There are US and State laws that make "mis−representing" an item for
sale, illegal.
There are laws like that in very many countries.
It is amazing what can be *NOT* (implied?) said and NOT be illegal.
It is also amazing what can be said and /still/ be legal.
If a (OEM) product is properly sold under license terms and a buyer
orders it for a different purpose, the buyer is at fault.
If a seller sells a "branded" OEM version with out disclosing that it
is branded (let alone not selling it with the linked equipment), that
would be fraud.
You are correct. That is truly amazing.
To the OP:
REPUTATION of the seller and knowledge of *what* you are purchasing
are key here.
If the OP purchases a genuine XP version, it doesn't matter in the slightest
from where or from whom it was purchased.
