ORDER APPROVING APPLICATION; APPROVING TARIFF SHEETS; AND APPROVING SERVICE AREA MAP OVERLAY BY THE COMMISSION: Background On October 23, 1998, the MUNICIPALITY OF ANCHORAGE d/b/a ANCHORAGE WATER AND WASTEWATER UTILITY, Water Division (AWWU), filed an application to amend its Certificate of Public Convenience and Necessity (Certificate) No. 122 to extend its service area to include the Eklutna Water Treatment Facility (EWTF) plant. AWWU is authorized it to provide water utility service throughout most of the Municipality of Anchorage. The purpose of the
requested service area expansion is to enable AWWU to sell bulk water from the water basin at the EWTF to independent water bottlers.

The application and Special Contracts were noticed to the public on October 28, 1998, with a closing date of
November 27, 1998, for submission of statements in support of, or in opposition to, the filings. in response to the notice. The Commission Staff (Staff) reviewed the filings in this proceeding and on November 25, 1998, submitted its analysis and recommendation (Report) thereon. Staff’s Report sets out in No public comments were received
detail the history of the proceeding, the public notice of the application, and Staff’s findings and recommendations regarding disposition of the application. A copy of Staff’s Report is
attached to this Order as an Appendix.1 Based on its review, Staff stated that the public convenience and necessity requires the provision of water public utility service at AWWU’s EWTF plant site and that AWWU has demonstrated that it is fit, willing, and able to provide the service. Staff determined the first revisions to tariff Sheet Nos. 34 and 50, filed with the application, were in compliance with Commission standards and recommended approval. Staff also
recommended approval of the revised AWWU service area map overlay filed with the application, which satisfied the intent of Ordering

Further, Staff recommended
that the Commission make note of AWWU’s failure to timely amend its certificated water service area boundaries prior to commencement of service to the bottled water customers in the Docket U-98-142 proceeding. Discussion Based on its review of the record in this proceeding, the Commission concurs with Staff's recommendation that the public convenience and necessity require water public utility service to the bulk water sales customers at AWWU’s EWTF plant site, and that AWWU is fit, willing, and able to provide that service. The
Commission also concurs with Staff’s recommendation to approve the revised tariff Sheet Nos. 34 and 50, as well as the revised AWWU service area map overlay filed with the application, which
satisfied the requirements of Ordering Paragraph No. 4 of Order U-97-142(1). Staff’s Report is incorporated herein by reference and adopted as the Commission’s findings of fact and conclusions of law.

1998, by the Municipality of Anchorage d/b/a Anchorage Water and Wastewater Utility, Water Division, are approved. 3. The revised service area map overlay filed by the
