RE:    Short Term Activity Authorization- Twin Grove to Wooly Hollow Collector pipeline
       crossing multiple streams in Faulkner County


Dear Mr. Hansen:

The Arkansas Department of Environmental Quality (“ADEQ”) has completed its review of
Frontier Gas Service’s above referenced request for a short term activity authorization to trench
Soda Creek once, two unnamed tributaries to Soda Creek at three locations, Mill Creek once, one
unnamed tributary to Mill Creek at one location, Black Fork Creek once, and seven unnamed
tributaries to Black Fork Creek each once, for the installation of a natural gas pipeline referred
to as Twin Grove to Wooly Hollow Collector pipeline, as part of the Fayetteville Shale Gas
Exploration Project. The project begins in S 7, T 7 N, R 12 W, and terminates approximately
3.25 miles west in S 3, T 7 N, R 13 W, Faulkner County, Arkansas.

ADEQ hereby grants you a one time short term activity authorization for the stream crossing
activities involved in the installation of collection lines as identified in the submitted to ADEQ,
subject to the following conditions:

       1. The contractor shall limit the construction activity to low flow conditions as much as
          possible.
       2. The contractor shall take all reasonable measures to limit equipment and machine
          usage in the wetted area of all streams.
       3. The contractor shall utilize best management practices (BMPs) such as those
          developed by the Federal Energy Regulatory Commission (FERC), the U.S. Fish and
          Wildlife Service (Service) or equivalent BMPs to minimize the impacts of
          sedimentation and turbidity in the streams impacted by this project. The contractor’s
          activities shall not cause violations of any other water quality standards, pursuant to
          the Arkansas Pollution Control and Ecology Commission’s Regulation No.2.
       4. The contractor shall take all reasonable measures to prevent the spillage or leakage of
          any chemicals, oil, grease, gasoline, diesel, or other fuels adjacent to or into the
          wetted area of any water body. If any such spillage or leakage occurs, the contractor
          shall notify ADEQ immediately and take immediate steps to contain and remediate
          the material released into the environment.
       5. The contractor shall contact Steven Johnson, ADEQ Inspector Supervisor, either by
          phone 501-682-2746, or by email johnsons@adeq.state.ar.us, at least 24 hours prior
          to the initiation of each stream crossing that has the potential to cause a water quality
          turbidity violation (a wetted stream crossing).
       6. This short term activity authorization is being issued pursuant to the Arkansas
          Pollution Control and Ecology Commission’s Regulation # 2, Section 2.305(E). This
          short term activity authorization is granted for a period of 24 hours for each minor
          water body crossing (all water bodies less than or equal to 10 feet wide), 48 hours for
          each intermediate water body crossing (all water bodies greater than 10 feet wide but
          less than or equal to 100 feet wide) and 96 hours for each major water body crossing
          (all water bodies greater that 100 feet wide). The contractor shall notify ADEQ by
          email; hooks@adeq.state.ar.us, if a crossing cannot be completed within the allotted
          time frame. The contractor shall document the date and duration of each water body
          crossing and the specific BMPs utilized to minimize impacts to the water quality of
          the water body. This information shall be keep for a period of 6 months after
          completion of the water body crossing and this information shall be made available to
          the Director upon request.
       7. No construction activity is authorized in any stream designated as Extraordinary
          Resource Waters, Natural and Scenic Waterways, or Ecologically Sensitive
          Waterbodies.
       8. The contractor shall cease construction activity immediately if the ADEQ Director
          rescinds or revokes this short term activity authorization in writing.

 In issuing this authorization, ADEQ does not assume any liability for the following:
        A. Damages to the proposed project, or uses thereof, as a result of other permitted or
           unpermitted activities or from natural causes.
        B. Damages to persons, property, or to other permitted or unpermitted activities or
           structures caused by this authorization.
        C. Design or construction deficiencies associated with this proposed project.

COMMENTS: Mr. Reid Hansen has requested a short term activity authorization in order to
construct a natural gas pipeline crossing Soda Creek once, two unnamed tributaries to Soda
Creek at three locations, Mill Creek once, one unnamed tributary to Mill Creek at one location,
Black Fork Creek once, and seven unnamed tributaries to Black Fork Creek each once, for the
installation of a natural gas pipeline referred to as Twin Grove to Wooly Hollow Collector
pipeline, as part of the Fayetteville Shale Gas Exploration Project. The project begins in S 7, T 7
N, R 12 W, and terminates approximately 3.25 miles west in S 3, T 7 N, R 13 W, Faulkner
County, Arkansas. The required $200 fee has been submitted for this project.
