FIDM on Bankruptcy Case (May 2007)
Question: I rec’d FIDM worklist items on this case. The NCP had filed for Chapter 13
bankruptcy 6/29/04, at that time no enforcement action could be taken. Do you know
how long before enforcement action can be taken? (I think it is 2 years.)
Answer: A Chapter 13 petition that was filed prior to October 17, 2005 could have a
stay lasting three (3) to five (5) years. When the bankruptcy ends, the Division of Child
Support should receive a notice of discharge from the court. Enforcement actions can
be taken once a notice of discharge has been received. To receive information on an
