Improves the Federal Government’s ability to hire persons
with these disabilities
Designed to remove barriers and increase employment
opportunities for these individuals

New Regulation:
Broader certifying entities:
• A licensed medical professional (e.g., a physician or
other medical professional certified by a State, the
District of Columbia, or a U.S. territory to practice
medicine)
• A licensed vocational rehabilitation specialist (i.e., State
or private)
• Any Federal agency, State agency, or agency of the
District of Columbia or a U.S. territory that issues or
provides disability benefits

5 CFR 213.3102 (u) now replaces the following three
Schedule A appointing authorities:
• 5 CFR 213.3102 (t) (mental retardation)
• 5 CFR 213.3102 (u) (severe physical disabilities)
• 5 CFR 213.3102 (gg) (psychiatric disabilities)

• Temporary appointments
• Time limited appointments
• Permanent appointments
Clarifies distinctions between proof of disability and
certification of job readiness
Retains noncompetitive conversion to competitive service
