THE TERM ` DANGEROUS GOODS ‘ REFERS TO ITEMS THAT ARE POTENTIALLY DANGEROUS FOR HUMAN LIFE AND ENVIRONMENT. THESE INCLUDE A WIDE RANGE OF SOLIDS, LIQUIDS AND GASES THAT HAVE EXPLOSIVE, FLAMMABLE, TOXIC (POISONOUS), INFECTIOUS, RADIOACTIVE OR CORROSIVE PROPERTIES. THESE ITEMS NEED SPECIAL TRANSPORT REQUIREMENTS TO ELIMINATE OR MINIMISE THE RISK OF INJURING PEOPLE OR DAMAGING PROPERTY AND THE ENVIRONMENT.

THE FOLLOWING INFORMATION NEEDS TO BE COLLECTED BEFORE A PLAN CAN BE DRAFTED: CHEMICALS TRANSPORTED; QUANTITIES TRANSPORTED; ROUTES ON WHICH TRANSPORTED; LIKELY POINTS WHERE ACCIDENTS COULD OCCUR; PAST ACCIDENT RECORD; CHEMICALS USUALLY INVOLVED IN ACCIDENTS; EXISTING SAFETY STATUS AND PREPARATION TO COMBAT AN EMERGENCY; COMPLIANCE OF EXISTING STATUTES, CONDITIONS OF ROADS.
IDENTIFICATION & ASSESSMENT OF HAZARD
TO MANAGE THE RISKS AND TO PROMOTE AND CONTINUALLY IMPROVE THE SAFE HANDLING OF DANGEROUS GOODS, SEVERAL STEPS NEED TO BE TAKEN. INTERNATIONAL REGULATION
THE COMMITTEE OF EXPERTS ON THE TRANSPORT OF DANGEROUS GOODS UNDER UNITED NATIONS ECONOMIC AND SOCIAL COUNCIL (ECOSOC), HAS PUBLISHED RECOMMENDATION ON THE TRANSPORT OF DANGEROUS GOODS (MODEL REGULATIONS) IN 1999. THESE RECOMMENDATIONS ON THE TRANSPORT OF DANGEROUS GOODS ARE ADDRESSED TO THE GOVERNMENTS AND TO THE INTERNATIONAL ORGANISATIONS CONCERNED WITH THE REGULATION OF THE TRANSPORT OF DANGEROUS GOODS. THESE MODEL REGUALTIONS DO NOT APPLY TO THE TRANSPORT OF DANGEROUS GOODS IN BULK, WHICH IN MOST COUNTRIES IS SUBJECT TO THE SPECIAL REGULATION.
INTERNATIONAL REGULATION
THE IMPORT / EXPORT OF HAZARDOUS CHEMICALS ARE ALSO CONTROLLED UNDER THE INTERNATIONALLY LEGALLY BINDING INSTRUMENT FOR THE APPLICATION OF THE PRIOR INFORMED CONSENT (PIC) PROCEDURE IN INTERNATIONAL TRADE. THE TRANSBOUNDARY MOVEMENT OF HAZARDOUS WASTES IS CONTROLLED UNDER THE BASEL CONVENTION. INDIA IS A PARTY TO THE CONVENTION. A PROTOCOL ON LIABILITY AND COMPENSATION FOR TRANSBOUNDARY MOVEMENT OF HAZARDOUS WASTES AND ITS DISPOSAL HAS BEEN ADOPTED. INDIA IS YET TO SIGN THE PROTOCOL.
OBLIGATION UNDER PLI ACT
WITH A VIEW TO ENSURING IMMEDIATE RELIEF TO VICTIMS OF A CHEMICAL ACCIDENTS, THE PLI ACT WAS PASSED IN 1991 BY THE PARLIAMENT. TRANSPORTATION OF HAZARDOUS CHEMICALS NOTIFIED BEYOND A SPECIFIC QUANTITIES ARE REQUIRED TO TAKE OUT INSURANCE POLICY UNDERN THIS ACT. THESE POLICIES ARE BEING OFFERED BY THE FOUR PUBLIC INSURANCE COMPANIES IN THE COUNTRY. SURPRISINGLY, TRANSPORTERS AND COMPANIES HIRING TRANSPORTERS HAVE NOT ENSURED COMPLIANCE OF THE LAW WHICH IS BEING SERIOUSLY LOOKED INTO.

THE SALIENT FEATURES OF THE LEGISLATION PROPOSED ARE:
1.CLASSIFICATION OF SUBSTANCES HAZARDOUS FOR HANDLING; 2. PACKAGING OF HAZARDOUS CHEMICALS; 3. LABELLING HAZARDOUS CHEMICALS FOR SUPPLY; 4.LABELLING OF CHEMICJALS HAZARDOUS FOR CONVEYANCE; METHOD OF MARKING OR LABELLING PACKAGES.

FEASIBILITY STUDY FOR TRANSPORTATION OF HAZARDOUS CHEMICALS ON NATIONAL HIGHWAY NO.8 HAS BEEN UNDERTAKEN WITH THE OBJECTIVE OF CREATING A DATA-BASE ON ACCIDENT OCCURANCE, NATURE OF DANGEROUS GOODS TRANSPORTED, ACCIDENT REPORTED SYSTEM, PREPARATION OF EMERGENCY PLANNING AND COMBATING ACCIDENTS THAT OCCUR IN TRANSPORTATION OF CHEMICALS.

THE MINISTRY PROPOSES TO UNDERTAKE VULNERABILITY AND RISK ASSESSMENT OF TRANSPORTATION OF HAZARDOUS CHEMICALS IN STATES HAVING A LARGE NUMBER OF MAJOR ACCIDENT HAZARD UNITS NAMELY GUJARAT, MAHARASHTRA, A.P. & TAMIL NADU TO START WITH.
