Through a fiction put forth in the Constitution itself (article 375), the Constitution does not lose its validity in the face of an attack by brute force or political-legal machinations; as such, it is still valid despite the coup d’�tat. What is unprecedented is that the coup d’�tat was the product of a conspiracy of all the Powers and other organisms of State, the business leadership, the leadership of the political parties (except UD), and of some religious leaders and civil society. This has made clear the fact that public [state] power and the powers of the establishment are one and the same, and that they are convinced they can act with impunity. For this reason we should not be surprised that they have conspired unscrupulously against the nation, against democracy, against history and against reason. They were not concerned with the crisis they could generate on a national or regional level; nor did they care about the reactions of the international community; much less did they care about the future of the country. Their hate, intransigence, intolerance, and stubbornness were stronger; they gave in to the sense of impunity that comes from the arbitrary exercise of power. In this process, not once have intelligence, imagination or insight–all vital elements of successful conspiracies–played a role; in their place, what stands out is clumsiness, simple�mindedness, and the abundance of dilly-dallying. This is why the conspiracy has proved to be a categorical and resounding fiasco. Por una ficci�n planteada por la misma Constituci�n (Art. 375), �sta no pierde su vigencia ante ning�n atentado, proveniente de la fuerza bruta o de maquinaciones pol�tico- jur�dicas; por ello, est� vigente a pesar del Golpe de Estado.Lo in�dito es que el Golpe de Estado fue producto de una conspiraci�n de todos los Poderes y dem�s �rganos del Estado, la dirigencia empresarial, la dirigencia de los Partidos Pol�ticos (excepto UD), y algunos dirigentes religiosos y de la sociedad civil.Se puso al descubierto que el poder p�blico y el poder f�ctico est�n gran�ticamente unidos y est�n convencidos de que pueden actuar con impunidad. Por lo que no debe sorprender que hayan conspirado inescrupulosamente contra el pueblo, contra la democracia, contra la historia y contra la raz�n. No les preocup� la crisis que podr�a generarse, a nivel nacional o regional; tampoco las reacciones de la comunidad internacional; menos les import� el futuro del pa�s. Pudo m�s el odio, la intransigencia, la intolerancia, la obcecaci�n; se rindieron ante la sensaci�n de impunidad que dispensa el ejercicio arbitrario del poder. Por ello, no aparece por ninguna parte la inteligencia, la imaginaci�n y la perspicacia, que tan �tiles son en las conspiraciones; en su lugar, se destaca la torpeza, la simpleza y la abundancia de nader�a. The National Congress, directed by Mr. Roberto Micheletti Bain, elected the 15 members of the current Supreme Court in January of this year, 2009, from a list of attorneys presented by Mr. Micheletti to the Congress. On June 29th, 2009, the National Congress of Honduras interpreted president Zelaya’s disapproval, as removal of president Zelaya. The Congress then elected Mr. Micheletti, its president, as the president of Honduras based on a subjective absolute absence of President Zelaya, while President Zelaya’s absence was not absolute. It was, instead, forced and temporary, as he was violently taken out of his office and expatriated by the Army, a day before. The National Congress also had a letter of resignation by President Zelaya under consideration. The letter was signed three days before the coup. This resignation consequently would drop charges and close President Zelaya’s case. These National Congress actions were taken after a Congressional Decree dated Monday 29, 2009, at 12:45 AM - a day after President Zelaya was removed violently from his office and expatriated by the Army on Sunday June 28th at 5:30 AM. The Supreme Court failed to address the original Executive Orders of President Jos� Manuel Zelaya Rosales and allowed the Honduran lower Court of Letters and the Contentious Administrative to deal with the constitutional matter beyond the competence of this Court. The United States is leading an international effort to address this“dangerous depots” problem.Since 1993, the United States government has provided a total of more than $1.4 billion to clear landminesand unexploded ordnance. In 2008, the Department of State provided $123.1 million in assistance to 35countries and continues to work bilaterally and multilaterally to cooperate and enact stricter controls.
