You, the lawyer, defending a fairy tale creature, (or perhaps prosecuting
them).
Righting a wrong, (or preventing the wrong from continuing).
Depending on the side you take, these are the fruits of your efforts.
Here is what you need to do:
Read synopsis of your “case” or read the version of the “Fairy Tale”
itself
The Opening Statement: A very important key to your success
in this case. The jury knows nothing; remember that. You need
to set the stage. That is telling a story. Incorporate info from
the general case info. Reinforce those facts with witness
statements from both sides. Show how you will prove one thing
and disprove another. Proper phrasing includes:
“Your honor, my name is ___, lawyer for the ______ in
this action”
“The evidence will indicate that _______”
“The facts will show________”
“Witness _______ will be called to show____”
“The defendant will testify that_______”
Direct/Cross Examination Questions (20): When questioning
your own witness, try to use the following general outline:
Call for answers based on info from the general case
Reveal facts favorable to your side
Ask your witness to tell a story
Keep the witness focused on what is important
Make sure the witnesses identifies themselves (“Please
state your name and occupation for the court”)
“Could you please tell the court_______”
“How long did you see/were you____”
Closing Arguments: This should summarize the case using
information that clarifies the position of your side as well as
anything that is favorable to your side of the case. It should
include things that actually happened during the case to remind the
Jury in case they forget. Be emotional, if necessary, and appealing.
o The prosecution should emphasize that the state has proven
guilt beyond a reasonable doubt while the defense should
raise questions, which suggest the continued existence of a
reasonable doubt.
All Opening Statements, Questions and Closing Statements MUST BE
