INTRODUCTION
The Utah Motor Vehicle Registration files are owned, operated and updated by the Utah Motor Vehicle
Division (MVD). It is a Bureau of Criminal Identification (BCI) controlled file for statewide criminal justice
agencies. To ensure appropriate access, dissemination and training see the User Agreement in the
Introduction Section of this manual.
The information in this file is in the format designed by the Utah Motor Vehicle Division. The Motor
Vehicle Division controls updates and the quality of this information. The time it takes to make updates
can vary.
For any information not shown on the screen, or for questions about what is shown, contact MVD by
phone at 801-297-3546 or by fax at 801-297-3579. Hours are Monday through Thursday 7:00 am to 6:00
pm. An Administrative Message (AM) may also be sent to UTUTCVI70 (this is not a 24 hour terminal).
STATE AND FEDERAL LAW – DRIVER PRIVACY PROTECTION ACT
Each motor vehicle record falls under the federal “Driver Privacy Protection Act.” The specifics of this law
are located at the back of this section. Motor Vehicle data is for law enforcement purposes only.
Operators may access Utah motor vehicle information for criminal justice investigations and criminal
justice employment only.
Motor Vehicle Codes and NCIC Stolen Vehicle Entries
The coding found on the Utah Motor Vehicle Files may not match that which is required by NCIC. When
making NCIC entries use the codes provided in the NCIC Code Manual. The Motor Vehicle Division may
enter a flag on a vehicle file if the vehicle has been reported stolen. However, this flag may not always be
accurate. Users should check NCIC to verify if a vehicle is stolen.
The information on the following pages refers to and shows the UCJIS internet applications. Different
software programs will show the information in slightly different formats.
Utah Motor Vehicle Test Records
Unlike most other files (UCCH, driver license, III, etc.) there are no test records for Utah Motor Vehicle
Transactions. The examples shown in this manual are not test records, and names and numbers have
been changed. Remember not to use the plate numbers of friends, neighbors, co-workers, etc., for use in
testing or training.

From the UCJIS web site select the Utah Motor Vehicle Transaction. There are two different ways the user
can do this.
The user can enter the code (RQL) into the “Transaction Code” box and click “GO.”
Or, the user can click “Vehicle” then “Inquiry” then “Utah” then double-click “Utah Motor Vehicle” (see
figure 1.0).

This is the screen brought up by the “RQL” transaction (see figure 1.1). Searches can be done by plate
number, VIN, registration decal number, or name of registered owner. However, a search can be
performed only on the plate number, the VIN Number, decal number, or the owner’s name. Trying to
search on more than one at the same time will result in an error message.
Search by Plate Number
To search by the number on the license plate, run the characters just as they show on the plate, only
without spaces, punctuation, or special characters (hyphens, apostrophes, etc.) For example, a plate that
reads MT. NEBO would be entered as MTNEBO. A plate that reads YOGI’S would be entered YOGIS.
The example shown (see figure 1. is a search on the plate number for GO JAZZ. The space between the two
words is eliminated. On the internet version of UCJIS it does not matter if the letters are upper or lower
case.

If you click the hyperlinked plate number in the upper left corner of the response (see figure 1.3) you will
be brought to a screen that displays the motor vehicle detail information. The detail screen shows more
information than what is seen above on the initial display screen. For additional information see the
motor vehicle detail section (figure 3.4).

If you inquire on a plate number or VIN that does not exist in the Utah Motor Vehicle Files, you will
receive a response like the one shown (see figure 1.4). In this instance, the user inquired upon the plate
“WIERDO,” which is not in the Utah Motor Vehicle Files.

It could be that you entered the plate number incorrectly. Make sure to omit any blank spaces and
punctuation when entering plate numbers, and double check that the plate number was entered correctly.
For VIN searches, double check that the right VIN was entered.
Search by VIN Number
To search by the vehicle’s VIN, enter the complete VIN number in the VIN field. Press “Enter” or click
“Submit Query” (see figure 1.5). The results will be identical to the license plate search (see figure 1.3).

Search by Registration Decal Number
To search by the registration decal, enter the decal number in the “Decal Number” field and submit (see
figure 1.6). The decal’s year of expiration is entered in the “Decal Year” as a two digit number (example:
07 for 2007, 10 for 2010, 11 for 2011, and so forth). Press “Enter” or click on “Submit Query.” The results
will be identical to the license plate search (see figure 1.3).

Search by Name of Registered Owner
The name index file is in strict alphabetic order by last name. Searches may be made on all registered
owners of a vehicle; i.e., if a vehicle is registered in the names of both a husband and wife, a name search
on either name will pull up the vehicle registration information.
There are three transactions to inquire specifically by name:
RQL: returns a name list with license plate and VIN data that can be selected to display the
details (see figure 1.7)
RNQL: returns a name list with license plate data that can be selected to display the details
RNQV: returns a name list with VIN data that can be selected to display the details.

Searching Common Names by Name of Registered Owner
The Utah Motor Vehicle Division does not capture owner dates of birth on vehicle registration
information. If you are running a search on a common name with the standard RQL search transaction
you may not be able to find the information you need. The Partial Plate Search (PPS) may help in this
situation. Please see “Partial Plate Search – Searching Common Names” portion in this section of the BCI
Operating Manual.
Motor Vehicle Name List Inquiry
When searching the name of an individual, enter the owner’s name in the “Name” field, last name first.
Separate the last and first name with a comma. In this example, we are searching for vehicles registered to
Zeke Bear, so BEAR, ZEKE is entered into the “Name” field (see figure 1.7).
NOTE: “Zeke Bear” is NOT a valid test record on UCJIS.

After running a name search, you will be brought to a name list as shown (see figure 1.8). It lists the name
of the registered owner, license plate number (link), VIN (link), vehicle year, vehicle make, vehicle model,
and county that the vehicle is registered in.
The county codes can be seen at the end of this section of the manual.

Searching Vehicles Registered to a Company or Organization
If the vehicle is owned by a company or other entity, and the name of the company contains a number
(7UP, 3M, etc.) the number may or may not be spelled out. If the owner is the 7UP company, the vehicle
may be listed under 7UP, SevenUp, or Seven Up. You may have to try all possible combinations before
receiving a hit.
Special characters, such as hyphens, slashes, commas, etc., can be entered when running the name of a
company (see figure 2.0).

Occasionally when you run a name search on the Utah Motor Vehicle system, you will get a “hit” on the
name, but will find no license plate number in the name list (see figure 2.1). When this happens, you can

no records can be found in other states, it most likely means that the vehicle is not currently registered in

Lessee Information
If a vehicle is being leased, the “lessee” information will be filled in under the “REGISTERED OWNER
INFORMATION.” This information only appears on vehicles that are leased for more than one year.
Information about the person who is leasing the vehicle will appear under “LESSEE.” The “LESSOR” listed
on the screen is the entity that is legally liable for the vehicle and is the name of the person/company
from whom the Lessee is leasing.
In this example shown, Michael Bluth is leasing his vehicle from the Nissan-Infiniti Company (see figure
2.4).

Insurance Information
The insurance information shown on the Utah Motor Vehicle Registration screens comes from a company
called Insure-Rite, and not the Utah Motor Vehicle Division.
The “AS OF” statement means that the information seen was current as of the date shown. Insure-Rite
updates the insurance information almost daily. If the Motor Vehicle Screen shows that a motorist’s
insurance information is “Not Found” this does not necessarily mean the individual does not have
insurance. It is possible that the individual purchased some insurance after the date shown. Or, it is
possible that the individual cancelled the insurance policy since the last update. Technical difficulties may
also effect the information seen.
For example, if the motorist shows as insured the “Insured” line will read:

Exempt License Plates
Many vehicles, particularly government vehicles, do not have to be registered every year and are
considered “exempt.” Examples of such vehicles may include city, county or state government owned
vehicles, as well as some vehicles owned by public utilities.
Exempt plates consist of numerics preceded by or followed by the letters “EX.” Run the characters on the
plate in the same manner as you would regular plates, omitting spaces before or after the EX. Where the
EX is placed, before or after the number, is dictated by where it occurs on the plate.
For example:
EX 12345 would be entered in the LIC field as EX12345
44444 EX would be entered as 44444EX
123456 EX would be run as 123456EX

search. Running plate number SIMPSONS with the RNQL transaction brings back the result shown (see
figure 2.5). The plate number shown is a hyperlink that brings you to the detail screen.

Handicap Placard Search
This file contains information on the owner of the handicap placard. Handicap placards belong to the
handicapped driver, and do not belong to a specific vehicle. A handicapped driver may own several
vehicles, and can transfer the placard to whatever vehicle he or she is driving at the moment.
The search (OP transaction) can be run only by placard number (see figure 3.3). The result of an inquiry
is shown (see figure 3.4).

If you need more information that what is shown on the initial display screen, you have two options for
getting detailed information.
If you already have the Motor Vehicle Registration screen open, click on the blue hyperlinked license
number to pull up the “detail screen.” In this example, GOJAZZ is the hyperlink in the upper left corner
(see figure 3.5).
The detail response brings back more information than what is seen on the Motor Vehicle Registration
screen. The amount of information seen depends upon what the Utah Motor Vehicle Division has added to
the record. The detail results will look like the screen shown (see figure 3.5). Note that not all fields are
filled in.
If you already have the decal number, plate number or VIN available, enter RQD into the Transaction
Code box, click “GO,” and then enter the known information into the appropriate field. You cannot inquire
by name on the RQD transaction.
Regardless of the inquiry method used, the response will look similar to the one shown (see figure 3.5).
Not all fields will be filled in on all vehicles. The amount of information shown depends entirely upon the
Utah Motor Vehicle Division.

Running a motor vehicle inquiry allows you to view Utah driver license and Utah statewide warrant
information on the registered owner(s) of a vehicle. When the vehicle data displays on your screen, the
name(s) of the registered owner is a hyperlink that brings you to the Utah driver license and Utah
statewide warrant transactions (see figure 3.7). Clicking on the owner name generates these two
additional inquiries.

After running the plate “GO JAZZ,” you want to see if the primary owner, Jazz Bear, has a Utah driver
license or any Utah statewide warrants. Click on the hyperlinked name Jazz Bear, and the shown screen
will return (see figure 3.8). The SWW-PO INQ and UTAH DL buttons show as red until the data is
returned. Once a button turns green you may click it to view the results (see figure 3.7).

Clicking on the green buttons shows the results of the inquiries. Clicking “SWW-PO INQ” will show if Jazz
Bear has any Utah statewide warrants. Clicking “UTAH DL” will show Jazz Bear’s Utah driver license (if
any.) Refer to the appropriate Driver License or Statewide Warrants sections for more information on
these results.
Clicking the name Honey Bear (the secondary owner) will show if she has any Utah warrants or a Utah
driver license.
If the owner name is common, this approach to finding warrants or driver license information may not
work. It also does not work if the vehicle is registered to a company or other entity.

can do this.

If you have used the Partial Plate Search transaction prior to February 2010, the layout of the screens has
changed, but the basic principles of the search are still the same as they have been.
The initial PPS search screen looks like the screen shown (see figure 3.10).

If any of the characters on the plate are known, enter them in the corresponding “Plate by Position” fields
in the upper left corner of the screen (see figure 4.0). The “Plate by Position” requires that the characters
be placed in the exact location as they are on the plate. For instance, if it is known that the first, second,
third, and fourth characters are “123A” (in that order,) enter those in the first, second, third, and fourth
positions (see figure 4.0). Then click the “Submit Query” button on the lower part of the screen.

Clicking the hyperlinked license plate number in the “License” field brings you to the motor vehicle detail
screen for that vehicle. In the example (see figure 4.1), clicking 123A9 brings you to the detail screen for
the Utah plate 123A9.
Remember, the “Plate by Position” search requires that the characters be placed in exactly the same
position as they are on the license plate. Running the search with 123A in the first, second, third, and
fourth positions will not bring back results for plates with 123A in the third, fourth, fifth, and sixth
positions (XX123A for example). If the exact character placement in unknown, use the “Plate Contains
Any” fields.
Often, “Plate by Position” searches bring back more results than the system can handle. Searches will
usually need to be narrowed by entering other known information, such as vehicle year range, make,
model, county, color, etc. (see figure 4.2)
NOTE: The “color” field is not filled in for many vehicles. Entering the color in the color
field may cause you to miss potential matches. In the example shown above you
will notice that only one of the vehicles in the list (123AA) has the color (red)
listed.

If it is known that the vehicle with the “123A” in the plate number is registered in Salt Lake County, the
search can be restricted by entering “Salt Lake” into the “County” field (see figure 4.2).
This search brings back all vehicles registered in Salt Lake County with 1 in the first position, 2 in the
second position, 3 in the third position, and A in the fourth position. Results are shown (see figure 4.3).

Plate Contains Any
If it is known that certain characters are contained somewhere in the plate, but the exact positions are not
known, the search can be run by entering the characters in the “Plate Contains Any” fields, and all
combinations will be checked.
For instance, if it is known that A, B, and C are each contained somewhere in the plate number, enter A, B,
and C into the “Plate Contains Any” fields. The exact positions do not matter. Entering ABC brings back the
same results as entering CBA, ACB, etc. (see figure 4.4)

Using the “Plate Contains Any” search will almost always bring back more results than the system can
handle. You will almost always need to narrow down the search when using the “Plate Contains Any”
search.
The above example of A, B and C in any position is too much for the UCJIS system to handle. The search
must be narrowed down, as shown (see figure 4.5).

Narrowing the search by Make, Year Range, Model, etc., will bring back fewer results, and will most likely
be more useful to the operator.
Searching by Name and County
The PPS transaction can be used to run a name of the owner. No other information is needed for this
search, although extra information can help narrow down the search if the name is common.
To find all vehicles registered to the last name “Krzyzewski” in Sevier County, enter Krzyzewski in the
Last Name field, and choose “Sevier” as the county (see figure 4.7).

Partial Plate Search – Searching Common Names
As mentioned previously, running a common name with the RQL transaction can be difficult because
dates of birth for the registered owner are not captured by the Utah Department of Motor Vehicles.
However, if you know certain facts about the person or vehicle you are searching on, the PPS transaction
can be helpful when searching common names.
If you are searching John Smith, and it is known he usually drives trucks, and lives in Uintah County, enter
“TRUCK” in the Vehicle Type field, “Smith” in the Last Name, “John” in the First Name, and “UINTAH” in
the County field (see figure 4.9).

Partial Plate Search – No Plate Number Known
If no plate number is known, the PPS transaction can be used to search for certain types of vehicles. The
narrower you make the search, the better the likelihood of receiving a response.
The example (see figure 5.1) is looking for all 2007 and 2008 Acuras registered in Tooele County.
This search brings back all 2007 and 2008 Acuras registered in Tooele County (23), regardless of what
the plate number is (see figure 5.2).

Partial VIN Number Search
If only a partial VIN is known, the same program may be used to look up possible matches. Enter the
characters in the “VIN by Position” fields in the exact placement as they show on the VIN. If “G” is the
second character in the VIN, “G” must be entered in the second position in the “VIN by Position” search.
The example (see figure 5.2) will find all vehicles registered in Utah where the VIN begins exactly with
1GCDT14X.

Recreational Vehicles (ATVs, snowmobiles, etc.) registered in Utah are run on the same screen, and in the
same manner, as regular motor vehicles. Watercrafts (boats, jet-skis, wave-runners, etc.) have their own
inquiry screens that are separate from the motor vehicle screens. Information on boat inquiries can be
found later in this section of the BCI Operating Manual.
Recreational Vehicle Decal Numbers
When running an RQL search by owner name, recreational vehicles can be identified on the name search
screen by the plate number (or “decal number”). The plate number shown on the name search results will
be the recreational vehicle’s “Decal Number.”
Decal numbers begin with a code for each group:
SN – Snowmobile
OH - Off Highway (dirt bikes, ATVs)
After running a standard name search on Xavier Smith with the Utah RQL transaction, the recreational
vehicles can be identified by the two-letter code in license field. The make and model also tell you if it is a
recreational vehicle (see figure 5.4).

To view the motor vehicle registration screen for the recreational vehicle, click the highlighted decal
number of the vehicle you are interested in (in this example, OH10636098). You will be brought to a
screen like the one shown (see figure 5.5).
With the exception of the “Decal Number” in the “License Plate” field, it is the same as the summary
screen for a regular motor vehicle. To get detail information on the recreational vehicle, click on the
hyperlinked “License Plate” number in the upper left hand corner of the screen.

Assigned Hull Number – BQN Transaction
The “Assigned Hull Number” is a separate number assigned to motorized watercraft in addition to the
decal number. You will need to know the Assigned Hull Number before running a BQN Transaction.
When inquiring by the Assigned Hull Number the number must be eight characters long. For a boat
registered in Utah it will begin with “UT” and be followed by four numbers, and then a two character
alphabetic county code (for example, UT9999QR).
NOTE: UT9999QR is not a test record.
Enter BQN into the Transaction Code box and click “GO.” Enter the eight-digit Assigned Hull Number in
the “Assigned Number” field. Hit “Enter” or click “Submit Query” (see figure 5.9).

Hull Numbers Less Than Eight Characters
When inquiring by the Assigned Hull Number the number must be eight characters. If the Assigned
Number you need to run is less than eight characters long “zeros” will need to be added after the UT and
before the known numbers to make the Hull Number eight characters long.
For instance, you need to inquire on the Assigned Hull Number UT86WC, which is only six characters
long. To run this on UCJIS, make an inquiry on UT0086WC. The Assigned Hull Number UT686TE would
have to be run as UT0686TE in order to make it eight characters long.
Watercraft Registration by Owner Name – BNQH Transaction
Watercraft registration information is available by registered owner name. To obtain the information
select the BNQH Transaction.
The name index file is in strict alphabetic order by last name. Searches may be made on all registered
owners of a vehicle; i.e., if a watercraft is registered in the names of both a husband and wife, a name
search on either name will pull up the watercraft.
If the name of the company that owns the watercraft contains a number (7UP, 3M, etc.), the number may
or may not be spelled out. If the owner is the 7UP company, the watercraft may be listed under 7UP or
SevenUp. The operator may have to try all possible combinations before receiving a hit.
To search the Utah Watercraft Registration Files by owner name, enter BNQH into the Transaction Code
box and click “GO.” Enter the owner name, last name first, into the NAM field. Leave the DOB field blank.
Hit “Enter” or click “Submit Query” (see figure 6.1).

The HIN number is placed in different locations, depending on the manufacturer. The hull identification
number (HIN) on all boats built after November 1, 1972 is permanently affixed to the rear of the transom
usually on the upper right corner, and is required by federal law. The HIN consists of 12 letters and
numerals at least one-quarter inch tall that indicate the manufacturer, hull serial numbers and/or letters,
and model year and/or month. The Assigned Hull Number and Decal Number are issued by the Utah
Motor Vehicle Division, while the HIN is affixed by the manufacturer, and must meet certain
requirements, much in the same way a VIN number on a vehicle must meet certain requirements.

The HVEH transaction allows the user to inquire on information from NCIC Stolen Vehicle File entries.
This information is only available to users that have access to both Utah Motor Vehicle files and NCIC files.
This transaction allows the user to inquire by several methods:
Date of theft
Area of theft
Vehicle data
Partial Plate or VIN
From the UCJIS web site select the Motor Vehicle Hot Files Screen. There are two different ways the user
can do this. The user can enter the code HVEH into the “Transaction Code” box and click “GO.”
Or, the user can select “Vehicle,” then “Inquiry,” then “Utah,” then “Vehicle Hot Files” from the left-hand
“tree” structure. An example of the inquiry screen is shown (see figure 7.0).

The inquiry can be as broad or as narrow as needed. By entering more or less information in the
transaction fields a user can expand the inquiry to include more or less responses.
The response from the inquiry made using the sample above (Chevrolet automobiles entered into NCIC in
Salt Lake County from January 1, 2006 through April 6, 2006) is shown (see figure 7.1)

While this is a sampling from the response, several things should be noted. First, the response came back
on a two-line response. This means that the response is displayed with data on an entry on two lines
rather than one line but requiring the user to scroll the screen to the right to read the response. Next,
users should note that the plate number and VIN fields are hyperlinks and by clicking on either the listed
license plate or VIN data, the user can run a motor vehicle registration inquiry. And last, by clicking on the
NIC number, a hyperlink, the user can run an NCIC inquiry by that NIC.

Section 2721 - Prohibition on release and use of certain personal information from State motor vehicle
records
(a) In General -- Except as provided in subsection (b), a State department of motor vehicles, and any
officer, employee, or contractor, thereof, shall not knowingly disclose or otherwise make available to any
person or entity personal information about any individual obtained by the department in connection
with a motor vehicle record.
(b) Permissible Uses -- Personal information referred to in subsection (a) shall be disclosed for use in
connection with matters of motor vehicle or driver safety and theft, motor vehicle emissions, motor
vehicle product alterations, recalls, or advisories, performance monitoring of motor vehicles and dealers
by motor vehicle manufacturers, and removal of non-owner records from the original owner records of
motor vehicle manufacturers to carry out the purposes of the Automobile Information Disclosure Act, the
Motor Vehicle Information and Cost Saving Act, the National Traffic and Motor Vehicle Safety Act of 1966,
the Anti-Car Theft Act of 1992, and the Clean Air Act, and may be disclosed as follows:
(1) For use by any government agency, including any court or law enforcement agency, in
carrying out its functions, or any private person or entity acting on behalf of federal, State, or
local agency in carrying out its functions.
(2) For use in connection with matters of motor vehicle or driver safety and theft; motor vehicle
emissions; motor vehicle product alterations, recalls, or advisories; performance monitoring
of motor vehicles, motor vehicle parts and dealers; motor vehicle market research activities,
including survey research; and removal of non-owner records from the original owner
records of motor vehicle manufacturers.
(3) For use in the normal course of business by a legitimate business or its agents, employees, or
contractors, but only
(A) to verify the accuracy of personal information submitted by the individual to the
business or its agents, employees, or contractors; and
(B) if such information as so submitted is not correct or is no longer correct, to obtain the
correct information, but only for the purposes of preventing fraud by, pursuing legal
remedies against, or recovering on a debt or security interest against, the individual.
(4) For use in connection with any civil, criminal, administrative, or arbitral proceeding in any
Federal, State, or local court or agency or before any self-regulatory body, including the
service of process, investigation in anticipation of litigation, and the execution or enforcement
of judgments and orders, or pursuant to an order of a Federal, State, or local court.

(5) For use in research activities, and for use in producing statistical reports, soling as the
personal information is not published, redisclosed, or used to contact individuals.
(6) For use by any insurer or insurance support organization, or by a self-insured entity, or its
agents, employees, or contractors, in connection with claims investigation activities, anti-fraud
activities, rating or underwriting.
(7) For use in providing notice to the owners of towed or impounded vehicles.
(8) For use by any licensed private investigative agency or licensed security service for any
purpose permitted under this subsection.
(9) For use by an employer or its agents or insurer to obtain or verify information relating to a
holder of a commercial driver's license that is required under the Commercial Motor Vehicle
Safety Act of 1986 (49 U.S.C. App. 2710 et seq.).
(10) For use in connection with the operation of private toll transportation facilities.
(11) For any other use in response to requests for individual motor vehicle records if the motor
vehicle department has provided in a clear and conspicuous manner on forms for issuance or
renewal of operator's permits, titles, registrations, or identification cards, notice that personal
information collected by the department may be disclosed to any business or person, and has
provided in a clear and conspicuous manner on such forms an opportunity to prohibit such
disclosures.
(12) For bulk distribution for surveys, marketing or solicitations if the motor vehicle department
has implemented methods and procedures to ensure that
(A) individuals are provided an opportunity, in a clear and conspicuous manner, to
prohibit such uses; and
(B) the information will be used, rented, or sold solely for bulk distribution for surveys,
marketing, and solicitations, and that surveys, marketing, and solicitations will not be
directed at those individuals who have requested in a timely fashion that they not be
directed at them.
(13) For use by any requester, if the requester demonstrates it has obtained the written consent
of the individual to whom the information pertains.
(14) For any other use specifically authorized under the law of the State that holds the record, if
such use is related to the operation of a motor vehicle or public safety.

(c) Resale or Redisclosure -- An authorized recipient of personal information (except a recipient under
subsection (b)(11) or (12)) may resell or redisclose the information only for a use permitted under
subsection (b) (but not for uses under subsection (b)(11) or (12)). An authorized recipient under
subsection (b)(11) may resell or redisclose personal information for any purpose. An authorized recipient
under subsection (b)(12) may resell or redisclose personal information pursuant to subsection (b)(12).
Any authorized recipient (except a recipient under subsection(b)(11)) that resells or rediscloses personal
information covered by this title must keep for a period of 5 years records identifying each person or
entity that receives information and the permitted purpose for which the information will be used and
must make such records available to the motor vehicle department upon request.
(d) Waiver Procedures -- A State motor vehicle department may establish and carry out procedures under
which the department or its agents, upon receiving a request for personal information that does not fall
within one of the exceptions in subsection (b), may mail a copy of the request to the individual about
whom the information was requested, informing such individual of the request, together with a statement
to the effect that the information will not be released unless the individual waives such individual's right
to privacy under this section.

Section 2722. Additional Unlawful Acts
(a) Procurement for Unlawful Purpose -- It shall be unlawful for any person knowingly to obtain or
disclose personal information, from a motor vehicle record, for any use not permitted under
section 2721(b) of this title.
(b) False Representation -- It shall be unlawful for any person to make false representation to obtain
any personal information from an individual's motor vehicle record.
Section 2723. Penalties
(a) Criminal Fine -- A person who knowingly violates this chapter shall be fined under this title.
(b) Violations by State Department of Motor Vehicles -- Any State department of motor vehicles that has a
policy or practice of substantial noncompliance with this chapter shall be subject to a civil penalty
imposed by the Attorney General of not more than $5,000 a day for each day of substantial
noncompliance.
Section 2724. Civil Action
(a) Cause of Action -- A person who knowingly obtains, discloses or uses personal information, from a
motor vehicle record, for a purpose not permitted under this chapter shall be liable to the individual to
whom the information pertains, who may bring a civil action in a United States district court.
(b) Remedies -- The court may award –
(1) actual damages, but not less than liquidated damages in the amount of $2,500;
(2) punitive damages upon proof of willful or reckless disregard of the law;
(3) reasonable attorneys' fees and other litigation costs reasonably incurred; and
(4) such other preliminary and equitable relief as the court determines to be appropriate.

Sec. 2721. Prohibition on release and use of certain personal information from State motor vehicle
records
(a) In General.--A State department of motor vehicles, and any officer, employee, or contractor thereof,
shall not knowingly disclose or otherwise make available to any person or entity:
(1) personal information, as defined in 18 U.S.C. 2725(3), about any individual obtained by the
department in connection with a motor vehicle record, except as provided in subsection (b) of this
section; or
(2) highly restricted personal information, as defined in 18 U.S.C. 2725(4), about any individual
obtained by the department in connection with a motor vehicle record, without the express
consent of the person to whom such information applies, except uses permitted in subsections
(b)(1), (b)(4), (b)(6), and (b)(9): Provided, That subsection (a)(2) shall not in any way affect the
use of organ donation information on an individual's driver's license or affect the administration
of organ donation initiatives in the States.
(b) Permissible Uses.--Personal information referred to in subsection (a) shall be disclosed for use in
connection with matters of motor vehicle or driver safety and theft, motor vehicle emissions, motor
vehicle product alterations, recalls, or advisories, performance monitoring of motor vehicles and dealers
by motor vehicle manufacturers, and removal of non-owner records from the original owner records of
motor vehicle manufacturers to carry out the purposes of titles I and IV of the Anti Car Theft Act of 1992,
the Automobile Information Disclosure Act (15 U.S.C. 1231 et seq.), the Clean Air Act (42 U.S.C. 7401 et
seq.), and chapters 301, 305, and 321-331 of title 49, and, subject to subsection (a)(2), may be disclosed
as follows:
(1) For use by any government agency, including any court or law enforcement agency, in
carrying out its functions, or any private person or entity acting on behalf of a Federal,
State, or local agency in carrying out its functions.

consent of the individual to whom the information pertains.
(14) For any other use specifically authorized under the law of the State that holds the record,
if such use is related to the operation of a motor vehicle or public safety.
(c) Resale or Redisclosure.--An authorized recipient of personal information (except a recipient under
subsection (b)(11) or (12)) may resell or redisclose the information only for a use permitted under
subsection (b) (but not for uses under subsection (b)(11) or (12)). An authorized recipient under
subsection (b)(11) may resell or redisclose personal information for any purpose. An authorized recipient
under subsection (b)(12) may resell or redisclose personal information pursuant to subsection (b)(12).
Any authorized recipient (except a recipient under subsection (b)(11)) that resells or rediscloses
personal information covered by this chapter must keep for a period of 5 years records identifying each
person or entity that receives information and the permitted purpose for which the information will be
used and must make such records available to the motor vehicle department upon request.(d) Waiver
Procedures.--A State motor vehicle department may establish and carry out procedures under which the
department or its agents, upon receiving a request for personal information that does not fall within one
of the exceptions in subsection (b), may mail a copy of the request to the individual about whom the
information was requested, informing such individual of the request, together with a statement to the
effect that the information will not be released unless the individual waives such individual's right to
privacy under this section.(e) Prohibition on Conditions.--No State may condition or burden in any way
the issuance of an individual's motor vehicle record as defined in 18 U.S.C. 2725(1) to obtain express
consent. Nothing in this paragraph shall be construed to prohibit a State from charging an administrative
fee for issuance of a motor vehicle record.
