CONTEST IS OPEN ONLY TO LEGAL RESIDENTS OF GEORGIA IN THE UNITED STATES OF AMERICA
AND 21 YEARS OF AGE OR OLDER.
1. To Enter: Contest begins on February 15, 2010 and all on-line entries must be received by 7:30pm EST on
February 27, 2010. To enter, simply visit the 790thezone.com (the “Sponsor”) Web site at www.790thezone.com
(the "Site") and register as a member by completing all required fields on the Site registration form and following
the instructions on the page. By becoming a member you will be agreeing to receive e-mail from time to time from
790thezone.com. (You may opt-out of the receipt of e-mail, except e-mail concerning this Contest, by following the
instructions in the e-mail or on the Site). From time to time during the Contest Period, Sponsor may offer additional
activities that may allow you to earn entries. LIMIT ONE ENTRY PER EMAIL ADDRESS.
2. Entry Information: Entrants may not enter false e-mail addresses. Any entrant who attempts, directly or indirectly,
to enter false e-mail addresses or uses any device or artifice to enter false entries will be disqualified. In the event of
a dispute, on-line entries will be declared made by the authorized account holder of the e-mail address submitted at
the time of entry. Authorized account holder is defined as the natural person who is assigned to an e-mail address by
an Internet Access Provider, or Internet Service Provider or other organization (e.g., business, educational,
institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-
mail address.
3. To Win: Contestants must predict the winners of the top 5 finishers in the Shelby American NASCAR in Las
Vegas on February 28 2010. The contestant beating Mike Bell’s picks will be declared one of three (3) winners of
the Contest. In the event of a tie where there are multiple winners, all contestants who tie will be put into a random
drawing.
Drawing: On or about March 1, 2010 from all eligible entries received, a random drawing will be conducted by the
Sponsor, whose decisions concerning all matters related to this Contest are final. Winner will be notified by e-mail
and certified mail, return receipt requested. Odds of winning depend on the number of eligible entries received.
4. Prize: Two (2) tickets to the Kobalt Tools 500 race and an entry into the SCOTTS cornhole tournament.
5. Eligibility: Contest is open only to legal residents of the state of Georgia in the United States of America, 21 years
of age or older. Employees, and directors of Sponsor, their parents, affiliates (any company, whether incorporated or
not, in which an interest is owned, either directly or indirectly, by Sponsor, or any parent of Sponsor, hereinafter, an
"Affiliate") or subsidiaries, successors and assigns, advertising, promotion and fulfillment agencies, insurers, and
legal advisors, web masters and web suppliers, and the immediate family members (parents, spouse, siblings and
children wherever they reside) and persons living in the same household of such persons (whether or not related),
are not eligible. Void where otherwise prohibited by law.
6. Conduct: BY PARTICIPATING YOU AGREE TO THESE OFFICIAL RULES AND THE DECISIONS OF
SPONSOR, WHICH ARE FINAL AND BINDING IN ALL MATTERS RELATING TO THIS CONTEST.
Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds (a) to be tampering with the
entry process or the operation of this Contest or the Site; (b) to be in violation of the Terms of Service of the Site; (c)
to be acting in violation of these Official Rules; (d) to be hacking, or to be acting in a non-sportsmanlike or
disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; or (e) to have provided any
false or misleading information as part of the registration process including, without limitation, any false names,
addresses or e-mail addresses. ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO
DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS
CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT
BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO
THE FULLEST EXTENT PERMITTED BY LAW.
7. General: Sponsor will attempt to notify winner by e-mail, certified mail, or telephone for a period of seven (7)
days; and if winner cannot be contacted within such time period prize may be forfeited and an alternate winner
selected. No substitutions, transfer or assignment of prizes allowed, except by Sponsor, in its sole discretion. By
accepting prize winner grants to Sponsor the right to use his/her name, likeness, hometown, and biographical
information in advertising and promotion, in any and all media now known or hereafter invented, including on the
790thezone.com Web site, throughout the world, without further compensation or permission, except where
prohibited by law. Winners must also provide picture proof of identification to the Sponsor, which may include a
driver's license, passport, a voting card or similar government issued identification, as determined by Sponsor, in its
sole discretion. All taxes and any other expenses on the receipt and use of the prize are the sole responsibility of the
winner. Sponsor is not responsible for contacting any participant when participant has changed contact information
and failed to notify Sponsor of such change. Throughout the Contest Period, any failure to accept or receive e-mail
from Sponsor regarding the Contest will result in the automatic disqualification of the entrant from the Contest. BY
ACCEPTING PRIZE, WINNER(S) RELEASE AND AGREE TO HOLD HARMLESS SPONSOR, THEIR
PARENTS, SUBSIDIARIES, AFFILIATES, ADVERTISING AND PROMOTION AGENCIES AND ALL OF
THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS FROM:
(A) ANY AND ALL LIABILITY FOR ANY INJURY, LOSS OR DAMAGE OF ANY KIND (OTHER THAN
DEATH OR PERSONAL INJURY CAUSED BY THE NEGLIGENCE OF THE SPONSOR, OR ANY OTHER
PARTY INVOLVED IN THIS CONTEST); AND
(B) ANY AND ALL LIABILITY FOR ANY DEATH OR PERSONAL INJURY;
IN EACH CASE TO PERSONS ARISING DIRECTLY OR INDIRECTLY, FROM OR IN CONNECTION WITH
ACCEPTANCE, POSSESSION, USE OR MISUSE OF ANY PRIZE, PARTICIPATION IN THIS CONTEST OR
ANY GAME RELATED ACTIVITY. Some jurisdictions may not allow a person to restrict or exclude liability for
death or personal injury caused by such person’s negligence, so some of the above restrictions or exclusions may not
apply to you. Check your local laws for any restrictions or limitations regarding these limitations or exclusions.
Sponsor reserves the right to modify these Official Rules for clarification purposes without materially affecting the
terms and conditions of the Contest. Sponsor is not responsible for typographical or other errors in the offer or
administration of this Contest, including but not limited to errors in advertising, these Official Rules, the selection
and announcement of the winner or the distribution of the prize.
8. Limitations of Liability: Sponsor is not responsible for any incorrect or inaccurate information, whether caused by
users of the Site or by any of the equipment or programming associated with or utilized in this Contest or by any
technical or human error which may occur in the processing of submissions in this Contest. Sponsor is not
responsible for lost, late, incomplete, non-delivered, misdirected, illegible e-mails or mail. Sponsor assumes no
responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission,
communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not
responsible for any problems or technical malfunction of any telephone, network, satellite, cable or lines, computer,
on-line-systems, servers or providers, computer equipment, software, failure of e-mail or entry submissions on
account of technical problems or traffic congestion on the Internet or at any web site or combination thereof,
Sponsor is not responsible for injury or damage to participants' or to any other person's computer related to or
resulting from participating, downloading or uploading materials in this Contest. Any use of robotic, automatic,
micro, programmed or like entry methods will void all such entries by such methods, and disqualify any person
using such methods. If, for any reason, this Contest, in Sponsor’s sole opinion, is not capable of running as planned,
including, but not limited to, by reason of infection by computer virus, bugs, worms, tampering, unauthorized
intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which, in the Sponsor's sole
judgment, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Contest,
Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend this Contest and limit entries
to those submitted prior to the action taken, or proceed in such a manner as may be deemed fair and equitable by
Sponsor in its sole discretion.
IN NO EVENT WILL SPONSOR, , THEIR PARENTS, AFFILIATES, SUBSIDIARIES AND RELATED
COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS,
DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR
ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL,
CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE
SITE OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID
SITE, OR ANY OTHER WEB SITE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE SITE
IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED,
INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS

THE LIMITATIONS OR EXCLUSION OR LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL

9. Arbitration/Choice of Law: Except where prohibited, entrants agree that: (a) any and all disputes, claims, and
causes of action arising out of or connected with this Contest, or any prizes awarded, or the determination of winners
shall be resolved individually, without resort to any form of class action, and exclusively by arbitration pursuant to
the Rules of the American Arbitration Association, then effective; and (b) any and all claims, judgments and awards
shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Contest but in no
event attorneys' fees; and (c) under no circumstances will entrant be permitted to obtain awards for, and entrant
hereby waives, all rights to claim, punitive, incidental and consequential damages and any other damages, other than
for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All
issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules,
or the rights and obligations of entrant and Sponsor and in connection with this Contest, shall be governed by, and
construed in accordance with, the laws of the State of Georgia, U.S.A., without regard for conflicts of law doctrine,
and all proceedings shall take place in that State.
