Overview of the Texas Enterprise Fund

      The number of projects awarded through the Texas Enterprise Fund (TEF) has steadily increased
       over the last three fiscal biennia. However, the average size of located projects has decreased.
       Mirroring worldwide business trends during the economic downturn, capital investment by TEF-
       funded projects between FY 2008 and FY 2011 totaled significantly less than investments committed
       between FY 2004 and FY 2007.

      Despite this trend, the TEF is on track during the current biennium (ending Aug. 31, 2011) to
       significantly exceed FY 2008-2009 results in all categories, including jobs and capital investment
       committed. The program has closed deals on 40% more projects during the first 16 months of the
       current biennium than were funded during the entirety of the previous biennium.

The TEF has helped attract businesses to Texas in a wide range of advanced industry sectors. The following
chart displays the distribution of all TEF-funded projects by industry.

Since the beginning of the FY 2010-2011 biennium, the TEF has funded 26 projects around the state.

An additional 12 projects received TEF award offers that did not result in finalized grants due to corporate
decisions by the applicants. These offers were made in the communities and years below.

The TEF has helped attract business investment from around the world. Below are the states or countries in

     Sec. 481.080. ECONOMIC AND FISCAL IMPACT STATEMENT FOR CERTAIN GRANT PROPOSALS.
           (a) Before the governor awards a grant under Section 481.078 to an entity for a proposed initiative, the
           office shall prepare a statement that, specifically and in detail, assesses the direct economic impact that
           approval of the grant will have on the residents of this state.
           (b) The statement must include:
                        (1) for the period covered by the grant:
                                    (A) the estimated number of jobs to be created in this state by the potential recipient
                                        each biennium; and
                                    (B) the estimated median wage of the jobs to be created in this state by the
                                        potential recipient each biennium;
                        (2) the additional amount of ad valorem taxes, sales and use taxes, and fee revenues projected
                            to be generated each year by governmental entities of this state;
                        (3) the total amount of tax credits, local incentives, and other money or credits estimated to be
                            distributed to the proposed grant recipient by governmental entities of this state; and
                        (4) any other information the office considers necessary to include in the statement.

Annual Verification of Program Compliance

Each TEF grant recipient is required to submit an Annual Compliance Verification report each year through
the duration of its contract term. These reports cover the status of yearly job targets and other contracted
commitments and are maintained by the Office of the Governor’s Financial Services division, which
monitors for fulfillment of all TEF agreements.


The table below details all compliance reports required for calendar year 2009 (latest available). All job
creation in these reports occurred before the annual reporting cut-off date of Dec. 31, 2009. Projects that did
not have job reporting requirements or targets for 2009 are not included.

TEF Contract Amendments

        The Office of the Governor has, on several occasions, worked with contracted TEF recipients to
amend the terms of their agreements. Amendments may adjust future job targets or deadlines when changes
in business conditions require awarded companies to modify their growth and hiring plans.
        In order for an amendment request to be considered, a company must be in compliance with all
contract terms at the time of consideration, as amendments are not used to retroactively assist grant recipients
that have already missed job creation targets. Additionally, all changes to TEF contracts require a
proportional exchange between the recipient company and the State in order to maintain the same return on
investment for the project as calculated by the Office of the Governor at the time of the original award. The
cost of an amendment is assessed on a case by case basis and may involve repayment of grant dollars,
reduction of future grant disbursements, or increasing the number of years for which jobs must contractually
be maintained.
        During FY 2010-2011 to date, 16 TEF recipients worked with the Office of the Governor to amend
their contracts for business reasons while remaining in good standing with their original TEF agreements.

        Additionally, Bank of America, which acquired Countrywide Financial in 2008, ended its $20
million TEF contract for business reasons in 2009, and returned an $8.45 million portion of the original
award. The State received return on the remainder of the grant through increased sales tax revenues resulting
from 3,800 new jobs created and reported by the project at the time of contract termination. Also in 2009,
Gulfstream ended its $375,000 TEF contract for business reasons, and as a condition of the agreement
returned the full TEF investment plus interest, a total of $379,949, to the State.
        In 2010, Alloy Polymers ended its TEF contract for business reasons and returned $43,816 of the
$100,000 grant the company had received in 2006. The State received return on the remainder of the grant
through increased sales tax revenues resulting from jobs created and reported by the project in the years
preceding contract termination.
