This fall, NCSA will again sponsor the Jennings 1040 In Depth seminar in
Leadership Cary; PTI seminars in Charlotte, Greensboro, and Myrtle Beach; and NC State tax
Conference Flyer schools throughout the state. This should provide ample opportunity for all members
Jennings Brochure to learn about the hundreds of changes to the tax law.
NCSA will sponsor a “Day at the Zoo” on May 14. This will be a great op-
PTI Brochure portunity to join other NCSA members, families, and friends for fun and fellowship
at one of the best zoos in the United States.
The Spring PAS will be combined with the annual convention in June 2011.
Combining these activities will lower overall cost and time away from the office. To
assist our members who hold the ACAT Accredited Business Advisor (ABA) creden-
tial, the Spring PAS will have a minimum of eight hours of accounting CPE. A na-
tionally recognized speaker will be featured. Since there have been several major
changes in accounting procedures, all members should plan on attending.
I’m really excited about the coming year! I hope to meet each of you at an
NCSA function during the year.

B Notice
In Announcement 2010-41, the IRS announced changes in procedures for individual payees to follow to
obtain validation of Social Security Numbers (SSNs) from the Social Security Administration (SSA) to prevent
or stop backup withholding following receipt of a second “B notice” from a payor.
To obtain validation of the payee’s SSN from the SSA for purposes of responding to a second B notice,
each individual payee now should contact the local SSA office and request a SSN Printout. The SSN Printout
will validate the SSN of the individual and serve as acceptable validation of the Individual’s TIN. An individ-
ual may request one free coy of the SSN Printout. The individual should provide a copy of the printout to the
payor who sent the second B notice. A payor who receives a copy of the SSN Printout validating the SSN of a
payee will not be required to commence backup withholding and may stop backup withholding.
A payor sending a second B notice to an individual payee should inform the payee of this change in pro-
cedure. The following language is acceptable:
Note that the Instructions for Incorrect Social Security Numbers have changed and the SSA no longer
uses form SSA-7028. You must request a Social Security Number Printout from SSA rather than Form
SSA-7028. You must send a copy of the Social Security Number Printout directly to us along with a
copy of this notice.

As many of you already have heard, June Votik of Charlotte, who was President of NCSA 1990-
1991, passed away June 9. Our sympathy goes to her husband of 59 years, Carl….Lettie Woodruff and
Virgil Hildebran also left us during the past few months. We will miss them….Our June Convention was
great! Especially for John McKinney from Marion who was a first-timer and then elected to the Board of
Directors….Did you know that Curt Lee has been serving as our Legislative advocate for 16 years? We
owe him a THANK YOU for all the meetings he has attended and hours spent behind the scenes preserving
our right to unregulated practice….Latefa Powell has bagged a deer in Carthage. Of course, it was her car
that did the dastardly deed to Bambi….Jim Holmes is back at work after being hospitalized with an e-coli
infection. He was a mighty sick puppy for several days. He also had one of those stent contraptions put in to
help his ticker tick. Can’t keep a good man down, though, and Jim says he feels fine now….In May, Cheryl
Hudson and her family went to Frankfurt (Germany, not Kentucky) and then to London. She says the “ice

Affordable Care Act
The Affordable Care Act contains some tax provisions that take effect this year and more that will be
implemented during the next several years. The provisions that follow are in effect this year.
A 10% excise tax on indoor UV tanning services started July 1. The tax doesn’t apply to phototherapy
performed by a licensed medical professional on the professional’s premises. There also is an exception for
certain physical fitness facilities that offer tanning as an incidental service to members without a separately
identifiable fee.
The Act provides a one-time $250 rebate in 2010 to assist Medicare Part D recipients who have reached
their Medicare drug plan’s coverage gap. This payment is not taxable.
The Therapeutic Discovery Project is designed to provide tax credits and grants to small firms that show
significant potential to produce new and cost-saving therapies, support jobs, and increase US competitiveness.
Firms can apply to have their research projects certified as eligible for the credit or grant. Applications must be
postmarked no later than July 21, 2010.
The Small Business Health Care tax credit helps small businesses and tax-exempt organizations afford
the cost of cost of covering their employees, especially those with low or moderate incomes. The credit is de-
signed to encourage small employers to offer health insurance coverage for the first time or maintain coverage.
In general, the credit is available to small employers that pay at least half the cost of single coverage for their
employees.
Health coverage for an employee’s children under 27 now generally is available tax-free to the em-
ployee. This expanded health care tax benefit applies to various work place and retiree health plans. These
changes allow employers with cafeteria plans to permit employees to begin making pre-tax contributions to pay
for this expanded benefit. This also applies to self-employed individuals who qualify for the self-employment
health insurance deduction.
Internet Retailers
The NC Department of Revenue is collaborating with e- commerce retailers that have operated affiliate programs
in the state to resolve issues of tax liability and to promote equal treatment of all businesses in the state. The Internet
Transactions Resolution Program is the result of cooperative discussions between the DOR and a number of e-commerce
retailers.
Research indicates the amount of sales tax North Carolina loses from e-commerce transactions will be $161.8
million in 2010, $190.2 million in 2011, and $213.8 million in 2012.
The resolution program offers retailers that have operated an affiliate program in North Carolina a proactive way
to resolve their liability to the State. E-commerce retailers can contact the DOR for detailed information about eligibility
and participation in the Internet Transactions Resolution Program. Businesses that participate in the program will not be
assessed tax, penalties, and interest for prior liability in exchange for agreeing to collect sales and use tax in the future.

What should NCSA do for YOU?
The annual NCSA Leadership and Networking Conference is scheduled for Saturday, July 17, at the
Embassy Suites, Greensboro. All Chapter Officers, prospective chapter and NCSA officers, NCSA Board
Members, NCSA Committee Chairs, and members who want to learn more about NCSA are encouraged to at-
tend. Registration with coffee and donuts begins at 9:00 am. Topics to be covered include Leadership, The
Board of Directors and Finance, Membership, and Goals for the Future.
Goals for the Future is an especially important topic, because YOU will be able to tell the NCSA lead-
ers what YOU expect from NCSA, such as continuing to protect our Right to Practice, accounting and/or tax
CPE classes throughout the year, or anything else you feel is important.
In addition to a wealth of knowledge and three CPE credits, lunch also is included. The price is right
for everyone! It’s free! If you plan on attending, please notify the NCSA Executive Director, Candace Can-

Tanning Tax
In IR-2010-73, the IRS issued regulations outlining the administration of a 10% excise tax on indoor
tanning services that went into effect July 1. In general, providers of indoor tanning services collect the tax at
the time the purchaser pays for the tanning services. The provider then pays these amounts to the government
quarterly along with Form 720, Quarterly Federal Excise Tax Return.
The tax does not apply to phototherapy services performed by a licensed medical professional on the
professional’s premises. The regulations also provide an exception for certain physical fitness facilities that
offer tanning as an incidental service to members as part of the membership fee without a separately identifi-
able fee.
The tax does not apply to spray-on tanning services.
