Members Cooperative Credit Union’s Internet Banking and Electronic Statement

END USER AGREEMENT



1. The acronym “MCCU” refers to Members Cooperative Credit Union. The words “you” or “your”

mean each person who uses the My Online Banking product with MCCU or is authorized by you

or MCCU to use My Online Banking.



2. MCCU’s My Online Banking product is provided as a service of MCCU and permits access to

member account information, provides eStatements, and upon request, allows account

transactions to be conducted. By accessing MCCU’s My Online Banking product you agree that

you are the account holder or you have full legal authority granted by the account holder or by law

to obtain information and conduct transactions.



3. When you click on the “Agree” button you agree to receive your statements electronically and

you are choosing to discontinue receiving your MCCU statements by mail, and agree to

receive MCCU e-Communications containing information about MCCU and its products and

services, Annual Notices, such as your annual privacy notice, and other required

disclosures electronically for all accounts you see on My Online Banking for which you are the

primary owner. You will receive your first eStatement by the 5 business day of the following

month. You will receive an email no later than the 5 business day of each month informing you

that your eStatement is available. You are responsible for providing MCCU with a new email

address whenever you change your email address. For security purposes, you may be required to

provide written notice of any email address changes. You agree to notify MCCU if you are unable

to access any of the information delivered by MCCU in electronic form or manner. If you later

decide you want to discontinue receiving eStatements contact MCCU at 1-800-296-8871. You will

then begin to receive statements by mail beginning the next statement cycle. There are no fees

associated with rescinding your consent to receive eStatements. You may be required to provide

written notice of your intent to rescind your consent to receive eStatements. If you want to receive

paper statements in addition to eStatements call MCCU at 1-800-296-8871. See the MCCU Rate

and Fee Schedule for fees associated with receiving paper statements.









4. MCCU has provided you an Account Number which is required in order to access MCCU’s My

Online Banking product. You will be required to establish a Sign-On ID and a Password prior to

accessing My Banking Online for the first time. You authorize MCCU to follow any instruction

entered through MCCU’s My Online Banking product using your Sign-On ID and Password. You

are responsible to ensure that your Account Number, Sign-On ID and Password are maintained in

a secure manner and not disclosed to any person who is not authorized to obtain account

information or conduct transactions on your account. If you believe that the security of your Sign-on

ID or Password have been compromised, you are required to contact MCCU immediately at 1-800-

296-8871.



5. MCCU and any other companies or entities involved in the design, development or operation of

MCCU’s My Online Banking product are not responsible and shall not have any liability for any

loss, expense, injury, cost or damage resulting from any access obtained to account information or

any transactions conducted on any account which occur prior to notice by you to MCCU that the

Sign-On ID or Password may have been disclosed to or obtained by any unauthorized person,

other than those transactions for which we are responsible, as explained through our EFT

agreement.



6. If you use any method of storing your Account Number or Sign-On ID or Password on your

computer, you are solely responsible for unauthorized access to account information any

transactions conducted on your account(s). If you have reason to believe that your Account

Number or Sign-On ID or Password have been disclosed to or obtained by an unauthorized person,

you are required to immediately notify MCCU at 1-800-296-8871.

7. Except as specifically provided in this Agreement or where the law requires a different standard,

you agree that neither we nor the service providers shall be responsible for any loss, property

damage or bodily injury, whether caused by the equipment, software, MCCU, or by Internet

browser providers, such as Microsoft Corporation (Microsoft Internet Explorer browser) and Mozilla

Foundation (Mozilla Firefox browser), or by Internet access providers or by online service

providers, wireless carriers, or by an agent or subcontractor of any of the foregoing: nor shall we or

the service providers be responsible for any direct, indirect, special or consequential, economic or

other damages arising in any way out of the installation, use, or maintenance of the equipment,

software, the online financial services, or Internet browser or access software.



8. When connected to or using MCCU’s My Online Banking product, you are required to ensure that

no unauthorized persons have access to your computer. If you fail to maintain direct control and

supervision over your computer or otherwise fail to ensure that no unauthorized persons have

access to your computer when connected to or using MCCU’s My Online Banking product, MCCU

and any other companies or entities involved in the design, development or operation of MCCU’s

My Online Banking product are not responsible for any loss, expense, injury, cost or damage

resulting from any unauthorized (non-authorized) access obtained to account information or any

transactions conducted on any account.



9. Sending electronic mail (E-mail) through My Online Banking is a way for you to communicate with

the Credit Union. E-mail is provided for you to ask general questions about your account(s) and

provide general feedback. You cannot use E-mail to initiate transactions on your account(s). Please

note that E-mail is not a secure method of communication over the Internet. MCCU requests that

you do not include confidential information (i.e. your account number or social security number) in

your E-mail.



10. You are responsible for any charges, such as, but not limited to telephone charges, internet

connection charges, or long-distance calling charges, incurred in accessing My Online Banking

and e-Communications.



11. My Online Banking may be unavailable at certain times or for certain periods of time or for some

or all of your accounts, due to system maintenance, system failure, or other reasons. MCCU is not

responsible for any damages alleged as a result of these interuptions in service.



12. If your account enrolled in My Online Banking is closed or deleted voluntarily or involuntarily, you

will no longer be able to use My Online Banking.



13. MCCU may, from time to time, make additional services available through My Online Banking.

MCCU will notify you of the availability and terms of these new services. By using these additional

services when they become available, you agree to be bound by this Agreement and any additional

instructions, procedures, or terms MCCU provides you with respect to each of these new services.



14. Subject to any notice required by law, your access to My Online Banking may be cancelled at the

sole discretion of MCCU at any time and for any reason. MCCU may change any other terms

described in this Agreement or related to My Online Banking at any time. MCCU will notify you in

advance of any changes online, by email, or by mail at your last known address, unless

cancellation or the change is necessary to immediately protect the security of your account or the

My Online Banking system. MCCU will cancel your My Online Banking if you have not accessed

My Online Banking for 180 days or more.



15. To terminate this Agreement and access to My Online Banking send written authorization to

16. When you click on the “Agree” button you are accepting this Agreement. By accepting this

agreement, you acknowledge that you have received a MCCU’s My Online Banking product

Account Information Brochure including an Electronic Funds Transaction Agreement, Truth in

Savings Act and privacy disclosures, have read the terms of this Agreement and that you agree to

be bound by these terms, including the provisions stating that MCCU and any other companies or

entities involved in the design, development or operation of MCCU’s My Online Banking product

are not responsible for any loss, expense, injury, cost or damages, including direct, indirect,

special, consequential, economic damages, resulting from any access obtained to account

information or any transactions conducted on the account. Further, you understand that by

accepting this Agreement, the current date will be logged as part of your account records and

MCCU’s My Online Banking product will be activated for your account and you will begin receiving

E-communications.
