EMPANELMENT OF ADVERTISING AGENCIES

FOR THE FINANCIAL YEARS 2011-12 & 2012-13



Bank of India invites Sealed Expression of Interest (EOI) from the interested

Advertising Agencies for the Corporate Communications requirement of the

Bank at Head Office, Mumbai through Creative Art Works & Comprehensive

Advertisement (Strategy and Execution) in various media (Print , Electronic,

Outdoor etc.) for the financial year 2011-12 & 2012-13 as per the following

schedule.

Technical Evaluation



The date for the presentation for final empanelment shall be communicated

separately to the technically evaluated short listed Advertising Agencies. It may

please be noted that only technically eligible short listed advertising agencies

shall be requested for the presentation before the committee of bank formed for

the purpose. Meantime servicing of the bank through existing agencies may

continue.



PRE-QUALIFICATION CRITERIA AND TERMS & CONDITIONS FOR THE EMPANELMENT

OF ADVERTISING AGENCIES



1. It is specifically clarified that at present the applications are invited only for

the purpose of drawing up a panel of advertising agencies for the National

requirement of the Bank at Mumbai.



2. The award of the work will be at the sole discretion of the Bank irrespective

of the Empanelment of the Advertising Agencies at National and Regional

Level. It is further clarified that the empanelment of any agency does not

tantamount to an assurance by the Bank for the purpose of awarding any

services / release of the advertisement.



3. The agency should have full –fledged office, having independent media &

creative facilities to plan & execute campaigns. The agency should have

all basic communication facilities like, telephone, fax, e- mail etc. at their

respective place of functioning. The agency should have full fledged

office at Mumbai.

4. The agency should have a good creative team consisting of the following-

(a) Creative Director (b) Art Director (c) Visualiser (d) Illustrator (e) Artists

with Experience (f) Experienced Copy Writers with multi language

proficiency (g) A team to do creative as well as marketing research, if

required (h) Talented Team for essential client servicing. All the applications

for empanelment should be supported by the requisite documents as

mentioned in the criteria above.



5. The agency should have preferably uninterrupted full accreditation with

the Indian Newspapers Society (INS), for a minimum period of 5 years as on

March, 2011. Agency must also preferably be accredited / approved with

DoorDarshan and All India Radio as on March, 2011. Membership of the

advertising agency with Advertising Standard council of India and Audit

Bureau of Circulation (ABC) shall also be preferable.



6. Preference will be given to the agencies who are empanelled with Public /

Private Sector Bank/s for a period of 5 years. Certificate from the

concerned Bank to be attached, for having completed the job

satisfactorily.



7. For empanelment of advertisement agencies at National Level it is

proposed that the agency should have a minimum billing of ` 5 crores per

year, for the last three consecutive years (2008-09, 2009-10, 2010-11)as per

the audited Balance Sheet.



8. For empanelment of advertisement agencies it is proposed that the

agency should preferably have a continuous net profit for the last three

consecutive years (2008-09, 2009-10, 2010-11)as per the audited Balance

Sheet.



9. For empanelment as an Advertising Agency of the Bank, the agency

should submit proven established credentials for Corporate Brand Building

and Products & Services.





10. The Bank reserves right to reject any application for empanelment without

assigning any reason whatsoever. Similarly, even after empanelment the

Bank reserves the right to remove the name/ names of the agencies from

the panel without assigning any reason.



11. Bank of India reserves the right to remove any agency from their

empanelled list, by giving a notice of one month at Bank’s discretion

without assigning any reason.



12. The Agreement can be terminated by either party without assigning any

reasons, by giving a written notice of 30 days to the other at its address.

13. The approval of creative work submitted by the empanelled advertising

agencies for the Bank would be the sole- discretion of the Bank. The Bank

reserves the right to accept or reject any creative art work at its sole

discretion. The artwork of advertisement shall be prepared by the

empanelled advertising agency at their own cost and no special/extra

charges will be paid to the agency for their unapproved artwork.



14. Artwork/Commercial once selected will be the property of the bank and it

can be repeatedly used in different media like print, outdoor, electronic etc.

without seeking permission from concerned advertising agencies or paying

any commission. Agency has to provide original soft copy of open file to the

bank. The agency can’t use the concept, artwork, picture, film and jingle

for other clients once the bank selects it. Bank reserves the right to make

necessary modification to the selected artwork, concept, film etc.



15. For selection of artwork for print media or for preparation of TV commercial

bank will invite concept from all/or selected empanelled agencies and

release order will be given through the media buying agency whose

design/concept is approved. The selection of the media will be the sole

discretion of the Bank.



16. Conditional application for empanelment are liable to be rejected.



17. The bank will not make any advance payment. However, the selected

agency shall be paid at reasonably competitive rates negotiated and

agreed upon by both Bank of India and the Agency. All applicable taxes

including Income Tax etc. will be deducted at source (TDS) from the final

bills as required under Income Tax Act.



18. No other charges shall be payable for releases of advertisements except

for the commission as applicable, for which duly certified copies of the

media bill/s should be submitted by the empanelled advertising agency/

media buying agency along with their bill.



19. If the creative sent to media is not found to be of good quality then the

Bank will have the right to make suitable deductions from the payable

amount or reject the media payment bill to the agency on its sole

discretion. The decision of the Bank in this regard will be final.



20. The Earnest Money Deposit (EMD) for the application related to

Empanelment of advertising agencies shall be ` 200000/- (Rupees Two lac

only) payable by Demand Draft or Pay Order favoring “Bank of India”

payable at Mumbai is to be submitted along with the application Form and

is refundable only on the non- acceptance of the offer. Application

submitted without EMD will not be entertained.

21. Tender Form will be available with Asstt. General Manager, Publicity & PR

Department, Bank of India, Head Office, 2nd Floor, C-5, G Block, Star House,

Bandra Kurla Complex, Bandra (East), Mumbai- 400 051 on payment of fee

of ` 10000/- (non -refundable) payable by Pay Order or Demand Draft

favouring “Bank of India” payable at Mumbai. Tender Form will also be

available on Bank’s website (www.bankofindia.co.in) which can be

downloaded and to be submitted along with form charges of ` 10000/-

(non refundable) by way of Pay Order / Demand Draft favouring Bank of

India, Mumbai.



22. The Bank will reject the incomplete applications.



23. The applicant must submit their application in sealed cover addressed to

the Asstt. General Manager, Publicity & PR Department, Bank of India, Head

Office, 2nd floor, C-5, G Block, Star House, Bandra Kurla Complex, Bandra

(East), Mumbai – 400 051 superscribed as :



“APPLICATION FOR EMPANELMENT OF ADVERTISING AGENCIES FOR THE

FINANCIAL YEARS 2011-12 & 2012-13’’ SEPARATELY (see Annexure 1) and

shall contain the following information:



(a) Bio-data in the enclosed format, along with audited financial

statements of March 2009, March 2010 and March 2011.



(b) It should be duly signed by authorized persons with date and seal

of the firm/ company.



(c) Account Payee Demand Draft or Pay Order of `2,00,000/- (Rupees

Two lac only) for application for Empanelment of Advertising

agencies favouring “ Bank of India”, payable at Mumbai towards

the Earnest Money Deposit (EMD).



(d) If tender form is downloaded from website, form charges of

` 10,000/- (non refundable) to be paid by DD/PO while submitting

the application form.



22. Short-listing of application will be done on the basis of following criteria :



(A) The agency should have full –fledged office, having independent

media & creative Facilities to plan & execute campaigns. The agency

should have all basic communication facilities like, telephone, fax, e- mail

etc. at their respective place of functioning. The agency should have full

fledged office at Mumbai.



(B) The agency should have a good creative team as specified in

qualification criterion.

(C) The agency should have preferably uninterrupted full accreditation

with the Indian Newspapers Society (INS), for a minimum period of 5

years as on March, 2011. Agency must have preferably accredited /

approved with DoorDarshan and All India Radio as on March, 2011.

Membership of the advertising agency with Advertising Standard council

(I) For empanelment as an Advertising Agency of the Bank, the agency

should submit proven established credentials for Corporate Brand Building

and Products & Services.



(23) The applicants short-listed as per the above criteria will be informed by mail/

courier about the date, time and place for the presentation before a

Committee of the Bank formed for the purpose.



(24) Pre Bid meeting on 21.11.2011 at 3 p.m., Last date of submission of

application form up to 1 p.m. on 28.11.2011 to Asstt. General Manager,

Publicity & PR Department, Bank of India, Head Office, 2nd floor, C-5, G

Block, Star House, Bandra Kurla Complex, Bandra (East), Mumbai – 400 051

and opening of Expression of Interest (EOI) and Technical Evaluation shall

be carried out by a sub committee on 29/11/2011 at 3 p.m.

(25) Taxes and Duties : The Agencies shall fully familiarize themselves about the

applicable Domestic Taxes (such as VAT, Service Tax, Income Tax, duties,

fees, levies etc. ) on amount payable by Department of Information

Technology under the contract. The Agencies, sub Agencies and

personnel shall pay such domestic tax, duties, fees and other impositions

(wherever applicable) levied under the applicable law.



(26) Bank of India reserves the rights to amend, modify, add or delete, accept or

reject in part or full any conditions mentioned as above without assigning

any reason thereof. The decision of the Bank will be final.



(27) Any dispute arising will be subject to the jurisdiction of the courts at Mumbai.



Scope of work for the Advertising Agency :

a) Preparation of Artwork for different advertisement campaigns as well as

Brochures, posters or any other art material.

b) Suggestions/preparation of plans for different advertising campaigns from

time to time.

c) Preparation of TVC and Radio Jingle/Song, etc. for the Bank.

d) Artwork for Hoardings, Banners, posters, designs of all other outdoor media

advertisement.

e) Artwork for leaflets, magazines and souvenirs etc.

f) Organizing events ATL/BTL for the bank whenever required.

g) Any other work related to Publicity and Corporate Communications of the

Bank.



Documents to be submitted :

a) Document in support of accreditation with INS, Prasar Bharati and AIR &

DD.

b) Document in support of Empanelment with banks/PSUs/Financial

Institutions/Corporate Houses etc.

c) Brief Profile of the Agency consisting of : 1) Constitution – Ltd.

Company/Pvt. Ltd., Partnership, Proprietorship. Ii) Address of Head Office

and Branch Offices all over India. iii) Total number of employees working

with the company all over India and total employees, creative persons in

Head Office at Mumbai/Branch office, if any.

d) List of reputed organizations for which agency has worked earlier

(Certificate/Testimonials to be enclosed).

e) Credentials (Presentation regarding publicity campaigns carried in

Electronic & Print Media for any reputed organization).

f) Copies of audited balance sheet for last three years i.e. 2008-09, 2009-10

and 2010-11 supported by IT returns and turnover certificate by Chartered

Accountant.

g) Copy of Pan Card and Service Tax registration certificate

h) Copy of Registration/Trade Certificate

i) Solvency certificate from the Banker of the Advertising Agency

j) EMD – DD / Pay Order for `. 2,00,000.00
