JUDGMENT
Based on the attached affidavit entitled “Certificate of Dishonor” Affidavit in Support of Private Judgment and decision RE: Private Contract # JSD-0505-VO, the Lawful Notarial Protest, and the evidence attached to said affidavit, all o which has been presented to this panel, IT IS THE JUDGMENT AND DECISION OF THIS PANEL that: 1. Petitioner is a Secured Party/Creditor over the property of JANE SEYMOUR DONE; 2. 2On three occasions Petitioner properly noticed Respondent, in his private capacity and in his capacity as an agent for Visa One, of Private Contract JSD0505-VO and Respondent’s corresponding duty to respond, and that she properly commenced, continued, and concluded said Private Contract; 3. Respondent failed to answer or otherwise respond, and therefore stands in agreement with Petitioner; 4. Maxims of law in support of Petitioner’s request to this panel are: a. An unrebutted affidavit is a judgment in commerce. b. In commerce, truth is sovereign. c. Truth is expressed in the form of an affidavit. d. A lien or claim can be satisfied only through rebuttal by counter-affidavit point-for-point, resolution by jury, or payment. e. The proof lies on him who affirms, not on him who denies. f. The agreement of the parties makes the law of contract. g. A man’s word is his bond. h. For truth to be established, it must be expressed. i. j. l. Silence is agreement. He who leaves the battlefield first loses by default. An accessory follows the nature of his principal.

k. When a party has a duty to speak, his silence equates with fraud. m. A contract founded on a base or unlawful consideration, or against good morals, is null
n. Sacrifice is the measure of credibility. One who has not been damaged

by, given to, lost on account of, or put at risk by another has no basis to make claims or charges against him.

DECISION
THEREFORE, IT IS THE DECISION OF THIS PANEL that the parties have reached the following agreement:
A. That there is no documentation verifying that: 1) There is an outstanding balance on the RESPONDENT account; 2) RESPONDENT has a registered claim against Names and has produced a certified copy of the financing statement to Names; 3) DOE’s Bill of Exchange dated ___________ did something other than discharge the debt; 4) Information RESPONDENT provided to the Credit Reporting Agencies was completely correct and accurate in compliance with the principles expressed in the Fair Debt Collections Practices Act (hereinafter referred to as FDCPA); 5) Every contact, whether written or telephonic, by RESPONDENT or its Agents, is in compliance with the principles of the FDCPA; 6) An attempt to collect upon a purported debt without providing proof of claim when demanded by Names is in compliance with the STATE Statutes and constitutes a valid ‘claim’; 7) There is an outstanding balance on the RESPONDENT account; 8) RESPONDENT has a registered claim against Names and has produced a certified copy of the financing statement to Names; 9) DOE’s Bill of Exchange dated ___________ did something other than discharge the debt; 10) Information RESPONDENT provided to the Credit Reporting Agencies was completely correct and accurate in compliance with the principles expressed in the Fair Debt Collections Practices Act (hereinafter referred to as FDCPA); 11) Every contact, whether written or telephonic, by RESPONDENT or its Agents, is in compliance with the principles of the FDCPA; 12) An attempt to collect upon a purported debt without providing proof of claim when demanded by Names is in compliance with the STATE Statutes and constitutes a valid ‘claim’; B. That RESPONDENT has agreed to pay Names: 13) One Thousand Dollars ($1,000.00) for each communication RESPONDENT or its Agents cause to be made to Names, whether telephonically or in writing, which is not in affidavit form, regarding their unsubstantiated claim; and, 14) Three times the value of any property, the enjoyment and use of which by Names, that is taken by RESPONDENT or its agents without a proof of claim; and 15) Five Thousand Dollars ($5,000.00) for each transaction initiated by Names, where Names ‘ commercial ability is impeded due to RESPONDENT’s agents’ actions, adverse reporting or nonwithdrawal of summons and lawsuit; 16) One Thousand Dollars ($1,000.00) if notarial protest is initiated by Names; C. That RESPONDENT has further voluntarily authorized Names: 17) to record a UCC-1 on both his/her person and RESPONDENT as a debtor to secure the debt owed Names;

18) volunteers to prove his claim as a RESPONDENT in possession of Names property in a bankruptcy Chapter 11 proceeding process; D. The matter is resolved. Decision dated this ___ day of ____________, Two Thousand Three.
