11   TO PROPOSE AN AMENDMENT TO SECTION 9, ARTICLE
12   III OF THE CONSTITUTION OF SOUTH CAROLINA, 1895,
13   RELATING TO SESSIONS OF THE GENERAL ASSEMBLY,
14   TO PROVIDE FOR THE BIENNIAL SESSION OF THE
15   GENERAL ASSEMBLY, TO PROVIDE FOR A SINE DIE
16   ADJOURNMENT DATE, TO PROVIDE THE MEANS AND
17   THE LIMIT TO WHICH THE SINE DIE ADJOURNMENT
18   DATE MAY BE EXTENDED, AND TO PROVIDE FOR THE
19   CONVENING OF THE FIRST BIENNIAL SESSION.

21   Be it enacted by the General Assembly of the State of South
22   Carolina:

24   SECTION 1. It is proposed that Section 9, Article III of the
25   Constitution of this State be amended to read:
26
27      “Section 9. The annual biennial session of the General
28   Assembly shall convene at the State Capitol Building in the City of
29   Columbia on the second Tuesday of January of each every other
30   year. After the convening of the General Assembly, nothing in this
31   section shall prohibit the Senate or the House of Representatives,
32   or both, from receding for a time period not to exceed thirty
33   consecutive calendar days at a time by a majority vote of the
34   members of the body of the General Assembly seeking to recede
35   for a time period not to exceed thirty consecutive calendar days, or
36   from receding for a time period of more than thirty consecutive
37   calendar days at a time by a two-thirds vote of the members of the
38   body of the General Assembly seeking to recede for more than
39   thirty consecutive calendar days at a time. Each body shall sit in
40   session at the State Capitol Building in the City of Columbia and
41   may provide for meetings during the legislative session as it shall
42   consider appropriate. Furthermore, the Senate or the House of

 1   Representatives, or both, may meet on the first Tuesday following
 2   the certification of the election of its members for not more than
 3   three days following the general election in even-numbered years
 4   for the purpose of organizing. The biennial session of the General
 5   Assembly must be adjourned sine die no later than the first
 6   Thursday in June following the convening of the session unless
 7   extended by a concurrent resolution adopted by a vote of
 8   two-thirds of the membership of each house. The sine die
 9   adjournment date for each biennial session shall not be extended
10   beyond December thirty-first of the year in which it is convened.
11   If the casualties of war or contagious disease render it unsafe to
12   meet at the seat of government, the Governor, by proclamation,
13   may appoint a more secure and convenient place of meeting.
14   Members of the General Assembly shall not receive any
15   compensation for more than forty days of any one session. The
16   first biennial session convened pursuant to this section shall be on
17   the second Tuesday in January 2013.”

19   SECTION 2. The proposed amendment in Section 1 must be
20   submitted to the qualified electors at the next general election for
21   representatives. Ballots must be provided at the various voting
22   precincts with following words:

24      “Must Section 9, Article III of the South Carolina Constitution,
25   relating to sessions of the General Assembly be amended to
26   provide that the General Assembly shall meet every two years
27   rather than every year, to provide that the biennial session of the
28   General Assembly must adjourn by the first Thursday in June in
29   the year in which it is convened unless extended by a two-thirds
30   vote of the membership of the House and Senate, to provide that
31   the biennial session must not be extended past December
32   thirty-first of the year in which it is convened, and to provide that
33   the first biennial session shall convene on the first Tuesday in
34   January 2013?

39   Those voting in favor of the question shall deposit a ballot with a
40   check or cross mark in the square after the word „Yes‟, and those
41   voting against the question shall deposit a ballot with a check or
42   cross mark in the square after the word, „No‟.”
