The police misconduct is obvious. But it is appalling that a Harvard Law Professor does not know the principles of constitutional law sufficiently to have handled this matter more professionally. This document is a portion of a letter brief I wrote on behalf of a white defendant on astonishingly similar facts.Text in blue shows changes to the text of the excerpt of the brief or my comments regarding Professor Gates' case.If Professor Gates does not know these bedrock legal principles, he is obviously not conveying them to his students. The bottom line is simple: Under a case known as Terry v. Ohio, citizens In public places can be briefly detained, required to identify themselves and submit to a pat down search for weapons. But, absent exigent circumstances (hearing screams for help, seeing a house on fire, seeing a crime while it is being committed, etc.) police cannot enter onto private property, particularly a private home, without a warrant. And, if the police do not have a warrant and show up at your door, you do not have to talk to them (since they are trespassers). Needless to say, voluntarily talking to police – ever – is a very bad idea, unless you are making a criminal complaint. Police are allowed to lie, and they do so all the time. Anyone asked for information by a police officer who claims to be investigating a crime and just collecting information should say, “I'll be happy to cooperate. I'll have my lawyer call the prosecutor and have him issue a 'witness letter' (a document formally saying that the citizen is providing information only as a witness and is not the subject, target or 'person of interest' in any case). Give me your card, Officer. When the results of such an exam to fill vacant lieutenant and captain positions showed thatwhite candidates had outperformed minority candidates, a rancorouspublic debate ensued. Confronted with arguments both for and against certifying the test results—and threats of a lawsuit eitherway—the City threw out the results based on the statistical racial disparity. Petitioners, white and Hispanic firefighters who passedthe exams but were denied a chance at promotions by the City’s re-fusal to certify the test results, sued the City and respondent officials,alleging that discarding the test results discriminated against thembased on their race in violation of, inter alia, Title VII of the Civil Rights Act of 1964. The defendants responded that had they certifiedthe test results, they could have faced Title VII liability for adoptinga practice having a disparate impact on minority firefighters. S. C. 623(a). At the close of trial, and over FBL’s objections, theDistrict Court instructed the jury to enter a verdict for Gross if he proved, by a preponderance of the evidence, that he was demoted andhis age was a motivating factor in the demotion decision, and told thejury that age was a motivating factor if it played a part in the demo-tion. It also instructed the jury to return a verdict for FBL if it proved that it would have demoted Gross regardless of age. The juryreturned a verdict for Gross. The Eighth Circuit reversed and re-manded for a new trial, holding that the jury had been incorrectly in-structed under the standard established in Price Waterhouse v. Hop-kins, 490 U. The settlement agreement and reorganization plan were approved by the Bankruptcy Court (1986 Orders) and were affirmed by the District Court and the Second Circuit. Over a decade later plaintiffs began filing asbestosactions against Travelers in state courts (Direct Actions), often seek-ing to recover from Travelers not for Manville’s wrongdoing but for Travelers’ own alleged violations of state consumer-protection stat-utes or of common law duties. Invoking the 1986 Orders, Travelers asked the Bankruptcy Court to enjoin 26 Direct Actions. The indictment also charged petitioner with money laundering for conducting varioustransactions with the proceeds of his stock sales. The jury acquittedYeager on the fraud counts but failed to reach a verdict on the in-sider-trading and money-laundering counts. After the Government recharged him with some of the insider-trading and money-laundering counts, Yeager moved to dismiss the charges on the ground that the jury, by acquitting him on the fraud counts, had nec-essarily decided that he did not possess material, nonpublic informa-tion about the project’s performance and value, and that the issue-preclusion component of the Double Jeopardy Clause therefore barred a second trial for insider trading and money laundering. The District Court denied the motion, and the Fifth Circuit affirmed, rea-soning that the fact that the jury hung on the insider-trading andmoney-laundering counts—as opposed to acquitting petitioner—castdoubt on whether it had necessarily decided that petitioner did not possess material, nonpublic information.
