      MINUTES OF PUBLIC HEARING – AGED/DISABILITY TAX EXEMPTION &
  MINUTES OF REGULAR BOARD OF EDUCATION MEETING – NOVEMBER 24, 2009
                              PUBLIC HEARING
        INCOME ELIGIBILITY - AGED & DISABILITY SCHOOL TAX EXEMPTION

A public hearing was held in the K-2 Library at the Mill Road
Elementary School for the purpose of changing the income eligibility
requirements for persons age 65 and over to quality for school property tax
exemption. and homeowners who qualify for a school property tax exemption
as a result of a disability.

The hearing was called to order by Board President McLaughlin at
7:00 p.m. followed by the Pledge to the Flag.

Board members present: S. McLaughlin, F. Knobloch, J. Moore
K. Mosher, D. Brooks, and A. Crittenden, Student BOE Member

Administration present:
P. Finch, Superintendent
B. Martin, Business Administrator
E. Hayes, High School Co-Principal
B. Boyd, Intermediate Principal

There were 3 visitors and 1 member of the press present.

Bruce Martin, Business Administrator explained the current exemption         EXPLAIN
level and the exemption levels set forth in the townships and school         HRNG
districts of Dutchess and Columbia Counties and explained the $29,000        TOPIC
ceiling and the optional sliding scale available for exemptions. Mr. Martin
explained that this exemption is granted only on the portion of property
that is used for residential purposes. This includes residential dwelling and
one acre. Additional acreage and other buildings are not eligible for aged
exemption or disability exemption. Mr. Martin also explained that if any
child (ren) resides on the property for which an exemption is sought and
attends any public school grades K-12, no exemption from school taxes
 may be granted.

Board President McLaughlin explained the ground rules for public          GROUND
testimony at this hearing. An invitation to ask questions or make         RULES
statements was extended. Visitors were advised to contact the
Town Assessor’s Office to obtain the appropriate paper work to file for
the tax exemption currently in place.

President McLaughlin asked if there were any additional questions or speakers.
There were none/

Motion by K. Mosher, seconded by J. Moore to approve the                     AUTHORIZE
following resolution regarding the aged tax exemptions                       AGED TAX
                                                                             EXEMPTION
WHEREBY, there has been an amendment to the Real Property Tax Law
(“RPTL”) 467with regard to exemptions in taxes for persons 65 years of
age or over; and

WHEREAS, the Board of Education desires to amend its current school tax
exemption for persons 65 years of as or over to comply with the provisions of
RPTL 467,

THEREFORE, BE IT RESOLVED that the Red Hook Central School District, of Board
Education hereby adopts the following tax exemptions for persons 65 years of age or
older in accordance with the provisions of RPTL 467,

As of March 1, 2010, Taxable Status Date, the income ceiling or maximum base
income eligibility level pursuant to RPTL 467 shall be $29,000 to qualify for a 50% tax
exemption on real property owned by persons 65 years of age or older.

Effective March 1, 2010, the following sliding scale for the school tax exemption for
persons 65 years of age or older shall replace the sliding scale currently in effect:

$35,600.00 to $36,499.99               10%
$36,500.00 to $37,399.99               5%
was carried. VOTE: 5-yes, 0-no

Motion by F. Knobloch, seconded by D. Brooks to approve the
following resolution regarding the disability exemption                      APPROVE

                                                                             EXEMPT.
WHEREAS, the Board of Education desires to change the exemption policy
regarding persons with disabilities in accordance with the provisions of

Real Property Tax Law 459-c

THEREFORE, BE IT RESOLVED that the Red Hook Central School District,
Board of Education hereby adopts the following tax exemptions for persons
with disabilities as defined by RPLT #459-c.

As of March 1, 2010, Taxable Status Date, the income ceiling or
maximum base income eligibility level pursuant to RPTL 459-c shall be
$29,000 to qualify for a 50% tax exemption on real property owned by
persons with disabilities.

Effective March, 1, 2010, the following sliding scale for the school tax exemption for
persons with disabilities shall be put in place:

Motion by J. Moore, seconded by D. Brook that pursuant to
the recommendation of the Superintendent of Schools, that                    AWARD TENURE

tenure in the area of Physical Education effective
November 26, 2009 was carried. VOTE: 5-yes, 0-no

President McLaughlin welcomed the visitors and invited them to ask
questions or make statements. There were none at this time.

ISSUES FOR DISCUSSION/COMMENT – AUSTIN CRITTENDEN
Nothing to report. Questioned by President McLaughlin regarding
habitat project possibly being closer to home. Austin indicated
that Palm Beach was contacted, but can look locally as well.
