initial Password from -------------LTD. All bids made

from the Login ID given to the bidder will be deemed to have been made by the

bidder.



2. BIDS PLACED BY BIDDER: The bid of the bidder will be taken to be an offer to

execute the work. Bids once made by the bidder cannot be cancelled. The bidder

is bound to execute the work the as mentioned above at the price that they bid.

Should any bidder back out and not make the supplies at per the rates quoted,

KIOCL and / or ----------------------- LTD. shall take action as appropriate.



3. LOWEST BID OF A BIDDER: In case the bidder submits more than one bid, the

lowest bid will be considered as the bidder‘s final offer to execute the work



4. AUCTION TYPE: 1). English Reverse No Ties



5. DURATION OF AUCTION: The duration of Reverse Auction will be for one hour. If

a bidder places a bid in the last 10 minutes of closing of the Reverse Auction and

if that bid gets accepted, then the auction‘s duration shall get extended

automatically for another 10 minutes, for the entire auction (i.e. for all the items

in the auction), from the time that bid comes in. Please note that the auto-

extension will take place only if a bid comes in those last 10 minutes and if that

bid gets accepted. If the bid does not get accepted, the auto-extension will not

take place even if that bid might have come in the last 10 minutes. In case, there

is no bid in the last 10 minutes of closing of Reverse Auction, the auction shall get

closed automatically without any extension. However, vendors are advised not to

wait till the last minute or last few seconds to enter their bid during the auto-

extension period to avoid complications related with internet connectivity, network

problems, system crash down, power failure, etc. (THIS SCHEDULE IS

TENTATIVE. IF ANY CHANGE IN SCHEDULE, THE SAME SHALL BE

COMMUNICATED TO YOU)



6. BID DECREMENT: The minimum Bid decrement shall be available to the Bidders

at the start of the auction. The bidder can view the same by clicking on the Item

details at the start of the auction. The bidder can bid lower than the Lowest Bid in

the auction by a decrement or multiple of the Bid decrement.





7. VISIBLITY TO BIDDER: The Bidder shall be able to view the following on his

screen along with the necessary fields during English Reverse – No ties Auction:

8. AUCTION WINNER: At the end of the Reverse Auction, KIOCL will evaluate all the

bids submitted and will decide upon the winner.

9. PROXY BIDS: Proxy bidding feature is a pro-supplier feature to safe guard the

supplier‘s interest of any Internet failure or to avoid last minute rush. The Proxy

feature allows Bidders to place an automated bid against other Bidders in an

auction and bid without having to enter a new amount each time a competing

Bidder submits a new offer.



The bid amount that a Bidder enters is the minimum that the Bidder is willing to

offer. Here the software bids on behalf of the supplier.



The proxy amount is the minimum amount that the Bidder is willing to offer.

During the course of bidding, the Bidder cannot delete or change the amount of a

Proxy Bid.



Bids are submitted in decrements (decreasing bid amounts). The application

automates proxy bidding by processing proxy bids automatically, according to the

decrement that the auction originator originally established when creating the

auction, submitting offers to the next bid decrement each time a competing

Bidder bids, regardless if competing bids are submitted as proxy or standard bids.



This feature can be used only once during a particular Reverse Auction and only

after the L1 rate is equal to or less than the minimum bid amount that the bidder

has put in the system will he get the option to manually bid for the same. In no

case during the bidding till the L1 rate or less is not reached as equivalent to the

minimum bid amount offered by the bidder, will the bidder get the option to

manually bid for the same.



GENERAL TERMS & CONDITIONS: Bidders are required to read the ―Terms and

Conditions‖ section of the auction website (----------------) using the Login IDs and

passwords given to them.



OTHER TERMS & CONDITIONS:



1. The Bidder shall not involve himself or any of his representatives in Price

manipulation of any kind directly or indirectly by communicating with other

suppliers / bidders.

2. The Bidder shall not divulge either his Bids or any other exclusive details of KIOCL

to any other party.

3. KIOCL‘s decision on award of Contract shall be final and binding on all the

Bidders.

4. KIOCL along with ---------------------- LTD. can decide to extend, reschedule or

cancel any Auction. Any changes made by KIOCL and / or M/s -------------------

LTD. , after the first posting will have to be accepted if the Bidder continues to

access the site after that time.

5. M/s-------------------. shall not have any liability to Bidders for any interruption or

delay in access to the site irrespective of the cause.

6. M/s ------------ LTD is not responsible for any damages, including damages that

result from, but are not limited to negligence. M/s ------------ LTD will not be held

responsible for consequential damages, including but not limited to systems

problems, inability to use the system, loss of electronic information etc.

N.B.



All the Bidders are required to submit the Agreement Form (Annexure- B) duly signed to

M/s---------------- Ltd, ----------- before the due date specified in the tender document.

After the receipt of the Agreement Form, Log in ID & Password shall be allotted to the

suppliers (bidders).



After the completion of the Auction event, all the Bidders have to submit the Price

Breakup immediately to M/s ------------------------ Ltd, ------------- for further proceedings.



All the bidders are requested to ensure that they have valid digital certificate well in

advance so as to confirm participation before the reverse auction.
