Dear Mr. Martin: I am in receipt on your communication dated April 10, 2003 which is attached herewith. Formal notice is hereby served upon you personally, ELAN FINANCIAL SERVICES and US BANK that the above-listed account, in its entirety, has been fully discharged, ab initio, by agreement of the parties and as further evidenced by Notarial Process, in accordance with State and Federal law, including the Fair Debt Collections Practice Act. Under the aforementioned agreement, your communication to CAROL ENGEN, which is subsequent to the issuance of the Certificate of Dishonor, results in an additional $1000.00 (One thousand dollars and zero cents) charge to US Bank for attempting to collect on a nonexistent debt. This is timely written Notice and Demand that you are to IMMEDIATELY CEASE and DESIST from: 1. 2. 3. any collection activities on said discharged account; any further contact, in any form, for the purpose of collection, with me or CAROL ENGEN; any reporting to any credit reporting agency concerning said account, save and except to correct your report to reflect the full amicable discharge of the account.

Your continued violations which impede CAROL ENGEN’s commercial ability and subsequent harassment may subject you to substantial civil damages in addition to statutory fines and penalties. This Notice will serve as proof that you were fully informed of said violations and harassment and that you voluntarily, willfully and knowingly, chose to continue to commit said crime(s) against me and CAROL ENGEN.
