11 TO AMEND SECTION 56-7-10, CODE OF LAWS OF SOUTH

13 UNIFORM TRAFFIC TICKETS, SO AS TO PROVIDE THAT A

16 JURISDICTION OF MAGISTRATES COURT THAT IS

20 Be it enacted by the General Assembly of the State of South
21 Carolina:

23 SECTION 1. Section 56-7-10 of the 1976 Code is amended to
24 read:

26 “Section 56-7-10. (A) There will be a uniform traffic ticket
27 used by all law enforcement officers in arrests for traffic offenses
28 and for the following additional offenses:

32 (B) In addition to the offenses contained in subsection (A), a
33 uniform traffic ticket must be used in an arrest for a misdemeanor
34 offense within the jurisdiction of magistrates court that has been
35 freshly committed or is committed in the presence of a law
36 enforcement officer.
37 (C) No other ticket may be used for these offenses. The service
38 of the uniform traffic ticket shall vest all traffic, recorders’, and
39 magistrates’ courts with jurisdiction to hear and to dispose of the
40 charge for which the ticket was issued and served. This ticket will
41 be designed by the department and approved by the Attorney
42 General within thirty days of submission by the department. A law
43 enforcement agency may utilize computers and other electronic

1 devices to issue uniform traffic citations and store information
2 resulting from the issuance of a traffic citation if this method of
3 issuing a citation has been approved by the Department of Public
4 Safety.”

6 SECTION 2. This act takes effect upon approval by the Governor.
