AN ORDINANCE REZONING TWO TRACTS OF LAND TOTALING 3.77 ACRES, BEING

LOT 1, BLOCK 1, CRYSTAL PARK PHASE I, AND A 0.02 ACRE TRACT SITUATED IN

THE MORGAN RECTOR SURVEY, ABSTRACT 46, BRAZOS COUNTY, TEXAS.



BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COLLEGE STATION,

TEXAS:



PART 1: That the City of College Station Zoning Ordinance #1638, more specifically the

Official Zoning Map, be amended as set out in Exhibits “A, “B”, “C”, “D”, and “E”

attached hereto and made a part of this ordinance for all purposes.



PART 2: That if any provisions of any section of this ordinance shall be held to be void or

unconstitutional, such holding shall in no way effect the validity of the remaining

provisions or sections of this ordinance, which shall remain in full force and effect.



PART 3: That any person, firm or corporation violating any of the provisions of this chapter

shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be

punishable by a fine of not less than Twenty-five dollars ($25.00) nor more than Two

Thousand Dollars ($2000.00). Each day such violation shall continue or be

permitted to continue, shall be deemed a separate offense. Said Ordinance, being a

penal ordinance, becomes effective ten (10) days after its date of passage by the City

Council, as provided by Section 35 of the Charter of the City of College Station.

EXHIBIT “A”





That the Official Zoning Map of the City of College Station, and part of Zoning Ordinance

#1638, is hereby amended as follows:





The following property is rezoned from A-P Administrative Professional to PDD-B

Planned Development District – Business.



3.77 acres being described as Lot 1, Block 1, Crystal Park Phase I, and a 0.02 acre

tract lying and being situated in the Morgan Rector Survey, Abstract No. 46, College

Station, Brazos County, Texas, and being that portion of the 10.4 acre tract described in

the deed as recorded in Volume 467, Page 314, of the Deed Records of Brazos County,

Texas being more particularly described by metes and bounds in the attached Exhibit

“B”. Both tracts are shown graphically in Exhibit “C”.





The purpose of the PDD-B Planned Development District – Business zoning

designation on the property described above is to allow for the development and

maintenance of an office and light retail mix of uses limited to uses as listed in the A-P

zoning district and including light retail uses such as art galleries, jewelry stores,

clothing/accessories and coffee/sandwich shops. The overall building height shall not

exceed 30’ and all business activities shall be conducted inside the buildings. The site

shall be constructed in accordance with the development plan as shown in Exhibits “D”

and “E”.

EXHIBIT “B”





Being a 0.02 acre tract or parcel of land, lying and being situated in the Morgan Rector Survey, Abstract No. 46,

College Station, Brazos County, Texas, and being that portion of the 10.4 acre tract described in the deed from

Kathy Dowell Rice to Dan Clancy and Susan Clancy as Trustees of the Vera Cox Dowell Living Trust recorded in

Volume 467, Page 314, of the Deed Records of Brazos County, Texas, lying off of Farm to Market Road No. 2818,

and being more particularly described as follows:



BEGINNING at a ½” iron rod found in the south right-of-way line of Farm to Market Road No. 2818, marking an ell

corner of a 3.770 acre tract described in the deed to Karbrooke, Inc., recorded in Volume 2048, Page 182, of the

Official Records of Brazos County, Texas, a ½” iron rod found marking the northeast corner of the said 3.770 acre

tract bears S 80° 55’ 36” E – 195.05 feet;



THENCE along the southeast and southwest lines of the beforementioned Clancy 10.4 acre tract;



THENCE along the common line between the beforementioned 10.4 acre tract and the Karbrooke Inc., 3.770 acre

tract follows:



S 49° 21’ 59” W 38.23 feet to a 5/8” iron rod found,

N 39° 31’ 23” W 44.09 feet to a ½” iron rod found in the south right-of-way line of Farm to

Market Road No. 2818;



THENCE 80° 55’ 36” E along the south right-of-way line of Farm to Market Road No. 2818 for a distance of 57.79

feet to the PLACE OF BEGINNING, containing 0.02 acre of land, more or less.
