Lease Agreement
This Agreement is made and entered into this ___ day of August, 2008, by and between ____________________, an individual (“Lessor”) and ___________________, an individual (“Lessee”). 1. The Property. For and consideration of the promises and covenants set forth herein, Lessor hereby leases to Lessee and Lessee hereby leases from Lessor that certain residence located on __________ Road, approximately 1.5 miles west and one mile south of __________________, as may be more particularly described in Exhibit A attached hereto., together with all other improvements and fixtures thereon and appurtenances thereto (collectively referred to herein as the “Property”). 2. Term. The term of this Lease shall commence on August ___, 2008 and shall automatically renew at the beginning of each subsequent month unless otherwise terminated pursuant to the terms hereof. 3. Rent. As initial rental for the Property, Lessee shall maintain the Property in its current condition and keep the Property clean, mowed and repaired. Specifically, Lessor agrees to perform specific repairs in the time allotted to the property as are set forth on Exhibit B attached hereto and made a part hereof. Such repairs shall be performed in a quality workman like manner. Lessor shall have the opportunity to check the progress and quality of such repairs as well as the condition of the entire property at any time with reasonable notice given at the discretion of Lessor by telephone to Lessee. Lessor shall have the option to terminate this Lease Agreement at anytime if, in Lessor’s sole and absolute discretion, the repairs agreed to be made as set forth in Exhibit B are not progressing in a timely and quality manner, by Lessor giving Lessee thirty days verbal notice to terminate the lease and vacate the Property. In the event Lessor determines in its sole and absolute discretion that Lessee is damaging the property, wasting the Property, using it for any purpose other than as a single family residence for Lessee’s immediate family, Lessor may immediately terminate this Lease Agreement in which case Lessee shall vacate the Property within five days of Lessor’s delivery to Lessee of Notice to Terminate the Lease. During all times during which Lessee is in possession of the Property, Lessee shall use it best efforts to keep the property safe for all who may abide there and all visitors. Lessee accepts the property as is and assumes full responsibility, including provision of necessary liability coverage for any and all accidents which may occur to residents or visitors to the Property. Lessee agrees to hold Lessor harmless from any and all claims occasioned by accidents or injury which may happen to members of Lessee’s family living at the Property and all other guest and visitors and agrees to defend and hold Lessor harmless and to promptly indemnify Lessor for any liability, legal fees or other claims which may be brought by said dwellers, visitors or guests of Lessee. 4. Utilities. Lessor agrees to have the water, electric and other utilities connected with the Property put into the Lessee’s name. Lessee agrees to keep all payments for such
utility services current and to timely indemnify Lessor for any charges to Lessor for such utilities installed or consumed during Lessee’s possession or control of the Property. 5. Legal activities. Lessee agrees to permit the conduct of no illegal activities whatsoever at the Property. Any illegal activities conducted at the property shall result in immediate termination of the Lease and eviction of Lessee. 6. Surrender of Property. Lessee understands Lessor is interested in selling the Property and agrees that if Seller has a buyer willing to by the property, Lessor may give Lessee thirty days notice to terminate the lease and vacate the property unless the proposed buyer is agreeable to permitting Lessee to remain at the Property for a period of time. 7. Lessee shall permit no mechanics or materialmen’s liens or any other encumbrance to be place upon the property and shall immediately be fully responsible for removal of such liens should they occur. Any and all improvements Lessee performs on the property shall become part of and remain with the Property as part of the consideration for Lessee’s utilization of the Property. 8. Lessee may not sublease or sublet in any form any part of the Property without Lessor’s prior written consent. 9. Lessor makes now warranties or representation of any kind with respect to the condition of the Property and Lessee assumes the Property in its “as is” condition. However, Lessee acknowledges the requirements Lessee improve the Property as consideration for utilizing the Property and accordingly, Lessee shall ensure there are no broken pipes or other damage which may result from freezing weather or storm, and if such damage occurs, Lessee shall be responsible for fully repairing such damage and using its best efforts to assure against recurrence of such damage.
