procurement of 10.5 lakh lines of WLL-CDMA 2000 1X equipment (Package-I)
and 10.5 lakh WLL-CDMA 2000 1X integrated FWTs (Package-II).

Dear Sirs,

       Please refer the above mentioned subject tender. Kindly find enclosed
herewith clarifications to the technical and commercial queries raised by some of
the prospective bidders. The clarifications to the queries are as per Annexures
attached.

Section-II:                                                        ANNEXURE-1
Query No. 1(a): Clause-2(a) :
The eligible bidders should be Indian companies registered to manufacture…….
having Memorandum of Understanding (MOU) with the manufacturer for
maintenance support of the equipment during the life span……
Pl clarify that what is period of life span
Clarification: Life span may be taken as 07years from the date of commissioning.

Query No.1(b): Clause 2(a) :- The bidder or his collaborator who have got
experience to supply minimum 3 lakh lines of WLL CDMA 2000 1x equipment
comprising of equipment like MSCs, BSCs, BTS and packet core network etc. in
the world and working satisfactorily for the last one year prior to the date of
opening of tender are only eligible to participate in this tender.
Kindly make it clear that 3 lakh is the total number of all WLL CDMA 20001X
equipments or it means number of each equipment such as BSC,MSC,BTS,PCN
separately.
Clarification: Clause is clear needs no further clarification.

Query No. 2: Clause-9.1 : …….Prices of incidental services should also be
quoted. The offer shall be firm in Indian rupees. No foreign exchange will be
made available by the purchaser.
        Pl. clarify that what are the components of incidental services. It is not
included in Sec-VII.
Clarification: Prices are to be quoted as per Schedule of requirement given in
Section-V ,Package-I and Package-II.
Query No. 3: Clause-14&15:
        Format and signing:
        As the bidders are allowed to bid for package-I or package –II or both
separately, is it necessary to mention the name of the package on each of the
bids.
Clarification: Yes please. Please refer amendment issued vide letter No. 11-
14/2004-MMT(SW) Dated 15.09.2004
Query No. 4: Clause-16.3:
        However not more than one independent and complete offer shall be
permitted from the bidder.
        If a bidder bids separately for package I and package II , will he be rejected
as per the provision of this clause?
Clarification: Please refer reply at query No.-4.
Section-III:
Query No. 5: Clause-5.5 : When the performance tests…”Taking over certificate”
It is assumed performance test is same as per section IV/88. Pl clarify.
Clarification: Clause -88 of Section-IV deals with Acceptance testing which is
one of the clauses of Performance of Contract.
Query No. 6: Clause-9.1(b) (i) : In the event of termination of production of spare
parts ……
       Advance notification not less than two years is a too long time.
Upgradation takes place much faster. It may be for six month.
Clarification: Request is regretted please.
Section-IV:
Query No. 7: Clause-6(i):         Placement of orders:
       If only two bidders participate in the tender for package-I with two different
technologies, will the 100% order be placed on the L-1 bidder?
Clarification: L-1 will be considered for 70% of the order only.

Query No. 8(a) : Clause-12.1.1 &12.1.2 : The bidder who are issued purchase
orders for commercial supplies shall have to get their WLL equipment types
approved /validated from TEC.or a team nominated by BSNL. The WLL
equipment for type approval / validation shall be supplied within a period of two
months…..
       Supply of validation eqpt. may be considered two months from the date of
P.O. instead of A. P.O. And completion of validation within 5 months from the
date of P.O. Total supply of eqpt. may be considered 08 months from the date of
P.O.
Clarification: Request is regretted please.

Query No. 8(b) : In case of successful validation of equipments, these
equipments will form part of the main supplies. Pl clarify.
Clarification: Yes please.

Query No. 9(a): Clause-13.1:
       (i)    50% on supply of equipment.
       (ii)   30% on successful Type approval…..
       (iii)  20% after one year…..

       (i)    This may be considered for 80% on supply of all equipments.
       (ii)   This may be considered for 10% on commissioning & AT
       (iii)  This may be considered for 10% after one year and signing of AMC.
Clarification: Request is regretted please.

Query No. 9(b): Clause 13 :- Payment terms : The payment shall be made in
Indian Rupees only. The mode of payment against Package-I and Package-II
shall be as follows :
Package-II
Query No.9(c) Clause 13.4 :- For the cost of equipment ordered in the purchase
order :
   i)        80% on supply of all equipment at site in satisfactory condition.
                 Please confirm “Supply of equipment at site” means supply of FWTs
        in lot at one nodal location in each circle.
   ii)       20% after one year of supply subject to satisfactory performance and
             signing of AMC agreement along with submission of performance bank
             guarantee.
                 Can this 20% be paid immediately after acceptance against bank
        guarantee ?
Clarification: Request is regretted please.

Query No. 10: Clause-13.3:
     Payment for AMC:
       This may be considered for six months basis in advance, as vendor is to
invest huge amount for infrastructure, spares and man-power etc. In addition
vendor is also giving 5% PBG.
Clarification: Request is regretted please.


Query No. 11: Clause-89 :
        Delivery period:
        The total delivery period for package-I is eight months from the date of
Purchase Order. We presume that two months additional period after the
completion of total delivery will be given for installation & commissioning for BSNL
sites as per clause 58 of section IV . We also presume that the same is
applicable for non-BSNL sites.
Clarification: Both Clauses 58 and 89 of Section-IV are clear needs no further
clarification.

Query No. 12(a): Clause 90:- The warranty of the Stores/Equipment supplied
shall be 12 months from the date of commissioning after successful acceptance
testing of the CDMA equipment under package-I and 12 months from the date of
supply and receipt at site of last batch of IFWTs in each Circle in good condition
under Package-II. The proof of receipt of last batch in a Circle shall be provided to
the Circle concerned and SW and NM (WLL) branches of BSNL Corporate Office.
       Since the delivery is distributed to 6 months it is not justified to warrant the
material already supplied and may be in use for six month to warrant for. Pls
modify this clause to 12 months warranty for each lot from the date of last date of
receipt of the lot.
Clarification: Request is regretted please.

Query No.12(b): Clause 90 :- The warranty of the Stores/Equipment supplied
shall be 12 months from the date of commissioning after successful acceptance
testing of the CDMA equipment under package-I and 12 months from the date of
supply and receipt at site of last batch of IFWTs in each Circle in good condition
under Package-II.
       Our understanding is 12 months including warranty and commissioning
otherwise commissioning must have a definite time.
Clarification: warranty under Package-II will be 12 months from date of supply
and receipt of last batch of IFWTs in each circle in good condition.

Query No. 13: Clause 91.9 :-The bidder shall submit a performance bank
guarantee in each Circle equivalent to 2% of the cost of equipment as per P.O. or
the first year AMC charge pertaining to that Circle which ever is higher in a
prescribed performa. The PBG shall be submitted at least two months in advance
of date of start of AMC. The PBG shall be valid for a period of six years. The PBG
shall be extendable for a further period as required if there is a delay in start of
AMC for any reason for the whole MSC-BSC package or one of the BSC packages
under the same MSC. For the additional/expansion equipment, the amount of
PBG shall be increased at the same rate as indicated above, within a time period
of one month of the date of such equipment getting covered under AMC.
Pls confirm that this is applicable to Package-I only.
Clarification: For performance bank guarantee for AMC of Package-II will be as
per Clause-12.2 of Annexure-II to Section-IV.

Query No. 14: Clause 83 :- BSNL ….. for undertaking the repairs of FWTs. The
selected bidders shall also give the specialized training to the staff of telecom
factory (at least 15 numbers) on repair of the IFWTs/FWTs without any cost. The
supplier shall provide continuous support for a period of 7 years in supplying the
spare parts at the same rates or negotiated lower rates. BSNL also reserves the
right, not to procure the repairing infrastructure each SSA headquarter, where
supplier’s equipment is installed. The date of handing over faulty terminals to such
courier service/agency shall be construed as the date of handing over the same to
the supplier concerned.
Please consider the alteration as follows :
The date of delivery of faulty terminals by such courier service/agency at the nodal
centre shall be construed as the date of handing over the same to the supplier
concerned.

       Kindly note : BSNL is asking 3 types of IFWTs, with 3 colours, meaning a
       vendor has to submit (3x3x6) = 54 samples.

       Kindly makes sure how many samples are needed? If every type of sample
       has to go thru CDG II test than any body would need at least 1 and half
       year to get CDG II test done. Normally a CDG II test cycle is 9 months (
       including waiting period). If one model after another sequenced for CDG
       II, it will take lot of time.

       Our suggestion is;
       1. KINDLY allow us time for CDG II tests to be carried out. We request
       the date of submission of tender be kindly extended by at least 2 months to
       help us prepare the samples required by BSNL.
       2. Please allow us that the CDG II test report be submitted during the type
       approval process as these samples will now be meeting the BSNL/TEC
       requirement, and not at the time of submitting samples/B form. The CDG
       II testing requires certain amount to be paid in USD, and if there is no
       commitment and so many samples are being asked, there should be some
       relaxation some where.

         the IFWT body.
       3. Please clarify whether all three color IFWTs should be submitted for

         internal circuitory is the same.
       Also please note the time given for submitting these many samples is not
         sufficient, we need at least 2 more months to comply to your
         requirement of submitting samples, accordingly the date for submission
         may please be extended.

       Also note that technology changes so fast that no body can keep/predict
       spares inventory for 7 years. BSNL has to decide in the beginning how
       much inventory they need to buy and keep for how many years. This
       clause should not be made applicable for Terminals, for Infra Systems it
       might be Ok.

       check before submission to TEC. The external SMPS with 7AH battery
       needs to be developed and hence BSNL asking to submit the sample
       before the tender submission date looks a very difficult task. We request;
           i.      In Order to make a quality product along with indigenous
                   SMPS power supply with 7AH battery and offer to BSNL at the
                   best possible price, we would request for extension of tender
                   upto month end of October, 2004. Trust BSNL in the best
                   interest of the vendor and to get quality product at competitive
                   price will consider our request favorably.
          ii.     Alternately BSNL can relax the condition of asking to submit
                  the sample to TEC and Switching Planning at the time of tender
                  submission. The sample can be submitted after 1 month. The
                  condition CDG II and CDG III tests to be conducted may
                  remain unchanged.

       or 3 original manufacturers for this product all over the World. They will
       not give us either technical or after sales service support for this small
       quantity. Hence, this product cannot be offered to TEC for validation or
       taken up for AMC. As such we request that this product may please be
       deleted from the schedule of requirement of this tender and whenever
       BSNL decided to Procure Mobile Terminals this may be added that time to
       get the maximum advantage. Trust BSNL understand the difficulty and
       take a second look on the issue.
145.   Clause no.3.6.9 (i) (b) specifies Protection Features for 60 V DC for 4 Clause is clear. No clarification is required.
