OMARA, had been staying with Omara Jor the past month. Omal'a stated that the defendant's boyfriend had been ;:

, threatening him. The boyfriend was later identified as being Michael Pies. '



Officers spoke with a resident in the apartment building, Roxanne Huston. Huston told officers tha:t (hat she had ~,

, seen James Omara in the hallway at approximately 2:30 p,m. on October 28,2011. Omara appeared to be intoxicated.

On October 29, 2011, at approximately 9:00 a.m., Huston saw the defendant in the hallway of the apartmentbnilding. ~

The defendant was carrying a small Burger King bag and asked Huston for a butter knife. She told Huston that she was l

trying to bring breakfast to James Omara and she wanted to use the knife to break into the apartment. The defendant :,

: returned the knife to Huston a short time later and told her she could not get into the apartment but that she looked into ~

. the apartment through the window and could see James sleeping on the couch. The defendant then left the building. ~

;. When Detec~ive Falk ~as in the apartment building, he observed that the b~nds on the w~n~ow were closed an~ that ~

: It was not possIble to see mto the apartment. Officers also located a Burger King bag contammg a breakfast bumto on ~

r a table next to Omara's body. ~.

l Officers then attempted to locate the defendant and her boyfriend, Michael Pies. Officers learned from the Ashland, ~

::Wisconsin, police that they had contact with the defendant in a hotel in that city on November 1, 2011. Police were ~

~called by hotel staff because the defendant wanted to prepay for several nights lodging with cash. A vehicle registered!

~to the defendant, a 1996 GMC Jimmy, was observed by police in the hotel parking lot. I

Police investigation revealed that relatives of Michael Pies had reported him missing on November 1,2011. Family H

members'indicated that Pies received a phone call from an unknown person between 11 :00 a.m. and 1:00 p.m. on ~

October 29} 2011 and then he left. They had not heard from him since thattime. Officers asked Ashland police to check 1

,.the hotel room where the defendant had been staying to detemline if Michael Pies was with her. Ashland police checked f

;:the hotel room on November 2,2011, at approxim,ately 9:20 p.m., and found that Michael Pies was dead from an f

; apparent gWlshot wound to the head. There was a pillow over Pies' head when his body was found_ r



, Officers spoke with JO, the defendant's daughter, who informed officers that the defendant had spoken with JO's

. '. grandmother on November 1, 2011 and told her that "Mike is dead." The 1996 GMC Jimmy, registered to the

: defendant, was found abandoned by Sioux Falls police at approximately 9:40 p.m. on November 2, 2011.



The defendant was arrested by Sioux Falls, South Dakota, police at approximately 2 :30 a.m. on November 3, 2011. !,
